HomeMy WebLinkAbout87-40 - Annexation of Bush St North 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 87-40 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH MAKING APPLICATION TO THE MENDOCINO COUNTY LOCAL AGENCY FORMATION COMMISSION FOR THE BUSH STREET NORTH REORGANIZATION WHEREAS, Government Code Section 56800 requires a resolution of application to the Local Agency Formation Commission (LAFCO) for proposed annexation to an existing City and detachment of area from a District, and WHEREAS, Government Code Section 56700 specifies the contents of such resolution, and WHEREAS, the City of Ukiah is the sole property owner in the subject area to be annexed, NOW THEREFORE BE IT RESOLVED: 1. The City of Ukiah applies for annexation of the area known as "Bush Street North", and 2. This proposal is made pursuant to Division 3 of Title 6 of the Government Code titled "Cortese-Knox Local Government Act of 1985", and 3. The proposed "Bush Street North Reorganization" encompasses 0.41 acres adjacent on the north to the City of Ukiah, Mendocino County Assessor Parcel Number 170-220-07 and a portion of Bush Street as illustrated by Exhibit A (map) and Exhibit B (legal description), and 4. The City of Ukiah proposes to provide the appropriate urban services to the subject area as specified in Exhibit C (Plan for Services) which has been prepared pursuant to Government Code Section 56653, and 5. This proposal is made because the City of Ukiah owns all of the non public right-of-way property within the annexation area and it is a legitimate extension of City boundaries, and 6. The subject property has been prezoned from Mendocino County to City of Ukiah "R-3", Multiple Family by City Council Ordinance Number 858 and 7. The area is proposed to be detached from the Ukiah Valley Fire Protection District as fire service will be provided by the City of Ukiah upon annexation, and - 1 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 8. The area is proposed to be detached from the Millview County Water District as water service will be provided by the City of Ukiah upon annexation, and 9. The area is uninhabited and vacant, and 10. Pursuant to the California Environment Quality Act the action of reorganization is determined categorically exempt, Class 19, Annexation of Existing Facilities and Lots for Exempt Facilities, and 11. The City of Ukiah requests that proceedings be initiated by the Mendocino County Local Agency Formation Commission pursuant to Government Code Section 56000 et sq. for reorganization of the area including annexation to the City of Ukiah, detachment from the Ukiah Valley Fire Protection District and detachment from the Millview County Water District and pursuant to code sections 56836 and 56937, that this action be done without notice and hearing since 100% of the property owners (the property is owned by the City of Ukiah) consent to the proposal, and 12. The City Clerk is hereby directed to forward seven certified copies of this Resolution of Application, including Exhibits A, B and C and all other documents required by said Commission to the Executive Officer of the Mendocino County Local Agency Formation Commission. PASSED AND ADOPTED this 4th day of March, 1987by the following roll call vote: AYES: Councilmembers Schneiter, Shoemaker, Hickey, Kier, and Mayor Henderson NOES: None ABSENT: None ATTEST C I~ CLERK MAYOR - 2 - EXHIBIT B CITY OF UKIAH NORTH BUSH STREET REORGANIZATION DESCRIPTION Beginning at a point in the existing City Boundary as established by Las Casas Annexation No. 80-3, as recorded December 16, 1980, in Official Records of Mendocino County, Book 1286, Page 187, said point being also a point on the Westerly line of North Bush Street; thence along said Westerly line, N 1° 30' 29" W 79.16 feet to its intersection with the Westerly extension of the Northerly line of Lot 7, of Vineyard View Estates Subdivision Unit 2 - Phase 2, Tract 201, as shown on a map recorded June 19, 1981, in Map Case 2, Drawer 38, Page 16, Mendocino County Records; thence along said Westerly extension and said Northerly line, N 88° 29' 31" E 218.87 feet to the Northeasterly corner of said Lot; thence along the Easterly line of said Lot, S 2° 18' 09" E 83.25 feet to the Southeasterly corner of said Lot, said corner being also a point on the existing City Boundary as established by Empire Gardens Addition, as recorded November 6, 1952, in Map Case 1, Drawer 9, Page 112, Mendocino County Records; thence along the existing City Boundary, S 89° 33' 18" W 22.06 feet to the point of beginning and containing 0.41 acres more or less. CITY OF UKIAH EXHIBIT C PLAN FOR PROVISION OF URBAN SERVICES: BUSH STREET NORTH REORGANIZATION FEBRUARY 24, 1987 Pursuant to Section 56653 of the State of California Government Code, a plan for the provision of urban services to a newly annexed area must accompany an application for annexation. This plan is prepared in conjunction with the annexation application to the Mendocino County Local Agency Formation Commission for the acreage encompassed in the Bush Street North Reorganization to the City of Ukiah. The area to be annexed is adjacent on the north of the City of Ukiah and includes a portion of Bush Street. Existing land use in the area is vacant. The total area to be annexed is approximately 0.41 acres, 5600 square feet of which is public right-of-way. Existing services to the area are provided by the County of Mendocino in the General government functions of Administration, Planning, Building Inspection, Public Health, Public Works and Sheriff. Electricity is provided by Pacific Gas & Electric Company; sewerage services by Ukiah Valley Sanitation District; and water by Millview County Water District. Fire prevention and protection is provided through the Ukiah Valley Fire Protection District (a special district on contract with the City of Ukiah). Telephone, gas and cable television are currently supplied and would continue to be provided by Pacific Bell, P.G.&.E. and Group W respectively. Solid waste disposal is on an individual property owner basis. The proposal is annexation to the City of Ukiah, a full service municipality. In addition to general administrative activities, the City of Ukiah provides police and fire services, its own water production and distribution system, its own electric generation and distribution system, a sewage treatment plant in conjunction with the Sanitation District and Public Works services including street maintenance and capital improvements. Solid waste disposal is through City franchise with a private hauling company. In general, the proposed services to be provided to the annexation area would be those currently existing in the City of Ukiah which are enumerated in detail below. The level and range of these services would be the same as currently provided within City boundaries. Increased demand would not cause a decrease in the levels of service to either existing City residents or the new area. The services can feasibly be extended to the affected territory