5. RIGHT TO APPEAL DECISION
Persons who are dissatisfied with a decision of
the City Council may have the right to a review of
that decision by a court. The City has adopted
Section 1094.6 of the California Code of Civil
Procedure which generally limits to ninety (90)
days the time within which the decision of the
City Boards and Agencies may be judicially
challenged.
6. CONSENT CALENDAR
The following items listed are considered routine
and will be enacted by a single motion and roll
call by the City Council. Items may be removed
from the Consent Calendar upon request by a
Councilmember or a citizen in which event the item
will be considered at the completion of all other
items on the agenda. The motion by the City
Council on the Consent Calendar will approve and
make findings in accordance with Administrative
Staff and/or Planning Commission recommendations.
a. Payroll and General Warrants
b. Claim for Damages, Melvin Brass, Deny and
Refer to Insurance Carrier
c. Award of Bid for 1/2 Ton Van to Ken Fowler
Motors in the amount of $14,122.38 (sales tax
included)
d. Adoption of Resolution Completing Appointment
to Growth Management Steering Committee
e. Adoption of Resolution Expanding Cultural Arts
Advisory Board
7. AUDIENCE COMMENTS ON NON-AGENDA ITEMS
The City Council welcomes input from the audience.
In order for everyone to be heard, please limit
your comments to three (3) minutes per person and
not more than ten (10) minutes per subject. The
Brown Act regulations do not allow action to be
taken on audience comments.
8. PUBLIC HEARING - 7:00 p.m.
*a. Appeal of Planning Commission Condition of
Approval Regarding Off Site Parking Requirement
for Variance Application No. 90-71, granted to
Henry Wong, for a proposed commercial and
residential building located at 519 South
School Street, zoned C-i, Light Commercial
District.
*b. Appeal of Planning Commissions denial of
Variance Application No. 90-70, as filed by
Phranklin and Maggie Apfel, for a variance
from the on-site parking requirement for a 5,200
sq. ft. building for office use at 302 West
Henry Street, zoned C-i, Light Commercial
District.
* These are quasi-judicial Public Hearings and
Councilmembers are to visit the site prior to
the meeting
c. Consideration of Resolutions Revising Rates at
the Ukiah Municipal Airport pertaining to
Administration Building Rental, Hangar Rental
Fees, Airplane Tie Down Fees and Shop Building
Rental Fees.
9. NEW BUSINESS
a. Review of Ukiah Code Section 4424, Regarding
Garbage Can Location
b. Presentation of the Preliminary Water Treatment
Plant Design and Request for Authorization to
Proceed with Final Design of Water Treatment
Plant
c. Set Date for a Study Session/Workshop Regarding
Water Rights
d. Approval of Professional Services Contract for
Republishing, Indexing and Supplementation of
the Ukiah Municipal Code Book
e. Annual Auditors Report for Fiscal Year 1989-90
f. Authorize Letter Endorsing Property Annexation
Application to LAFCO by Ukiah Valley Fire
