RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH
ADOPTING THE MEMORANDUMS OF UNDERSTANDING BETWEEN THE
CITY OF UKIAH AND THE MANAGEMENT AND MISCELLANEOUS UNITS
WHEREAS, the Employee/Employer Relations Officer has met and
conferred in good faith with representatives of the Management and
Miscellaneous Units; and
WHEREAS, a Memorandum of Understanding has been approved by
both the Management and Miscellaneous Units; and
WHEREAS, said Memorandums of Understanding have been presented
to the City Council for its consideration.
NOW, THEREFORE, BE IT RESOLVED that the Memorandums of
Understanding for the Management and Miscellaneous Units are hereby
adopted and the Employee/Employer Relations Officer is authorized
to enter into this Agreement for the Fiscal Year 1997-98.
PASSED AND ADOPTED this 18th day of March, 1998, by the
following roll call vote:
AYES- Councilmembers Chavez, Ashiku, Kelly, Mastin, and Mayor Malone.
NOES: None.
ABSENT: None.

MEMORANDUM OF UNDERSTANDING
1997-1998
This Memorandum of Understanding is entered into pursuant to the
Meyers-Millias-Brown Act (California Government Code Section 3500,
et. seq.) and applicable ordinances and resolutions of the City of
Ukiah, between the City of Ukiah (hereinafter City) and the
Miscellaneous Unit (hereinafter Unit). As a result of meet and
confer sessions, the City and Unit have agreed to the following
understandings.
The term of this Agreement shall be one (1) year, effective July 1,
1997, through September 30, 1998.
The City Council has agreed to a one-year agreement due to the
possibility of increased revenues this year which cannot be
determined until July, 1998. Increased annual revenues are a
possibility only and there are no assurances that additional funds
will be available next year for salary increases.

Effective the pay period of March 8, 1998, there shall be
a 1% increase to the Miscellaneous Unit's base rate
salary schedule.
Effective the pay period of June 28, 1998, there shall be
a 1 1/2% increase to the Miscellaneous Unit's base rate
salary schedule.
2. Career Step Pr~ogram
The City and the Unit agree with the concept of implementing
a "Career Step Program" for those employees in the
Miscellaneous Unit who have reached their top salary step. A
committee has been formed to meet with the City Manager to
develop the criteria for this program.

Health Plan Advisorv Committee

The City will establish a Health Plan Advisory Committee to
review and provide input relative to proposed health and
dental plans for employees. This Committee will consist of
one representative from each of the City's bargaining units.
Section 125 Plan
The City will implement a Section 125 (Cafeteria) Plan for its
employees, effective March, 1998.
5. Retiree Medical Insurance Fund
The City will investigate the feasibility of establishing a
Retiree Medical Insurance Fund to which employees may
contribute in order to fund their retiree health benefits. The
Miscellaneous and Electric Units Sub-Committee and the City
Manager will continue to meet to discuss the details and IRS
considerations.

Flexible Hour.~
The City and the Unit agree that Management Unit employees may
work flexible hours on a given day for special needs or
unexpected absences of short duration with the approval of the
department head.
4. Continuation
The City and the Unit agree that all conditions of employment
established by City policy, including all conditions affecting
wages, hours, and working conditions that are not specifically
addressed in this Memorandum of Understanding shall continue
in effect and shall not be affected by the terms of this
Memorandum of Understanding.

The value or availability of the benefits provided in the
Memorandum of Understanding as originally worded or as amended
from time to time may depend on their tax treatment by the
state or federal government or the decisions of other
government agencies or departments, such as, but not limited
to, the Public Employees Retirement System. The City will
endeavor to obtain the most favorable treatment legally
possible from these other governmental entities. However, the
City makes no representation concerning the value of such
benefits to unit members or how they will be taxed or
otherwise treated by other agencies or departments. The
City's obligations under this Memorandum of Understanding are
limited to the direct cost of providing the salary and
benefits as described in the Memorandum of Understanding. The
City shall have no additional financial obligation, even if
the tax or other treatment of such salary or benefits by other
agencies or departments reduces or eliminates their value to
the employee.
This Memorandum is ratified and adopt ed pursuant to the

Upon review and analysis of the classifications in the
Water/Sewer Division, effective March 8, 1998, the City will
make the following salary range adjustments:
Water/Sewer Service Attendant
Range 36 to Range 37 - 2 1/2% increase
Water/Sewer Maintenance Supervisor

Range 39 to Range 41 - 5% increase
