Background
Craig Strattman applied for an outdoor dining permit in April 2016. The project was approved in
May 2016; however, staff received several complaints regarding the "Sun Shade and Curtains".
Staff inet with the applicant July 18, 2016 regarding the concerns received and the applicant is
proposing an alternative shade option.
Project
The applicant is proposing to replace the existing 12 X 20 feet Sun Shade with two 9-feet in
diameter thatch umbrellas. The 9-feet in diameter umbrellas would create a 1-foot
encroachment into the public right of way on the north side of the dining area (sidewalk). The
applicant has spoken with Public Works regarding the encroachment and staff does think the
encroachment over the sidewalk will be an issue given the proposed 7-foot height of the
umbrellas from the platform.
Staff Request
The Outdoor Dining Program states that the Planning Director may refer any application to the
Design Review Board for review and recommendation on applications that may be inconsistent
with the Design Standards. Given the nature of the area "Downtown Historical Ukiah" and the
unique look of the proposed umbrellas; staff is requesting the Design Review Board review and
make a recommendation for the proposed change to the project.

Outdoor Dining Proposal

Goals and Scope of the Pt�oject:
To add a deck far outdoar dining 8'wide by 20'long,which is one parking
space autside 110 West Standley Street Ukiah.
This wi11 increase sales,jobs and opti�ns for our community and guests. It
wi11 alsa make Standley Street look better and attract more business for the
whale area.
Hours of.Operation:
Tuesday to Saturday 11 AM to 11 PM or later by chance weather permitting.
Service hours may increase based on sales,events and season. We may mave
from five days a week to seven days a week and this wi11 be based on.
Design.Concept;
Removable all weather platform with benches that double as the 43" fence
around the boarder. Ten foot poles ta support guide wires far"sun sails"to
provide shade. The bench's will copy the large timber bar in Chop Chop
�� while the color theme accents the restaurants grey-green with fresh color
highlights.
Floorin�:
Sealed redwaod,we think it will be o1d growth red wood from the area
Tables:
Standard restaurant quality tables wi�h metal base and a wood top that can
be secured avernight but moveable during service.
Seatin�:
Will be mostly built in benches with the back of the bench 43 inches tall to
act as the fence and to copy the bar tap in the restaurant. Please see the
attached diagram. Additional chairs will be also restaurant quality and
added as needed.
L�htin�;
Solar lights wi11 be bolted on to the ten-footpoles under-the guide wires for
the shade protection. This will be added as needed.
Shade Covering:
Suspended ten feet above the deck, on guide wires anchared to support poles
Attached to the bench seating and fencing. Please see the attached diagram.
A natural g�;rrrn--�ig�:t-�rt�colored shade fabric will be used to allow
airflow while filtering the sun.

Project:
To augment the approved deck at Chop Chop with a shade cover that not only provides continuity for
the theme, menu and design of the restaurant but also strengthens the perception of the downtown as
providing diverse and interesting choices for dining and shopping. The Standley St.corridor is mixed
use, commercial and residential, and Chop Chop is right in the middle of the funky, modern and cheap
out-of-place design to the East and the nicer, more classic design to the West. Our goal is to bridge the
two design factors and add allure and continuity to the block. Akin to iconic destinations,the Tonga
Room and Trader Vic's in San Francisco, "modern tiki" offers a sense that our community includes a
culture that is ethnic,fun and a little exotic.
A"palapa"covering will provide continuity and support the diverse menus and dining style Chop Chop
offers our community. Expanding the Chop Chop look to the outdoor dining area gives us a consistent
look and feeling.
Our goal is to get people downtown to see how much Ukiah has to offer. Variety is what we need,this is
what has made Patrona successful.

Once I get approval it will take about four weeks to be up and running.
With the season closing in time is important but I do not want to rush
this, its need to be right.
The installation can be done on Sunday when it is the slowest time for
traf�c and business. All the work can be done for the existing deck and
the one-foot additional encroachment space on the sidewalk as we
discussed.

A
Cement a 2'x 6" pvc sleeve into the ground and screw the 6" pine pole into the
sleeve. The predrilled kit is then put together and bolt on the center pole.

B
If we can't dig a 2' deep hole in the street we could: Bolt in a metal6"x 2'metal
sleeve with a flange (from B&B steel) bolted into the street. Then a solid wood
table,also bolted into the street through the 2"deck with a 6"hole to support
the center pole.

Option A is a 9'x 20' cover that will cover the deck in one piece,which will be more
streamline.This one cost more but would be worth it in the long run.
Option B is two umbrellas that is less expressive but not as clean and simple as option A.

