HomeMy WebLinkAbout87-30 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 87-30 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH ORDERING THE CALDWELL FRONTAGE ROAD REORGANIZATION WHEREAS, the Mendocino County Local Agency Formation Commission on November 3, 1986 approved the "Caldwell Frontage Road Reorganization" by Resolution No. 86-6, and WHEREAS, said Commission designated the City of Ukiah City Council to be the conducting authority for subsequent proceedings, and WHEREAS, the proceedings were authorized to be held without notice, hearing or election pursuant to Government Code Sections 56836 and 56937, and WHEREAS, the subject properties, Mendocino County Assessor Parcel Numbers 180-040-06, 07, and 08 and 180-060-01 were prezoned from Mendocino County "AG-40-FP" and "C-2, 6000-FP" to City of Ukiah "C-i" Light Commercial by Ordinance Numbers 844 and 846, and WHEREAS, the properties are "uninhabited", and WHEREAS, the conducting authority is to act upon the subject reorga- nization within 30 days of the Commission's action, and WHEREAS, pursuant to the California Environmental Quality Act (CEQA) Guidelines (Section 15319) annexation of existing facilities is categorical- ly exempt from environmental evaluation, Categorical Exemption Class 19. NOW, THEREFORE, IT IS HEREBY RESOLVED that the Caldwell Frontage Road as depicted on attached Exhibits A (map) and B (legal description) is ordered, with subject properties annexed to the City of Ukiah and detached from the Ukiah Valley Fire Protection District. BE IT FURTHER RESOLVED that the City Clerk pursuant to Government Code Section 56450 is directed to transmit a certified copy of this resolution, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 17 18 19 2O 21 23 24 25 26 27 28 the applicable State Board of Equalization filing fees, and signed mylar of the Annexation Map and original legal description to the Executive Officer of the Mendocino County Local Agency Formation Commission for certification and filing with the State of California. Johnson to Evelyn May Johnson, as recorded December 30, 1977, in Official Records of Mendocino County in Book 1125, Page 500; thence along said Easterly line S 08° 35' 42" E 170.48 feet to a point in the Northerly line of Caldwell Frontage Road; thence along said Northerly line, S 88° 39' 11" W 28.44 feet to a point in the Easterly line of U.S. Highway 101, said Easterly line also being the existing City boundary as established by Resolution No. 82-45, adopted by the City Council of the City of Ukiah on February 3, 1982, 1 of 2 as recorded February 10, 1982, in Official Records of Mendocino County in Book 1340, Page 171; thence along said existing City boundary with the following courses; thence curving to the left with a radius of 150 feet, from a tangent which bears S a7° 49' 07" E, through an arc of 36° 54' 27", for a distance of 96.63 feet; thence S 86° 34' 43" E 698.04 feet to a point in the Northerly line of State Highway 222; thence crossing said Highway, S 05° 48' 49" E 113.98 feet to a point in the Southerly line of said Highway; thence along said Southerly line, curving to the right with a radius of 1450 feet, from a tangent which bears S 86° 46' 33" E, through an arc of 04° 16' 40", for a distance of 108.26 feet to the intersection of said Southerly line with the Easterly line of Hastings Frontage Road; thence along the Easterly line of Hastings Frontage Road with the following courses; thence S 18° 20' 27" W 137.30 feet; thence S 05° 48' 49" E 50.00 feet to the point of beginning and containing 6.5 acres of land, more or less. 2 of 2
