HomeMy WebLinkAbout87-25 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 87-25 RESOLUTION ABANDONING EXCESS STREET RIGHT-OF-WAY - DESPINA DRIVE WHEREAS, the City of Ukiah acquired Despina Drive right-of-way by Annexation No. 80-3, as said annexation was recorded December 16, 1980 in Official Records of Mendocino County, Book 1286, Page 187; and WHEREAS, a portion of the Despina Drive right-of-way as more particularly depicted and described on the attached Exhibit "A", which is incorporated herein by reference as though set forth in full (hereafter, "excess right-of- way") is excess and not required for street or highway purposes; and WHEREAS, for that reason the City of Ukiah intends to summarily vacate said right-of-way under the authority of Chapter 4 of Part 3 of Division 9 of the California Streets and Highways Code ("S & H Code"); NOW, THEREFORE, the City Council of the City of Ukiah RESOLVES AND FINDS as follows: 1. This vacation of a public right-of-way for roadway purposes is made under the provisions of Chapter 4 of Part 3 of Division 9 of the S & H Code. 2. The road easement vacated under by this resolution is a portion of Despina Drive referenced herein as the excess right-of-way and more particularly described in Exhibit "A". 3. This summary vacation is made based on the following facts: Right-of-way was acquired through annexation into the City of Ukiah by Annexation No. 80-3 and existing adjacent subdivision develop- ments and street improvements of Despina Drive have established the alignment for the street right-of-way. The existing right-of-way extending beyond the street improvements is deemed excess and not needed for roadway purposes. From and after the date this resolution is recorded, the portion of Despina Drive described and depicted in Exhibit "A" no longer constitutes a part of the Despina Drive right-of-way or a street. PASSED AND ADOPTED this Sth day of November , 1986 by the following roll call vote: AYES: Councilmembers Schneiter, Shoemaker, and Mayor Henderson NOES: None ABSENT: Councilmembers Hickey and Kier ATTEST: (2 of 2)
