RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF UKIAH AMENDING RESOLUTION NO.
86-18, GRANTING CABLE TELEVISION FRANCHISE
WHEREAS, on February 1, 1989, the City Council held its
hearing on whether to adopted proposed amendments to Resolution
No. 86-18 granting a Cable Television Franchise; and
WHEREAS, the City Council determined that the proposed
amendment to the technical standards for reception of KGO Channel
7 are technologically and economically feasible;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. Section 5d of Resolution No. 86-18 is hereby amended to
read as follows:
(d) Within 450 calendar days of the effective date of
this resolution, the technical configuration and equipment of the
system shall be as set forth in Exhibit A attached, or any other
equipment of comparable or better quality and capability. Grantee
shall use its best efforts to meet the system performance stand-
ards listed in Exhibit A, however, the system shall meet the
technical standards established by the Federal Communications
Commission, whether such technical standards be denominated
rules, regulations or guidelines. Notwithstanding the foregoing,
due to the distance, weather and terrain problems associated with
receiving KGO Channel 7 San Francisco, the City's technical
standards listed in Exhibit A will be waived for that channel,
and a degraded picture quality on KGO Channel 7 will not con-
stitute "failure of service," provided the Grantee meets the fol-
lowing additional conditions:
(1) The video and audio quality and reliability of KGO
Channel 7 shall be the same as they were prior to Grantee remov-
ing KGO San Francisco from its system in 1988;
(2) The Grantee shall make reasonable efforts to im-
prove the video and audio quality and reliability of KGO San
Francisco as rebroadcast on the local cable system;
(3) The Grantee shall write KGO San Francisco,
requesting suggestions for improving its picture quality and
reliability in the Ukiah Valley; and
(4) The Grantee shall make regular progress reports to
the City Council on its efforts to improve the quality of KGO's
signal as rebroadcast on the Grantee's system.
PASSED AND ADOPTED at the regular City Council meeting of
February 1, 1989, by the following roll call vote.