immediately, as presently the City is adjacent to the property and some City services are involved with backup assistance agreements (police and fire). No specific improvements to structures, roads, sewer or electric facilities are proposed without specific development taking place. Other services to be provided would be financed through the existing City revenue structure which includes property taxation, and reimbursement from the State government under various in-lieu and per capita subvention programs. User fees for electric, water, sewer, and solid waste will be charged for these respective services. - 1 - Presented here is documentation related to the specific services which would be provided to the annexed area. SERVICES PUBLIC SAFETY FIRE A. Service to be extended: Fire protection and prevention. B. Level and range of service: This area is currently served by the Ukiah Valley Fire Protection District whose services are provided under contract by the City of Ukiah. The City Fire Department is staffed by 17 full time firefighters with 29 volunteers. The Fire Chief states that no new personnel would be required to provide service to this area, though annexation will result in less reimbursement from the Fire District. C. When available: Immediate]_y. D. Improvements Required: None. E. Conditions to be imposed by City: None. F. How financed: City General Fund revenues. POLICE A. Service to be extended: Police protection and assistance. B. Level and range of service: The area is currently served by the Mendocino County Sheriff with the City of Ukiah Police Department providing back-up assistance as required. The City Department has 24 sworn personnel and 13 reserves. The Police Chief states that no new personnel would be required for this annexation. C. When available: Immediately. D. Improvements required: None. E. Conditions to be imposed by City: None. F. How Financed: City General Fund reserves. UTILITIES ELECTRIC A. Service to be extended: Electricity. B. Level and range of service: Currently the area is vacant but could be provided with electrical e~.ergy through the facilities - 2 - of P.G.& E. The City of Ukiah has its own electric generation and distribution system. Currently, the City has the capacity to accommodate additional loads in this area and revenues anticipated through user fees would pay for any required maintenance and operation of this system on an annual basis. The City provides the same levels and range of service as provided by P.G. & E., meeting demands ranging from minimum voltage and amperage in residential units to large loads in high density residential and heavy commercial uses. The anticipated demand is minimal. The City presently has a capacity of 40,000 KW with a current peak demand of 27,000 KW. C. When available: Immediately. De Improvements required: necessary. Specific improvements would not be E. Conditions to be imposed by the City: Specific conditions would be imposed by the City at time of any new development and include undergrounding and construction/placement of capital improvements at that time. No other conditions are necessary. F. How financed: Electric revenues. SEWERAGE A. Service to be extended: Sewage collection and disposal. B. Level and range of service: The area is currently served by the Ukiah Valley Sanitation District. There will be no change in the status of the responsible agency upon annexation as the district would retain its jurisdiction with current tax and use fee charges. No extension of service is necessary as the property is vacant. New development would require normal new installations. C. When available: Immediately. D. Improvements required: No immediate improvements are necessary. E. Conditions to be imposed by the City: None. F. How financed: Property tax levies and user fee charges. WATER me Service to be extended: Water for domestic and fire prevention uses. B. Level and range of service: The area is within the Millview County Water District. The City of Ukiah will provide water delivery upon annexation. C. When available: Immediately. -3 - Do Improvements required: No improvements are necessary at the present as the property is vacant. E. Conditions to be imposed by the City: None. F. How financed: On-going maintenance and operation of the system would be paid from the monthly use fees and service charges. SOLID WASTE A. Service to be extended: Solid waste collection and disposal. B. Level and range of service: Current service in the County is based upon individual property owner discretion. Within the City, solid waste service is provided through contract with Ukiah Solid Waste. Material is deposited at the City of Ukiah Sanitary Disposal Site which has satisfactory capacity for the entire valley population through the year 2000. C. When available: Immediately. D. Improvements required: None. E. Conditions to be imposed by the City: Collection by franchised company is required within City limits. F. How financed: User fees/service charges. No cost to City because of franchise with private agency. Revenues are generated through franchise fee. GENERAL GOVERNMENT A. Service to be extended: General administration and miscellaneous services. B. Level and range of service: The area is currently served by the County of Mendocino in the functions of administration (including Personnel, Planning, Building, etc.) and Public Works. The City is a full service municipality, encompassing the functions of City Manager, City Attorney, City Clerk, City Council, Treasurer, Personnel, Finance (including Purchasing and Warehousing), Community Development (including Planning Commission, Planning and Building), Parks and Recreation, Fire, Police, and Public Works, operating street maintenance and engineering, weed abatement, municipal garage and corporation yard. The annexation area can be serviced at existing service levels with existing staff. County-wide programs, such as public health, social services, etc., would continue to be the responsibility of the County. C. When available: Immediately. D. Improvements required: None. -4- E. Conditions to be imposed by the City: None. F. How financed: City General Revenue funds. FINANCING As noted previously, other than user fees for water, electricity, sewerage and solid waste disposal, urban services would be financed through the City of Ukiah General Fund. Major annual revenues include property tax, sales tax, per capita subventions from the State, and enterprise fund income. Presented here are approximate revenues and expenses for the annexation. These calculations reflect the existing vacant nature of the property and approximately 80 feet of street frontage. One time costs exceed net revenue, but deficit would be recovered within eight years. SUMMARY: As a full service municipality, the City of Ukiah will be providing all basic governmental functions and urban services for this area. The level of service charges and general governmental revenues would be as currently exist. The availability of services is immediate. 2/25/87:MFH:be - 5 -