Outdoor Dining Proposal
April 11, 2016
Goals and Scope of the Project:
To add a deck for outdoor dining 8'wide by 20' long,which is one parking
space outside 110 West Standley Street Ukiah.
This will increase sales,jobs and options for our community and guests. It
will also make Standley Street look better and attract more business for the
whole area.
Hours of Operation:
Tuesday to Saturday 11 AM to 11 PM or later by chance weather permitting.
Service hours may increase based on sales, events and season. We may move
from five days a week to seven days a week and this will be based on.
Design Concept:
Removable all weather platform with benches that double as the 43" fence
around the boarder. Ten foot poles to support guide wires for"sun sails"to �
provide shade. The bench's will copy the large timber bar in Chop Chop
while the color theme accents the restaurants grey-green with fresh color
highlights.
Floorin�:
Sealed redwood 2 inches thick
Tables:
Standard restaurant quality tables with metal base and a wood top that can
be secured overnight but moveable during service.
Seatin�:
Will be mostly built in benches with the back of the bench 42 inches tall to
act as the fence and to copy the bar top in the restaurant. Please see the
attached diagram. Additional chairs will be also restaurant qualiry and
added as needed.
Li htin
Solar lights will be bolted on to the ten-foot poles under the guide wires for
the shade protection. This will be added as needed.
Shade Coverin�:
Suspended ten feet above the deck, on guide wires anchored to support poles
Attached to the bench seating and fencing. Please see the attached diagram.
A natural green or light blue colored shade fabric will be used to allow
airflow while filtering the sun.
Menus are attached for your review•
Bothe food and alcoholic beverages will be served table side. A server
station will be set up and will act as host/busser.

5 INSTRUCTIONS: Please follow these instructions upon submittal of the following application
6 packet and consistent with the requirements of the Downtown Zoning Code.

8 Prior to submitting an application, it is advised that the business owner consult with the City of
9 Ukiah Public Works Department regarding the location of utilities, fire hydrants, etc. Due to
10 utility location and emergency vehicle clearance, not all locations may be appropriate for the
11 Outdoor Dining Program.

13 Outdoor Dining structures shall not obstruct stormwater runoff and must be readily removable
14 for maintenance of pavement, sidewalk, curb, gutter and utilities.
15
16 An application for Outdoor Dining shall include the following:
17
18 1. A completed and signed Outdoor Dining Permit application form and Special Encroachment
19 application form.

21 2. Five (5) copies of a dimensional site plan (drawn to scale)that includes the following
22 (maximum size 24" x 36")

24 A. Address
25 B. The underlying right-of-way and parking spaces and the location of items adjacent to
26 the use area.
27 C. An outline of the area proposed for outdoor dining facility and the location of any
28 existing and adjacent outdoor dining uses.
29 D. The proposed layout of all use furnishings, including, but not limited to, tables, chairs,
30 umbrellas, heaters, planters, fencing, signage, etc.
31 E. The proposed electrical connections to serve the use—if electrical service is
32 requested.
33 F. The proposed circulation to and from the outdoor dining use and the associated
34 business, general pedestrian circulation, and building ingress/egress.
35 G. Location of all buildings and structures adjacent to the outdoor dining use, including
36 the building proposing the use.
37 H. Location, type and height of any barriers surrounding the outdoor dining use.
38 I. Line of sight from indoor dining area, demonstrating the ability to appropriately
39 supervise the outdoor dining area
40 J. The location of any City utility infrastructure, including manholes, fire hydrants, valves,
41 storm drain outlets, and similar.

43 3. Specifications for the design, colors, and materials of all proposed furnishings including but
44 not limited to tables, chairs, umbrellas, heaters, planters, fencing, etc., demonstrating that all
45 furnishings are of commercial grade and designed for outdoor use and consistent with the
46 requirements of the Downtown Zoning Code.

48 4. A lighting plan, including under umbrella, table lighting, and any other lighting proposed,
49 showing fixture and lamp type and locations. (Installation of new lighting may require a
50 permit.)

2 5. An operational schedule including hours, days, and months (outdoor dining shall be required
3 to operate for a minimum of 8 hours per day, 6 days per week as weather permits).

5 6. Photos of the project area, including adjacent buildings and windows, to demonstrate impact
6 on neighboring businesses.

8 7. Insurance Requirements: A certificate of General Liability insurance in the amount of
9 $2,000,000.00 combined single limit per occurrence for bodily injury, personal injury and
10 property damage. If commercial general liability insurance or other form with a general
11 aggregate limit is used, either the general aggregate shall apply separately to this
12 project/location or the general aggregate shall be twice the required occurrence limit.

