HomeMy WebLinkAbout91-43 RESOLUTION NO. 91-43 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH ADOPTING FIRE PROTECTION FEE SCHEDULE. WHEREAS, 1. The Fire Marshal for the City of Ukiah or his delegates review various plans submitted in connection with building per- mit, subdivision and other applications and conduct inspections of property and improvements under the Uniform Fire Code and other applicable codes, ordinances and regulations; and 2. The City of Ukiah incurs costs in conducting these plan reviews and inspections; and 3. The permit applicants or parties requesting or requir- ing these inspections should pay for the costs incurred by the City in conducting the reviews and inspections; and 4. The City has provided all notices required by law and pursuant to Government Code Section 54992 has made available to the public for a period of ten (10) days prior to the hearing on the fees established in this resolution data indicating the amount of cost, or estimated cost, required to provide the serv- ice for which the fee is levied and the revenue sources an- ticipated to provide the service, including general fund revenues; and 5. The City Council finds that the fees imposed by this resolution do not exceed the estimated reasonable cost of provid- ing the service for which the fee is charged and the fees for reports or documents do not exceed the direct costs of duplica- tion; and 6. The fees for site and plan reviews and plan checks and inspections will not normally apply to plans and other actions involved in the actual construction of single family dwellings but will apply to approvals required for residential as well as other subdivisions and residential automatic sprinkler systems. NOW, THEREFORE, BE IT RESOLVED that there is now imposed in the City of Ukiah fees for fire department plan checking and in- spection services as set forth in the schedule of fees contained herein. BE IT FURTHER RESOLVED that the fees imposed by said fee schedule must be paid by the applicant for any permit in connec- tion with which any covered plan check or inspection is requested or required before the service is provided. BE IT FURTHER RESOLVED that when any covered inspection is conducted for fire safety purposes and not at the request of the permit applicant, property owner, tenant or other person occupy- ing the property, or where collecting the fee in advance is for any other reasons impractical or not in the interest of preserv- ing fire safety, the City shall collect the fee at the earliest opportunity and the finance department and City Attorney are authorized to take all actions, including legal action, they deem necessary to collect said fees. The City's ordinances imposing interest and authorizing the City to recover its attorneys' fees shall apply to such collection efforts. If an applicant com- mences work requiring a permit for which a covered inspection or plan check is required before submitting his or her application, the fees set forth in the fee schedule shall be doubled for all covered services provided in connection with that permit applica- tion. BE IT FURTHER RESOLVED that effective upon the adoption of this resolution, the City Council of the City of Ukiah hereby adopts the following fee schedule for fire department plan check- ing and inspection services.
