HomeMy WebLinkAbout89-30RESOLUTION NO. 89-30 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH APPROVING TENTATIVE SUBDIVISION MAP NO. 89-47, SIERRA SUNSET VILLAGE 1 2 3 WHEREAS, the Planning Commission on February 22, 1989 considered and 4 recommended approval of Tentative Map No. 89-47, Sierra Sunset Village, and WHEREAS, the City Council approved Use Permit No. 89-46 for the Sierra 6 Sunset Village Planned Development (which encompasses the property of this ? subdivision) subject to 19 conditions, and WHEREAS, the Director of Public Works reports that the City of Ukiah 9 has sufficient wastewater capacity to handle waste waters for this project 10 without violation of Water Quality Control Board Standards, and 11 WHEREAS, a focused Environmental Impact Report for the development of 12 316 units of which this project is a part, and a Negative Declaration for an 13 increase to 395 units were adopted by the City Council, thus this tentative 14 ]5 map does not require further environmental evaluation. NOW, THEREFORE, IT IS HEREBY RESOLVED that Tentative Map No. 89-47 16 (attached Exhibit A) for Sierra Sunset Village is approved conditioned upon 17 compliance with all applicable State Statutes, local ordinances, conditions of approval of Use Permit No. 89-46 and the following specific conditions: 19 1. In-lieu park fees shall be paid as required by City Code (Article 21, 20 Sections 8400-8410). 21 2. The developer shall dedicate with each building permit an easement on each property for the purpose of assuring that each parcel or unit in this subdivision shall have solar access for reasonably placed solar 25 energy systems. All applicable building codes relating to energy conservation and the appropriate provisions of the California Solar 27 Rights Act of 1979 shall be complied with by the developer. - 1 - 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 3. Hours of construction are limited to 7:00 a.m. to dark, Monday through Saturday. 4. Dust control measures be instituted during construction. 5. Single family detached units shall meet the standard R-1 site require- ments including 20-foot front setbacks to garages, five-foot side yard setbacks and 15-foot rear yard setbacks. 6. A fee prorated on a per unit basis for 25% of the cost of signalization at North Bush Street and Low Gap Road shall be paid with each building permit within this subdivision. 7. Developer shall purchase, install, and maintain for one year, City specified street trees to be planted in the planter strip between the sidewalk and the curb at locations determined by the City throughout the subdivision according to a street tree program approved by staff. 8. A development plan illustrating the location of proposed house plots, fences, and driveways be approved by the Planning Commission prior to acceptance of the final map. 9. A copy of the plot plan be provided to potential purchasers indicating setback requirements and applicable restrictions in accordance with current disclosure laws. 10. The final map be prepared by a licensed land surveyor or registered civil engineer to the approval of the City Engineer. 11. The street improvements must be installed prior to recordation of the final map or the developer must enter into an agreement and post a bond to guarantee the installation of these improvements. 12. Street improvements (curb, gutter, sidewalk, street trees, street paving, and drainage system) shall be constructed to the approval of - 2 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 the City Engineer. Plans to be prepared by a registered Civil Engineer and submitted for the approval of the City Engineer. 13. An encroachment permit from the Public Works Department is required to perform all work within the street right-of-way. 14. Inspection fees shall be paid prior to start of any construction within public right-of-way. 15. Fire hydrants be relocated, as required by the City of Ukiah Fire Marshal. 16. Existing water and sewer stub-outs to the property be abandoned at developer's expense. 17. Landscaped island in east cul-de-sac to be provided with automatic irrigation system from fire hydrant water system.
