RESOLUTION NO. 91-33
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF UKIAH DESIGNATING VOLUNTEER CITY
WORKERS AS EMPLOYEES FOR PURPOSES OF
WORKER'S COMPENSATION COVERAGE
WHEREAS, certain persons perform voluntary service without pay for
the City of Ukiah; and
WHEREAS, the City is authorized by Labor Code Section 3363.5 to
designate such persons as employees for purposes of worker's compensation
insurance; and
WHEREAS, it is the desire of the City Council of the City of Ukiah to
designate certain volunteer workers as City employees under Division 4 of
the Labor Code;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Ukiah that:
A. Covered volunteers. Persons who perform voluntary service
without pay for the City of Ukiah shall be deemed to be
employees of the City for the purpose of worker's compensation
insurance while performing such service as authorized by
Government Code Section 3363.5, provided these persons have been
designated as covered employees by the City Manager in the
following manner:
The City Manager makes a finding that the volunteer will be
covered under this resolution. The City Council hereby
finds and declares that the volunteer firefighters, police
department reserves and cadets, and museum docents shall be
employees for worker's compensation purposes;

2. The City Manager executes a Personnel Action Form
containing the finding required by Paragraph 1 and
designating the volunteer as a City employee for worker's
compensation purposes;
3. The volunteer signs an agreement:

to follow the instructions of his or her City employee
supervisor in performing volunteer services;
to participate in any training offered or provided by
the City in connection with the volunteer service;
acknowledging that the volunteer does not have the
status of a City employee for any other purpose, and
that he or she serves in the volunteer capacity at the
will and pleasure of the City Manager who can
terminate the volunteer's services at any time without
cause, prior notice or opportunity for a hearing.
B. Termination of Volunteers. The City Manager shall maintain a
file of such volunteer workers. The City reserves the right to
terminate the voluntary service of any individual worker at any
time without reason, prior notice or opportunity for a hearing.
No person performing volunteer service for the City shall have any
rights under the state worker's compensation laws as a City employee or
otherwise unless there has been full compliance with each and every
provision of paragraph A of this resolution.
