RESOLUTION NO. 90-2
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
UKIAH APPROVING USE PERMIT NO. 89-74, UKIAH TERRACE
WHEREAS, the 2.2 acres encompassed by Ukiah Terrace is zoned PD,
Planned Development, and
WHEREAS, the PD, Planned Development zone requires a use permit to be
reviewed and approved by the Planning Commission and the City Council
prior to development taking place within that zone, and
WHEREAS, on May 24, 1989 the Planning Commission approved Use Permit
89-74 with 20 conditions, and
WHEREAS, a Negative Declaration for a similar project on the same
property was approved on March 8, 1989.
NOW, THEREFORE, BE IT RESOLVED, that Use Permit No. 89-74 is approved
subject to the following conditions:
1. Standard Conditions 1 - 9.
2. Street improvements (curb, gutter, sidewalk, street paving, street
trees in planter strip, and drainage systems) shall be constructed to
the approval of the City Engineer. Plans (including hydrology study
to determine flow and capacity of Doolan Creek) to be prepared by a
registered Civil Engineer and submitted for the approval of the City
Engineer.
3. Ail on-site paving shall be a minimum of 2" of asphalt concrete over
a 6" aggregate base.
4. Ail on-site drainage shall be taken into existing storm drains.
5. Improvements may be bonded for a period not to exceed one year, if
not completed prior to recordation of Final Map.
6. Driveway curb cut widths shall be as approved by the City Engineer.

7. Area for the internal driveway and parking spaces be widened to a
minimum of 62 feet.
8. Ail map checking, plan checking, and inspection fees shall be paid
prior to start of any construction within the public right-of-way.
9. All work within the City right-of-way shall be performed by a
properly licensed contractor with a current City of Ukiah Business
License. Contractor must submit copies of proper insurance coverage
(public liability, $1,000,000, property damage $1,000,000) and
current workmen's compensation certificate.
10. An encroachment permit from the Public Works Department is required
to perform all work within the street right-of-way.
11. A landscaping plan be approved by the Director of Planning prior to
placement. The landscaping plan include that area on the east side
of Mulberry Street and the location of trees in the parking area.
12. Ail landscaping be irrigated by an automated irrigation system and
maintained in a neat, weed-free manner.
13. The tot lot be enclosed by a fence.
14. Any roof mounted air conditioning apparatus and outdoor trash
collection facilities be aesthetically screened from view.
15. A Deed restriction be signed by the property owner insuring the
completion of Mulberry Street with the next phase of development on
the Drive-in Theatre property.
16. Directional sign be placed at Mulberry Street frontage to identify
building addresses to approval of Ukiah Fire Marshal.
17. Provide a barricade at the south end of Mulberry Street.
18. Rip rap banks of Doolan Creek and provide easement to the City.
19. Developer will have the engineering prepared for the entire extension

of Mulberry Street to Washington Avenue, and will construct the
Mulberry Street extension as far as 50% of the total project costs
will allow.
20. Ail conditions of approval be completed prior to use and occupancy.
PASSED AND ADOPTED this 5th day of July, 1989 by the following roll
call vote:
AYES: Councilmembers Wattenburger, Shoemaker, Hickey and Vice-Mayor
Schneiter
NOES: None.
