RESOLUTION NO. 88-22
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH
MAKING APPLICATION TO THE MENDOCINO COUNTY LOCAL
AGENCY FORMATION COMMISSION FOR THE KUKI ROAD REORGANIZATION
WHEREAS, Government Code Section 56800 requires a resolution of
application to the Local Agency Formation Commission (LAFCO) for proposed
annexation to an existing City and detachment of area from a District, and
WHEREAS, Government Code Section 56700 specifies the contents of such
resolution, and
WHEREAS, the City of Ukiah has been requested by the property owner in
the subject area to be annexed,
NOW THEREFORE BE IT RESOLVED:
1. The City of Ukiah applies for annexation of the area known as "KUKI
Road", and
2. This proposal is made pursuant to Division 3 of Title 6 of the
Government Code titled "Cortese-Knox Local Government Reorganization
Act of 1985", and
3. The proposed "KUKI Road" Reorganization encompasses 4.8 acres to the
north of the City of Ukiah, including Mendocino County Assessor Parcel
Numbers 170-140-09, 10, 11 and 12 as illustrated by Exhibit A (map) and
Exhibit B (legal description), and
4. The City of Ukiah proposes to provide the appropriate urban services to
the subject area as specified in Exhibit C (Plan for services) which
has been prepared pursuant to Government Code Section 56653, and
5. This proposal is made because: 1) the property owner of all the parcels
requested annexation, and 2) it is a legitimate extension of City
boundaries, and
6. The subject properties have been prezoned from Mendocino County "C-2,
6,000" to City of Ukiah "C-I", Light Commercial, and
7. The entire area is proposed to be detached from the Ukiah Valley Fire
Protection District and Millview County Water District, as fire
protection and water services will be provided by the City of Ukiah

upon annexation, and
8. The area is uninhabited as there is only one registered voter within
the annexation boundaries, and
9. Pursuant to the California Environmental Quality Act the action of
reorganization is determined categorically exempt, Class 19, Annexation
of Existing Facilities and Lots for Exempt Facilities, and
10. The City of Ukiah requests that proceedings be initiated by the
Mendocino County Local Agency Formation Commission pursuant to
Government Code Section 56000 et seq. for reorganization of the area
including annexation to the City of Ukiah, detachment from the Ukiah
Valley Fire Protection District and detachment from the Millview County
Water District, and pursuant to Code Sections 56836 and 56837, that
this action be done without notice and hearing since 100% of the
property owners (single owner, Shaw Family Partnership) consent to the
proposal, and
11. The City Clerk is hereby directed to forward seven certified copies of
this Resolution of Application, including Exhibits A, B and C, a check
for the $150 filing fee, and all other documents required by said
Commission to the Executive Officer of the Mendocino County Local
Agency Formation Commission.

KUKI ROAD REORGANIZATION
"DESCRIPTION"
That certain real property situated in the County of Mendoctno, State of
California, more particularly described as follows:
Beginning at a point in the existing Northernmost Boundary of the City~ of
Ukiah, as established on that certain map, "The Empire Gardens Addition to the
City of Ukiah" filed November 6, 1952 in Map Case 1, Drawer 9, Page 112,
Mendocino County Records, said point being the intersection of said Boundary
with the Easterly line of KUKI Road, as shown on that certain map filed
September 18, 1961 in Map Case 2, Drawer 1, Page 107; thence Northerly along
the Easterly line of KUKI Road, N l°50'27'' W 397 feet, more or less, to the
beginning of a curve; thence continuing along the Easterly line of KUKI Road,
curving to the right, with a radius 78.58 feet, from a tangent which bears
N l°50'27'' W, through an arc of 38°41'52'', for a distance of 53.07 feet to the
Southwesterly corner of that tract of land, (2) Parcel two, Mobil Oil
Corporation to Robert F. Rinehart and Faye L.Rinehart, as recorded December
20, 1983 in Official Records of Mendocino County, Book 1436, Page 185; thence
leaving the Easterly line of KUKI Road, Northwesterly along the Southeasterly
line of said tract N 61°36' E 66.58 feet to the Northeasterly corner of said
tract, said corner being in the Southerly line of KUKI Road; thence Easterly
along the Southerly line of KUKI Road, N 86°18'53'' E 234.75 feet to an angle
point; thence continuing along said Southerly line, N 87°48'43'' E 91 feet,
more or less, to the Northwesterly corner of that parcel of land, (2) parcel
one, Mobil Oil Corporation to Robert F. Rinehart and Faye L. Rinehart, as
recorded December 20, 1983 in Official Records of Mendocino County, Book 1436,
Page 185; thence leaving the Southerly line of KUKI Road, Southerly along the
Westerly line of said parcel, S 02o02'57'' E 101.55 feet to the Southwesterly
corner thereof; thence Easterly along the Southerly line of said parcel, N
87°57'03'' E 150.00 feet to the Southeasterly corner thereof, said corner being
in the Westerly line of State Street; thence Southerly along the Westerly line
of State Street, S 01°50'27'' E 188.00 feet to the Northeasterly corner of that
tract of land, Richard C. Keehn and Karen S. Keehn to Waldo Shaw, as recorded
March 26, 1975 in Official Records of Mendocino County, Book 993, Page 663,
said corner being in the existing City of Ukiah Boundary as established on
that certain map, "Baldwin Annexation" filed January 19, 1956 in Map Case 1,
Drawer 10, Page 36, Mendocino County Records; thence Westerly and Southerly
along the said Boundary, S 89°31'40'' W 208.75 feet and S 01°50'27'' E 208.75
feet to its intersection with the Boundary of the City of Ukiah as established
on the aforementioned map "The Empire Gardens Addition to the City of Ukiah";
then~e Westerly along said Boundary, S 89°31'40'' W 344 feet, more or less, to
the point of beginning, and containing 4.8 acres of land', more or less.

