HomeMy WebLinkAbout91-44RESOLUTION NO. 91-44 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH SUPPORTING THE CIRCULATION OF REFERENDUM PETITIONS TO COMPEL ELECTION ON COUNTY ORDINANCES IMPOSING PROPERTY TAX COLLECTION AND JAIL BOOKING FEES ON CITIES, SCHOOL DISTRICTS AND SPECIAL DISTRICTS. ~HEREAS: 1. Mendocino County has adopted an ordinance imposing fees on cities, school districts and special districts within the county for collecting property taxes, and an ordinance imposing fees on cities for booking prisoners at the county jail who are arrested by city police; and 2. The county already receives 40% of the property taxes paid by residents of the City of Ukiah (as compared to 12% received by the City) to provide such services as property tax administration and operating the county jail; and 3. These fees are imposed retroactively to July 1, 1990, and have not been considered by the affected agencies in approv- ing their budgets for the fiscal year beginning July 1, 1990; and 4. Paying these unanticipated fees will force all the af- fected agencies to reduce services, in effect passing the burden of these fees onto the taxpayers who they serve; and 5. The cities, school districts and special districts have proposed to Mendocino County alternative ways to increase its revenues without imposing these hardships and without otherwise raising taxes within the county; and 6. The City Council of the City of Ukiah believes that the voters of Mendocino County have a right to vote on whether the cities, school districts and special districts in Mendocino County should be required to pay Mendocino County additional fees to administer property taxes and to book prisoners at the county jail; NOW, THEREFORE, BE IT RESOLVED that: 1. the City Council of the City of Ukiah hereby supports the circulation of referendum petitions to obtain the necessary signatures to require the Mendocino County Board of Supervisors to either rescind the ordinances or to place the ordinances on the ballot at a special or general election not sooner than 88 days after the petitions are filed with Mendocino County Clerk; and 2. the City of Ukiah, individual Councilmembers and others interested in this issue are encouraged to work together to as- sist in any way legally allowed to obtain the necessary signa- tures.
