HomeMy WebLinkAbout91-60 1 5 6 ? 9 10 11 12 15 15 16 17 19 2O 21 2~ 25 97 28 RESOLUTION NO. 91-60 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH REGARDING OBSERVATORY PROPERTY WHEREAS, on May 10, 1991, the General Services Administration (GSA), Region 9 Office, noticed that the Observatory property was suitable for homeless use; and WHEREAS, this property has been the subject of considerable concern by the City of Ukiah for many years, particularly with respect to its ultimate potential use as a park; and WHEREAS, the City of Ukiah through its Housing Element and the Redevelopment Agency with its Redevelopment Plan, are committed to meeting low and moderate income housing needs including addressing the homeless issue; and WHEREAS, the City of Ukiah is very concerned about the ultimate disposition of this property and that whatever is proposed is in the best interest of the community; and WHEREAS, the City of Ukiah is a local government eligible to make application to the Federal Government for use of this property; and NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council of the City of Ukiah does hereby authorize the City Manager to obtain the necessary application instructions from the Department of Health and Human Services to utilize the Ukiah Latitude Observatory property, HUD Property No. 549120003, for uses as noticed by the General Services Administration. Rough, Jr. City Manager City of Ukiah 300 Seminary Avenue Ukiah, CA 95482 RE: Ukiah Latitude Observatory Mendocino County, California GSA Control No. 9-C-CA-1277 Dear Mr. Rough: Thank you for your letter dated June 21, 1991, in which the City of Ukiah expressed an interest in obtaining the above referenced property. Your attached copy of Resolution No. 91-60 approved by the Ukiah City Council on June 19, 1991, underscores your intention. This letter is to inform you that the disposal of the subject property is governed by the Federal Property and Administrative Services Act of 1949. Pursuant to this Act, Federal real property must be determined to be surplus to the needs of all Federal Agencies prior to being made available for acquisition by eligible public bodies. The Ukiah Latitude Observatory has not yet been determined to be surplus and therefore is not available at this time for acquisition. In addition, you should be made aware this property has a pending application for inclusion on the National Register of Historic Places. As the State Historic Preservation officer has determined the property eligible for listing, it will be made available to eligible public bodies as a historical monument pursuant to Section 203(k)(3) of the 1949 Act. (See enclosure, Appendix A). If the subject property is determined to be surplus, our agency will promptly notify the Office of the Mayor of the City of Ukiah by certified mail of its availability. This notice will include instructions for acquiring the property and will reference several Federal statutes governing the acquisition. The Federal government may license unused Federal Property for interim use pending disposal. Currently, the property is tenant- occupied through a transitional housing program for the homeless. The Community Development Commission of the County of Mendocino (CDCCM) has a revocable license to conduct this program. Under the Stewart B. McKinney Homeless Assistance Act (McKinney Act) the CDCCM can apply to acquire surplus property by deed or long term lease to continue their homeless assistance program. Pursuant to the McKinney Act, their application will receive priority consideration over most other applications for surplus government property. The CDCCM has stated their intention to apply for this property under the McKinney Act. We strongly urge you to contact the Executive Director of the CDCCM, Mr. Michael T. Pucci, at (707) 463-5462, to resolve your competing interests. Your respective organizations would be better able to determine the most beneficial use of the property as it relates to the City of Ukiah. It should be noted that there may be a problem with any subdivision of the parcel due to its historical aspects. If, after consultation with the CDCCM, your city still wishes to acquire the property you should consider submitting an application to maintain the property as a historical monument. This application should only be filed when and if you receive notice the property has been determined surplus. We hope this letter does not create more questions than it attempts to answer.