PLAN FOR PROVISION OF URBAN SERVICES:
KUKI ROAD REORGANIZATION
OCTOBER 15, 1987
Pursuant to Section 56653 of the State of California Government Code, a plan
for the provision of urban services to a newly annexed area must accompany an
application for annexation. This plan is prepared in conjunction with the
annexation application to the Mendocino County Local Agency Formation
Commission for the acreage encompassed in the KUKI Road Reorganization to the
City of Ukiah.
The area to be annexed is immediately north of the City of Ukiah. Existing
land uses in the area are commercial with a motel and restaurant. The total
area to be annexed is approximately 4.8 acres.
Existing services'to the area are provided by the County of Mendocino in the
General government functions, including Administration, Planning, Building
Inspection, Public Health, Public Works and Sheriff. Electricity is provided
by Pacific Gas & Electric Company; sewerage services by the Ukiah Valley
Sanitation District; water is provided by Millview County Water District.
Fire prevention and protection is provided through the Ukiah Valley Fire
Protection District (a special district on contract with the City of Ukiah).
Telephone, gas and cable television are currently supplied and would continue
to be provided by Pacific Bell, P.G.&.E. and Century Cable respectively.
Solid waste disposal is on an individual property owner basis.
The proposal is annexation to the City of Ukiah which is a full service
municipality. In addition to general administrative activities, the City of
Ukiah provides police and fire services, its own water production and
distribution system, its own electric distribution system, a sewage treatment
plant in conjunction with the Sanitation District and Public Works services,
including street maintenance and capital improvements. Solid waste disposal
is through City franchise with a private hauling company.
In general, the proposed services to be provided to the annexed area would be
those currently existing in the City of Ukiah which are enumerated in detail
below. The level and range of these services would be the same as currently
provided within City boundaries. Increased demand would not .cause a decrease
in the levels of service to either existing City residents or the new area.
The services can feasibly be extended to the affected territory immediately,
as presently the City is adjacent to the property and some City services are
involved with backup assistance agreement (police and fire) or are now
provided to a portion of the area.
No specific improvements to existing facilities are proposed. Ail necessary
services would be provided to the properties by the City. Services would be
financed through the existing City revenue structure. User fees for electric,
water, sewer, and solid waste will be charged for these respective services.
Presented here is documentation related to the specific services which would
be provided to the annexed area.
SERVICES
PUBLIC SAFETY
FIRE
A. Service to be extended: Fire protection and prevention.
B. Level and range of service: This area is currently served by the
Ukiah Valley Fire Protection District whose services are provided
under contract by the City of Ukiah. The City Fire Department is
staffed by 17 full time firefighters with 29 volunteers. Minimum
manning is four firefighters operating out of two stations, one
located at 300 Seminary Avenue in downtown Ukiah and the other at
Lovers Lane and North State Street, immediately north of the
Freeway/State Street interchange. The Fire Chief states that no new
personnel would be required to provide service to this area, though
annexation will result in less reimbursement from the Fire District.
C. When~available: Immediately.
D. Improvements Required: None.
E. Conditions to be imposed by City:

