RESOLUTION NO. 98- 36
RESOLUTION OF THE CITY COUNCIL OF TI{E CITY OF UKIAH
ADOPTING THE MEMORANDUMS OF UNDERSTANDING BETWEEN THE
CITY OF UKIAH AND THE ELECTRIC AND FIRE UNITS
WHEREAS, the Employee/Employer Relations Officer has met and
conferred in good faith with representatives of the Electric and
Fire Units; and
WHEREAS, a Memorandum of Understanding has been approved by
both the Electric and Fire Units; and
WHEREAS, said Memorandums of Understanding have been presented
to the City Council for its consideration.
NOW, THEREFORE, BE IT RESOLVED that the Memorandums of
Understanding for the Electric and Fire Units are hereby adopted
and the Employee/Employer Relations Officer is authorized to enter
into this Agreement for the Fiscal Year 1997-98.
PASSED AND ADOPTED this 1st day of April, 1998, by the
following roll call vote:
AYES: Councilmembers Chavez, Ashiku, Kelly, Mastin, and Mayor
Malone.
NOES: None.
ABSENT: None.

MEMORANDUM OF UNDERSTANDING
1997-199~
This Memorandum of Understanding is entered into pursuant to the
Meyers-Millias-BrownAct (California Government Code Section 3500,
et. seq.) and applicable ordinances and resolutions of the City of
Ukiah, between the City of Ukiah (hereinafter City) and the Fire
Unit (hereinafter Unit)· As a result of meet and confer sessions,
the City and Unit have agreed to the following understandings.
The term of this Agreement shall be fifteen (15) months, effective
July 1, 1997, through September 30, 1998.
The City Council has agreed to a one-year agreement due to the
possibility of increased revenues this year which cannot be
determined until July, 1998. Increased annual revenues are a
possibility only and there are no assurances that additional funds
will be available next year for salary increases·

Fire Unit members shall receive a lump sum payment which
is equivalent to 1/2% of base rate salary retroactive to
the pay period beginning closest to July 1, 1997. This
lump sum will be a one-time payment and will not increase
base rate salary. Overtime is not included.
Effective the pay period of March 8, 1998, there shall be
a 1/2% increase to the Fire Unit's base rate salary
schedule.
Effective the pay period of June 28, 1998, there shall be
a I 1/2% increase to the Fire Unit's base rate salary
schedule.
2. Paramedic Stipe~
·
Effective July 1, 1997, Unit members with Paramedic
Certificates shall receive $275 per month in lieu of the
existing $225 per month EMT-II Certificate pay. Retroactivity
for this stipend will be calculated based upon paramedic
certification dates for individual Unit members.
Agting Pay
Fi~e Unit members who are formally assigned to perform the
duties of Acting Fire Engineer, Acting Fire Captain, and
Acting Duty Chief shall receive acting pay if they perform
those duties for more than six hours during a 1/2 shift
increment of twelve hours. The former requirement that
provided acting pay only if the employee worked in an acting
capacity for a full 24-hour shift is eliminated. The current
shift compensation for acting duties will remain the same and
will be pro-rated for half shifts.

If a Unit member works in an acting capacity for more than six
but less than 12 hours, he or she shall receive acting pay for
the number of hours actually worked in that capacity Only
one Unit member may receive acting pay during the same ~2-hour
period for the same acting position. If more than one Unit
member works in that capacity during such period, the Unit
member who worked the most hours will receive acting pay.
Section 125 P~an
The City will offer a Section 125 (Cafeteria) Plan for its
employees, effective March, 1998.

Continuation
The City and the Unit agree that all conditions of employment
established by City policy, including all conditions affecting
wages, hours, and working conditions that are not specifically
addressed in this Memorandum of Understanding shall continue
in effect and shall not be affected by the terms of this
Memorandum of Understanding.

The value or availability of the benefits provided in the
Memorandum of Understanding as originally worded or as amended
from time to time may depend on their tax treatment by the
state or federal government or the decisions of other
government agencies or departments, such as, but not limited
to, the Public Employees Retirement System. The City will
endeavor to obtain the most favorable treatment legally
possible from these other governmental entities. However, the
City makes no representation concerning the value of such
benefits to unit members or how they will be taxed or
otherwise treated by other agencies or departments. The
City's obligations under this Memorandum of Understanding are
limited to the direct cost of providing the salary and
benefits as described in the Memorandum of Understanding. The
City shall have no additional financial obligation, even if
the tax or other treatment of such salary or benefits by other
agencies or departments reduces or eliminates their value to
the employee. The City will meet and confer with the Fire
Unit regarding the impact upon salary and benefits.
MEMORANDUM OF UNDERSTANDING
1997-1998
This Memorandum of Understanding is entered into pursuant to the

2. Health Pl~AdvisoryCOm~,~ttec
·
The City will establish a Health Plan Advisory Committee to
review and provide input relative to proposed health and
dental plans for employees. This Committee will consist of
one representative from each of the City's bargaining units.
Section 125 P~
The City will implement a Section 125 (Cafeteria) Plan for its
employees, effective March, 1998.
4. Retiree Med~ cs] In-~ur~nce ~,n8
·
The City will investigate the feasibility of establishing a
Retiree Medical Insurance Fund to which employees may
contribute in order to fund their retiree health benefits. The
Electric and Miscellaneous Units Sub-Committee and the City
Manager will continue to meet to discuss the details and IRS
considerations. The City will research this issue and solicit
model plans from other agencies towards the goal of discussing
this item at next year's negotiations.
Classification Title Revision.
The City and Unit .agree upon the following classification
title changes:

The classification title of Electric Engineering
Technician will be revised to Electrical Engineering
Technician II.
b ·
The classification title of Engineering Technician
(assigned to the Electric Department) will be revised to
Electrical Engineering Technician I. This position will
now be represented by the Electric Unit.
6. Sick Leave Policy

Please refer to the Personnel Policies for the City's Sick
Leave Policy.
7. Continuation
The City and the Unit agree that all conditions of employment
