RESOLUTION NO. 87-1~
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH
APPROVING TENTATIVE SUBDIVISION MAP NO. 86-70,
SIERRA SUNSET, UNIT THREE
WHEREAS, the Planning Commission on July 23, 1986 considered and
recommended approval of Tentative Map No. 86-70, Sierra Sunset Unit Three,
and
WHEREAS, the City Council approved Use Permit No. 86-66 (Resolution No.
87-1) for the Sierra Sunset Planned Development (which encompasses the
property of this subdivision) subject to 18 conditions, and
WHEREAS, the Director of Public Works reports that the City of Ukiah
has sufficient wastewater capacity to handle waste waters for this project
without violation of Water Quality Control Board Standards, and
WHEREAS, a focused Environmental Impact Report for the development of
316 units of which this project is a part, and a Negative Declaration for
the increase to 395 units were adopted by the City Council, thus the
tentative map does not require further environmental evaluation.
NOW THEREFORE, BE IT RESOLVED that Tentative Map No. 86-70 (Attached
Exhibit A) for Sierra Sunset, Unit Three, is approved conditioned upon
compliance with all applicable State Statutes, local ordinances, conditions
of approval of Use Permit No. 86-66 and the following specific conditions:
1. In-lieu park fees shall be paid as required by City Code (Article 21,
Sections 8400-8410).
2. The developer shall dedicate with each building permit an easement on
each property for the purpose of assuring that each parcel or unit in
this subdivision shall have solar access for reasonably placed solar
energy systems. Ail applicable building codes relating to energy
conservation and the appropriate provisions of the California Solar
Rights Act of 1979 shall be complied with by the developer.
3. Hours of construction are limited to 7:00 a.m. to dark, Monday through
Saturday.

4. Dust control measures be instituted during construction.
5. Single family detached units shall meet the standard R-1 site
requirements including 20 foot front setbacks to garages, five foot
side yard setbacks and 15 foot rear yard setbacks.
6. A fee prorated on a per unit basis for 25% of the cost of signalization
at North Bush Street and Low Gap Road shall be paid prior to
recordation of the Final Map.
7. Developer shall purchase, install, and maintain for one year, City
specified street trees to be planted in the planter strip between the
sidewalk and the curb at locations determined by the City throughout
the subdivision according to a street tree program approved by staff.
8. If the City adopts an ordinance to mitigate impacts on Ukiah Unified
School District schools, any development under this subdivision
undertaken pursuant to building permits issued more than 30 days after
the effective date of the ordinance will be subject to that ordinance.
9. The developer shall enter into an agreement with the City of Ukiah and
the Community Development Commission of Mendocino County (CDCMC) to
provide iow and moderate income housing pursuant to California
Government Code section 65915 and based upon the concept presented in
the July 1 letter from CDCMC.
10. A Site Development Permit shall be secured for the apartments to be
constructed on lot 34.
