RESOLUTION NO. 92-7
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH
SETTING DEADLINE FOR IMPLEMENTATION OF RECYCLING
PROGRAMS FOR UNINCORPORATED AREAS SERVICED BY
THE CITY-OWNED LANDFILL
WHEREAS, the City Council has during the past two years approved and
implemented several recycling programs and waste diversion policies inside
the City and at the City-owned landfill; and
WHEREAS, the City Council is committed to the goals and objectives of
a vigorous, strong recycling and waste diversion program, and
WHEREAS, the City is required to meet the mandates of AB939 which
calls for a 25% reduction in waste volume by 1995, and 50% by the year
2000; and
WHEREAS, the City Council and Staff is continuing to search for, and
evaluate, new programs and innovative policies that will encourage
collection and reuse of recyclables; and
WHEREAS, the residents of the City of Ukiah have responded admirably
to the concepts and ideas of recycling; and
WHEREAS, residents in the unincorporated area beyond the City limits
which use the City-owned landfill for disposal have very limited or no
access to curbside recycling opportunities; and
WHEREAS, the County of Mendocino issues service area licenses to
commercial haulers for refuse col]ection, several of which use the
City-owned landfill for ultimate disposal; and
WHEREAS, the County of Mendocino contracts with private haulers for
hauling waste from refuse container sites in Anderson Valley and
Potter Valley to the City-owned landfill.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Ukiah that the City hereby declares that continued use of the Ukiah
landfill by the County of Mendocino and its licensed and/or contracted
refuse haulers is contingent upon imp]ementation of the following programs
by January 1, 1992:
1. The County is to require its licensed commercial refuse haulers
to develop and implement an effective, voluntary Curbside
Recycling Program within its service area equal to, as a minimum
the program currently operating within the Ukiah City limits and
as modified hereafter.
2. The County of Mendocino is to establish an effective, ongoing
method of diverting and removing recyclables from the transfer
containers prior to transportation and disposal at the
City-owned landfill. Recyclables are defined as those materials
designated by the City Manager as recyclable pursuant to
Paragraph 1 of Policy Resolution No. 20.
3. At the regular City Council meeting closest to January 1, 1992,
the C~ty Manager shall present to the City Council the County's
evidence that it has complied with the requirements of this
Policy Resolution. At the conclusion of that meeting or any
continuance or further consideration of the matter, the City
Council shall determine whether to exclude the County and its
licensed commercial refuse haulers from the landfill.
