This summary vacation of Public Utility Easement is made under Chapter 4 of Part 3, Division 9 of the Streets and Highways Code (commencing with Section 8300). Section 2. The name or other designation of the Public Utility Easement being vacated under this resolution is the unnamed Public Utility Easement, five feet in width along the North side of a portion of Lot 11, which lot is located at the corner of South Main Street and Marshall Street in the City of Ukiah, as more particularly described on the attached map, which is marked Exhibit A and incorporated herein by reference as though set forth in full. Section 3. This summary vacation is made based on the fact that the easement has not been used for public utilities and the City of Ukiah's need for said easement has been superseded by relocation in that the City has been dedicated an alternative five feet public utility easement along the Main Street frontage of said portion of Lot 11. Section 4. From and after the date this resolution is recorded, the public service easement described above no longer constitutes a public service easement and the same shall be considered vacated and of no further force or effect.
