If an Act of God, including inclement weather, nature, war, riots, epidemics, strikes, an act (or order) of public authority, on -sight mechanical difficulties (e.g., a power failure) or other legitimate causes beyond the control of the parties should render the performance contemplated by the Contract and this Rider impossible, the parties shall not be liable to one another for any damages they sustain. In such an event, the parties shall attempt to reschedule the performance for another mutually convenient date and time. If rescheduling is not possible, then the Contract and this Rider shall become null and void upon either party's written notification to the other at its last known address. In such an event, neither party shall have any other or further obligation to the other arising out of the Contract and/or this Rider. 2. In signing the Contract and this Rider, the undersigned parties hereby represent and warrant that they are duly authorized representatives of the person or entity for which they sign and legally entitled to enter binding contracts on its behalf; that they have read this entire document; that they understand the terms and provisions of this document; that they know this document will affect their legal rights and/or those of the person or entity they represent; and that they have signed this document knowingly and voluntarily. 3. Absolutely no audio recording, video recording, nor radio broadcasting will be allowed during the performance unless prior written permission has been granted by the artist or their management. 4. Cancellation — If the presenter cancels the event less than 30 days before the show, 50% of the contract rate will be paid to band. 5. An advance deposit of 50% is required for amounts of $1000 and over. Balance is due to artist at the time of performance. Upon signing of this agreement and receipt of deposit, this engagement will be considered binding. Please send the signed contract, tech rider, hospitality rider, and 50% deposit within 10 business days of receipt of contract to Virginia Prater, PRATER DAY 5511 Briercliff Rd. Knoxville, TN 37918. Remaining balance should be paid to the band at the time of performance. If balance is paid by check, please make payable to The Dustbowl Revival LLC. Deposit can be made out to PRATER DAY. Artist Contact Venue Contact Signature: v,�.c— Signature: Jam' f Print Name: Virginia Prater Day Print Name: 4J Date: 3/17/2016 Date: - r _3 - /e: The Dustbowl Revival Technical Rider To ensure a quality concert, PRESENTER agrees to provide ARTIST with the following: Stage Requirements We require a stage/performance surface, preferably raised, approximately 15ft x 15ft (4.5 meters) at least, and a riser for the drums when available. The stage surface must be stable and meet basic safety requirements. A covered/tented stage is needed for sunny daytime shows, and heaters for cooler, evening shows. For evening shows, the stage must be lit so that we are seen. Production Requirements Artist's Management and Presenter shall determine load -in and sound check times prior to the actual performance day. Presenter shall guarantee Artist a minimum of one hour to actually "sound check" once the stage equipment, P.A. system, monitor system, etc. are fully operational. In the event of technical difficulties and/or delays, Presenter shall make every effort to delay opening the doors to the audience until Artist has completed sound check. Sound System Requirements Afirst-class professional sound system with an experienced pro -sound technician(s). Note that we do not travel with a sound crew and require an engineer from the venue. The system must be able to accommodate everything listed on the "Dustbowl Revival Stage Plot" and input list. Breakdown is as follows: (7) drum mics - kick, snare, hat, tom (2), overhead (2) (1) bass rig - see "backline" below (4) DI lines *we provide our own Dls* - trombone, ukulele, mandolin, fiddle (2) instrument mics - trumpet, guitar amp (5) vocal mics (5) boom stands (1) straight stand - trumpet (1) amp mic stand - guitar amp (7) drum mic stands Power laid out according to stage plot Phantom power for the Blue Mic and Ukelele (6) monitor mixes - *we will take up to 8. If less, must be discussed prior to show* Backline Requested Drums: Drum set with Remo coated Ambassadors on all drums; preferred brands are - Gretsch (no catalina series), Sonor, Slingerland, Ludwig, or Yamaha. Maple or Birch shells. Including... (1) Bass drum - 10" Remo Powerstroke 3 clear on Batter side, Remo Coated Ambassador on front side. (If only 18" or 22" bass drums are available, then 18" is preferred.) No hole in front head. (1) Bass drum pedal - DW, Yamaha, Gibraltar (1) Snare drum - 5 1/2" x 14" wood or brass (Gretsch, Ludwig, Yamaha); Remo Coated ambassador top head. (2) Floor Toms - 14" and 16" (1) Rack Tom - 10" (4) Cymbal Stands Bass: (1) Bass amp with at least a 12" or larger speaker. Brand preference in order - Mesa Boogie, Ampeg, and Ibanez. Guitar: (1) Guitar amp. Preference of the Fender Twin Reverb, VOX AC15, or Fender Blues Jr. Must have reverb.
