AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF UKIAH SETTING ASIDE
ORDINANCE NO. 1146 AND REINSTATING ORDINANCE NO. 1098 AND THE AIRPORT
INDUSTRIAL PARK LAND USE MAP AS THEY READ IMMEDIATELY PRIOR TO THE ADOPTION
OF ORDINANCE NO. 1146.
WHEREAS,
The Superior Court of California for Mendocino County has issued a writ of mandate ("Writ")
directed to the City of Ukiah ("City") and the City Council of the City of Ukiah in Ukiah Citizens
for Safety First v. City of Ukiah et al., Case No. SCUKCVPT 14-63579, commanding it to,
among other things, set aside the City of Ukiah's approval of City of Ukiah Ordinance No.
1146, amending the Airport Industrial Park Planned ("AIP") Development Plan, which changed
the land use designation of 4.1 acres in the AIP from Industrial/Automotive Commercial to
Retail Commercial and 11.2 acres from light Manufacturing/Mixed Use to Retail Commercial;
and
2. The City is required to file a return with the Court demonstrating compliance with the Writ by
no later than December 3, 2016; and
3. This ordinance must be adopted as an urgency ordinance in order to file the required return
within the time prescribed by the Writ;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF UKIAH DOES ORDAIN AS FOLLOWS:
1. City of Ukiah Ordinance No. 1146, including the Airport Industrial Park Land Use Map, as
amended by said ordinance, is hereby repealed and set aside.
2. City of Ukiah Ordinance No, 1098, adopted on July 23, 2007, including the Land Use Map
attached thereto, is hereby reinstated, returning 4.1 acres in the AIP to the
Industrial/Automotive Commercial land use designation and returning 11.2 acres to the light
Manufacturing/Mixed Use land use designation.
3. Pursuant to Government Code Section 36937(b), in order to preserve the public peace,
health or safety, by complying with a court order, this ordinance shall be introduced and
adopted at a single City Council meeting and shall become effective immediately upon its
adoption.
