Regular Adjourned Meeting of March 27, 1992 6. ~IGHT TO APPEAL DECISION Persons who are dissatisfied with a decision of the City Council may have the right to a review of that decision by a court. The City has adopted Section 1094.6 of the California Code of Civil Procedure which generally limits to ninety (90) days the time within which the decision of the City Boards and Agencies may be judicially challenged. 7. CONSENT CALENDAR The following items listed are considered routine and will be enacted by a single motion and roll call vote by the City Council. Items may be removed from the Consent Calendar upon request by a Councilmember or a citizen in which event the item will be considered at the completion of all other items on the agenda. The motion by the City Council on the Consent Calendar will approve and make findings in accordance with Administrative Staff and/or Planning Commission recommendations. a. Update on County Progress Regarding Recycling and Diversion 8. AUDIENCE COMMENTS ON NON-AGENDA ITEMS The City Council welcomes input from the audience. In order for everyone to be heard, please limit your comments to three (3) minutes per person and not more than ten (10) minutes per subject. The Brown Act regulations do not allow action to be taken on audience comments. 9. PUBLIC HEARING - 7:00 p.m. a. Adoption of Resolution Approving Policies, Rates and Rental Fees for City Facilities Located at the Municipal Pool, Anton Stadium, and Civic Center Council Chambers b. Appeal of Planning Commission's denial of Variance Application No. 92-8, as filed by William L. Daniel, for a reduction of the frontyard setback requirement for a corner parcel located in the M - Manufacturing Zone; and appeal of the conditions of the approved Site Development Permit Application No. 92-5, as filed by William L. Daniel, to construct a 9,000 square foot metal storage building on the northeast corner of Brush and Mazzoni Streets, zoned M - Manufacturing District This is a quasi-judicial hearing which requires Councilmembers to view the site prior to Hearing 10.