15 A. The certificate shall be accompanied by an "Additional Insured Endorsement" which
16 names the City of Ukiah, its officers, employees, agents and volunteers as addition al
17 insured.
18 B. Indicates that the policy is primary with respect to the city and that any insurance or
19 self-insurance maintained by the city shall be in excess of the Named insured's
20 Insurance and not contribute with it. Example of preferred form#GC 2012 07 98-
21 State of political subdivisions.
22 C. Indicates that the city will be notified within 30 days of Insurance cancellation of
23 within 10 days of non-payment.

25 8. A copy of the applicant's approved City of Ukiah business license.

27 9. Fees, Charges and Deposits
28
29 A. Outdoor Dining Program Permit Fee of$250 (due upon approval of Outdoor Dining
30 Program application; one-time fee when new plans are submitted)
31 B. Usage Fee of 25 cents per square foot per month (due upon approval of Outdoor
32 Dining Program application, to be invoiced monthly by City). In the event that Usage
33 Fees are increased, said increase on an existing permit may be no more than 2%
34 per year with a maximum increase of 10°/0.
35 C. Annual renewal fee of$50 for administration and inspection.

37 GENERALREQUIREMENTS

39 The applicant must demonstrate that the proposed use will not block the display windows or
40 signage of the adjacent business(s).

42 Applications for Outdoor Dining Program permits will be handled through the encroachment
43 permit process when consistent with the design guidelines specified in the Outdoor Dining
44 Program Guidelines and Section 5.080 of the Downtown Zoning Code.
45
46 An Outdoor Dining Permit shall be valid for 12 months from the date of permit issuance.
47
48 Permits for subsequent years will be issued on a first come basis, except that the holders of a
49 permit for the prior year will be given priority over new applicants. Each year, the applicant shall
50 submit a complete application for an Outdoor Dining Program Permit as defined above. If no

1 changes to the project are proposed, plans are not required for renewal. An inspection may be
2 required by the Public Works Department. If the project is deemed to be out of compliance with
3 the Guidelines, the permit may be denied or conditionally approved.

5 Outdoor Dining Program Permits are not transferable to a new owner and/or location. However,
6 a new owner of a business with an existing permit may re-apply for the program as a renewal.
7
8 An Outdoor Dining Program Permit is an interruptible privilege. The City may interrupt the
9 operation of an outdoor dining use at any time due to anticipated or actual conflicts. Such
10 conflicts may arise from, but are not limited to, scheduled festivals and similar events, parades
11 or marches, repairs to the public right of way, or demonstrations or emergencies occurring in the
12 area. Outdoor dining uses shall be permitted to continue during special events unless the City of
13 Ukiah specifically requests that the use temporarily discontinue for the duration of the event.
14 Such request may include the removal of all use furnishings.
15
16 Within the program boundaries, a maximum of 26 parking spaces may be utilized for outside
17 dining.

3 Outdoor Dining Program Guidelines
4
5 Purpose: The purpose of the Outdoor Dining Program Guidelines is to create an enhanced quality
6 and consistent pattern of outdoor dining facilities that reflect the unique character of downtown Ukiah.
7 The Downtown Zoning Code allows for sidewalk cafes (on public property) and outdoor dining (on
8 public property), and a pilot project starting in 2011 demonstrated the feasibility of outdoor dining
9 facilities. These guidelines are consistent with the goals, policies, and actions of the General Plan.
10
11 Program Boundaries: The boundaries of the Outdoor Dining Program are as follows: East/West —
12 Main Street/Oak Street, North/South —Henry Street/Clay Street. (Commercial Core Properties)
13
14 Allocation of the Public Right of Way (Parking Space(s)): Allocation of the public right of way for
15 outdoor dining use shall be based on frontage between the extended property lines of the building in
16 which the associated fronting ground floor storefront restaurant use is an occupant. Where more than
17 one-half of the total square footage of a parking space is located between the extended property lines,
18 an application for allocation of that parking space may be made by the owner or tenant of such use.
19 Where one-half or less of the total square footage of a parking space is located befinreen the extended
20 property lines, an application for allocation of that parking space may be made by the owner or tenant
21 of such use, but shall require the written agreement of the affected underlying property owner, at no
22 compensation, and shall be conditionally allocated until such time the affected adjacent ground floor
23 storefront restaurant use requests and is approved for allocation of the public right of way for their
24 use. In such circumstance, the extended property line will become the dividing mechanism between
25 the two allocated uses, and 15 days notice shall be given to vacate any previous conditional allocation
26 that is outside a uses property line extensions.
27
28 In order to ensure safety and the unrestricted use of adjacent parking spaces, there must be a
29 minimum of 18" between the outdoor dining structure and the adjacent space(s). However, if two
30 Outdoor Dining facilities are immediately adjacent to each other, the 18" space between them will not
31 be required.
32
33 Restaurants situated on street corners may utilize parking on one street only.
34
35 Accessibility Requirements: The outdoor dining facility shall comply with California State
36 accessibility standards and federal ADA requirements.
37
38 Permanent Changes to Public Right of Way: Permanent changes to the public right of way are not
39 permitted. Any street, sidewalk, or City improvements, furnishings, and utilities damaged or destroyed
40 by the outdoor dining use and/or facility shalt be replaced to City standards with the cost borne by the
41 permittee.