POLICE
A. Service to be extended: Police protection and assistance.
B. Level and range of service: The area is currently served by the
Mendocino County Sheriff with the City of Ukiah Police Department
providing back-up assistance as required. The City Department has
24 sworn personnel and 13 reserves. Minimum staffing is three sworn
personnel operating out of the police station at 300 Seminary
Avenue. The Police Chief states that no new personnel would be
required for this annexation.
C. When available: Immediately.
D. Improvements required: None.
E. Conditions to be imposed by City: None.
F. How financed: City General Fund.

ELECTRIC
A. Service to be extended: Electricity.
Be
Level and range of service: Currently the area is provided with
electrical energy through the facilities of P.G.&.E. The City of
Ukiah has its own electric generation and distribution system.
Currently, the City has the capacity to accommodate additional loads
in this area and revenues anticipated through user fees would ~pay
for any required maintenance and operation of this system on an
annual basis. The City provides, at lesser rates, the same levels
and range of service as provided by P.G.&.E., meeting demands
ranging from minimum voltage and amperage in residential units to
large loads in high density residential and heavy commercial uses.
The City presently has a capacity of 40,000 KW with a current peak
demand of 25,000 KW.
C. When available: Immediately.

~mprovements required: Specific improvements would not be necessary
immediately other than for the City to connect its facilities within
the area.
E. Conditions to be imposed by the City: No conditions are necessary.
F. How financed: Electrical system revenues.
SEWERAGE
A. Service to be extended: Sewage collection and disposal.

Level and range of service: The entire area is currently served by
the Ukiah Valley Sanitation District. There will be no change in
the status of the responsible agency upon annexation as the district
would retain its jurisdiction with current tax and use fee charges.
No extension of service to current users is necessary as facilities
are in. New development would require normal new installations.
C. When available: Immediately.
D. ~mprovements required: No immediate improvements are necessary.
E- Conditions to be imposed by the City: None.

How Financed: Property tax levies and user fee charges on a monthly
basis would sustain operation at current levels.
WATER

Service to be extended: Water for domestic and fire prevention~
uses.
B. Level and range of service: Millview County Water District water
delivery within the annexation boundaries.

Improvements required: A City water main will be connected to the
on-site service.
E. Conditions to be imposed by the City: Millview services will be
disconnected by the City.
F. How financed: On-going maintenance and operation of the sy~tem
would be paid from the monthly use fees and service charges.
SOLID WASTE
A. Service to be extended: Solid waste collection and disposal.
B. Level and range of service: Current service in the County is based
upon individual property owner discretion. Within the City, solid
waste service is provided through contract with Ukiah Solid Waste.
Material is deposited at the City of Ukiah Sanitary Disposal Site
which has capacity for the City's population.
C. When available: Immediately.
D. Improvements required: None.
E. Conditions to be imposed by the City: Collection by franchised
company is required within City limits.
F. How financed: User fees/service charges. No cost to City because
of franchise with private agency. Revenues are generated through
franchise fee.
GENERAL GOVERNMENT
A. Service to be extended: General administration and miscellaneous
services.
B. Level and range of service: The area is currently served by the
County of Mendocino in the functions of administration (including
Personnel, Planning, Buildings, etc.) and Public Works. The City is
a full service municipality, encompassing the functions of City
Manager, City Attorney, City Clerk, City Council, Treasurer,
Personnel, Finance (including Planning Commission, Planning and
Building), Parks and Recreation, Fire, Police, and Public Works,
- operating street maintenance and engineering, weed abatement,
municipal garage and corporation yard. The annexation area can be
serviced at existing service levels with existing staff.
County-wide programs, such as public health, social services,
courts, etc., would continue to be the responsibility of the County.

Conditions to be imposed by the City: Applicable building codes and
local Ordinances.
F. How financed: City General Fund.
FINANCING
As noted previously, other than user fees for water, electricity, sewerage and
solid waste disposal, urban services would be financed through the City of
Ukiah General Fund. Major annual revenues include property tax, sales fax~
per capita subventions from the State, and enterprise fund income.
Presented here are approximate revenues and expenses for the annexation.
These calculations reflect existing activities with a 110 room motel, a
recently closed restaurant, and one registered voter.
