HomeMy WebLinkAbout89-13 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 23 24 25 26 27 28 RESOLUTION NO. 89-13 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH ACCEPTING THE NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUES FOR THE KUKI ROAD REORGANIZATION (NO. 87-6) WHEREAS, the City Council of the City of Ukiah, by Resolution No. 88-22, made application for annexation of the territory known as "KUKI Road Reorganization" No. 87-6, and WHEREAS, pursuant to Section 99, Part 0.5, Division 1, of the Revenue and Taxation Code, (as added by Assembly Bill 8), a transfer of property tax revenue is required for each reorganization, and WHEREAS, such jurisdictional change cannot become effective until each county and city negotiate and accept by resolution the negotiated exchange of property tax revenues, and WHEREAS, the Mendocino County Auditor-Controller's calculations of equivalent tax rates for affected agencies within the territory to be annexed indicate that the City should receive 12.19% of the property taxes generated within this reorganization area, and $2,282 as the initial property tax transfer, and WHEREAS, negotiations between the County and the City have been delayed by the County of Mendocino, and WHEREAS, the only alternative for the City is to take the position that the County will receive all of the property taxes, thus there is nothing to negotiate and the annexation process can move on, and WHEREAS, this position is only taken in this case and does not state a policy for future reorganization matters. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 NOW THEREFORE BE IT RESOLVED: a) The City Council of the City of Ukiah accepts zero dollars as the negotiated exchange of property tax revenues for the KUKI Road Reorganization, zero property tax transfer for the current fiscal year and zero percentage of property tax revenue generated in the subject area during subsequent years, b) this agreement is only for the KUKI Road Reorganization and not approval of such a property tax transfer for any other reorganization, and c) the City Clerk is directed to forward a certified copy of this resolution to the Executive Officer of the Mendocino County Local Agency Formation Commission and Administrative Officer of the Mendocino County Board of Supervisors for action by the respective agencies.