43 Use Area: Furnishings and decorations shall not encroach beyond the permitted use area or
44 overhang pedestrian or vehicular circulation paths.
45
46 Maintenance and Security: All outdoor dining facility furnishings shall be maintained in a safe and
47 clean condition. Furnishings shall be secured within the Outdoor Dining facility or stored indoors
48 nightly.

50 All outdoor dining facilities shall be maintained in an attractive, clean (free from spills, litter and other
51 debris) and safe manner.

1 Food and Beverages: Service of food and beverages shall comply as follows:

3 Outdoor dining facility may only serve food and nonalcoholic beverages prepared or stocked for sale
4 at the adjacent indoor restaurant; provided, however, that the service of alcohofic beverages for on-
5 premise consumption by customers within the outdoor dining facility may be authorized by the
6 Planning Director and Police Department if each of the following requirements are met:
7
8 1. The business operating the outdoor dining facility is duly licensed, or prior to the
9 service of any alcoholic beverage will be duly licensed by state authorities to sell
10 alcoholic beverages for consumption within the outdoor dining area.
11 2. The authorized outdoor dining facility is identified in a manner which will clearly
12 separate and delineate it from the areas of the sidewalk that will remain open to
13 pedestrian traffic.
14 3. One or more signs, as approved as part of the encroachment permit, are posted during
15 all times the outdoor dining facility is in operation, which shall give notice to the
16 customers that the drinking of alcoholic beverages or the carrying of any open
17 container which contains an alcoholic beverage is prohibited and unlawful outside the
18 delineated outdoor dining facility.
19
20 Closure of Business: Outdoor dining use area furnishings shall be removed immediately upon the
21 permanent closure of the associated business.
22
23 Signage: No signage shall be allowed in the outdoor dining area except for the name of the
24 establishment on an umbrella fringe and in compliance with this Section and UCC Division 3, Chapter
25 7 (Sign Ordinance, UCC Section 9224.8(D8)).
26 Portable Heaters: Outdoor heaters are allowed subject to Fire and Building Code compliance.
27 Trash Receptacles: To minimize litter and debris, trash and refuse receptacles shall not be
28 permitted within the area designated for the outdoor dining and the permittee shall remove trash and
29 litter as they accumulate. Trash and/or refuse containers may be authorized within the outdoor dining
30 area or adjacent sidewalk areas with Zoning Administrator approval of a Minor Use Permit.
31 Food Service: To minimize litter and debris, where table wait service is provided, or food is served to
32 the customer on a tray to be taken and eaten on site in the dining area, plates, glasses, cups and
33 silverware made of permanent(non-disposable) materials such as glass, ceramic, and metal shall be
34 required. Beverage, or"cocktail" napkins are prohibited. The use of disposable food containers and
35 utensils is permitted only where food is served to the customer"to go."
36 Music/Entertainment: Non-live music and/or speakers may be authorized with Zoning Administrator�
37 approval of a Minor Use Permit.

39 DESIGN STANDARDS

41 All outdoor dining furnishings shall be of commercial grade and designed for outdoor use. Due to the
42 proximity of traffic flow, consideration shall be given to minimizing potential driver distraction.
43
44 All furnishings shall be properly maintained and cleaned regularly.
45
46 Barriers
47 Railings shall be designed of steel, treated wood, cast aluminum or similar material and shall
48 not exceed 48" in height. Large planters may also be used as barriers, and must be properly

1 maintained with live, healthy plants year-round. Removable posts or stanchions are
2 prohibited.
3 Reflectors shall be placed on the corners closest to traffic to improve visibility.
4 If alcoholic beverages are to be served, fencing shall meet the requirements of the use
5 associated license issued by the State Department of Alcoholic Beverage Control (ABC).
6 "Open" Appearance: Perimeter enclosures with a height of between 36" and 48" must be at
7 least 50 percent open (see-through) in order to maintain visibility of street level activity.

PROJECT
An application was received from Jofrie Lolonis on behalf of the Russian River Cemetery
District for approval of a Minor Site Development Permit to expand the grave site area, add
live landscaping and construct an open Memorial Pavilion. There are no lights or signs
proposed as part of this project. The infrastructure is existing therefore the only new
development will be the Pavilion. All irrigation will be set up to eventually convert to recycled
water when it is extended to the area.
