DATED BETWEEN --PETE ESCOVEDO (Herein called ARTIST) AND (Herein called the PURCHASER) 1. Artist shall receive 100% headline billing in any and all advertising and publicity including marquee. 2. All Payments to the ARTIST by PURCHASER must be in CASH or CASHIERS CHECK or CORPORATE CHECK or UNIVERSITY CHECK: 3. No portion of the performance rendered hereunder may be broadcast, photographed, recorded, filmed, taped or embodied in any form for any purpose of reproducing such performance or part thereof without the Artist's prior written consent. Purchaser will deny entrance to any persons with audio or video recording device. 4. The name of the Artist may not be used or associated, directly or indirectly, with any product or service without Artist written consent. 5. Purchaser shall guarantee proper security at all times to ensure the safety of the Artist instruments, costumes and personal property before, during and after their performance(s). 6. Staging is under exclusive control of Artist's road manager or representative. 7. The Artist requires a clean dressing room for the sole use of Artist only. The room must be large enough for a minimum of eleven (11) people. The room should contain hot and cold running water, electrical outlets, mirrors and seating. 8. The Artist and Band Members shall receive a Hot Meal after Sound -Check. Chicken or Beef,Pasta for Vegetarians'. 9.. Purchaser shall provide at no cost to the Artist, complete sound and lights necessary for performance to include but not be limited to: (1) professional sound technician (1) professional monitor technician (4} . (2) bodied, competent stagehands prior to sound check and following performance. 10.HOUSE SYSTEM: Venue must provide a professional quality audio mixing console with no less than sixteen (16) input channels by four (4) subgroups into a single mono output. Each input must have at least three (3) bands of equalization, two (2) auxiliary sends and slides fader gain controls, one twenty-seven (27) band, third octave graphic equalizer for main output and one (1) cassette or cd deck patched for playback and recording. Fourteen (14) high quality low impedance microphones with adapters, stands and cables, plus one (1) direct box. Speakers system to be powered with no less than four thousand (4000) watts with three-way active crossovers. Monitors: Venue must provide on-stage monitors, consisting of no less than eight (8) inputs by four (4) discreet mixes, with separate equalizations for each mix, six (6) floor wedges and two (Z) drum fills. A monitor system operator must be provided unless otherwise notified by band. All equipment must be in good operating condition. Artist shall have the sole and exclusive right to sell merchandise (CDs -TAPES -SHIRTS -HATS, Etc.) at and in connection with the performance hereunder, and the receipts thereof shall belong exclusively to the Artist. 15. Artist shall have the sole and exclusive control over the production and performance of the engagement hereunder including, but limited to, the details, means and methods of the performance of the Artist hereunder.tp designate and change the performance personnel. Artist's obligation hereunder are subject to detention or prevention by sickness, inability to perform, accident, means of transportation, acts of god, riots, labor difficulties, epidemics and any act or order of any public authority in any case similar or dissimilar beyond Artist's control. 16 This agreement may not be changed, modified, or altered except by an instrument in writing signed by both parties. This agreement shall be constructed in accordance with the laws of the state of California Nothing in this agreement shall require the commission of any act contrary to the law, or any other rule or regulation of any union, guild or similar body having jurisdiction over the service Artist or over the performance hereunder and wherever or whenever there is any conflict between any provisions of this agreement and any material, law, rule, or regulation shall prevail and this agreement shall be curtailed, modified or limited only to the extent necessary to eliminate such conflict. This constitutes the sole, complete and binding agreement between the parties hereto.
