Presentation by Cultural Arts Advisory Boardmember Jim Mayfield Approval/Correction of Minutes of Special Meeting, April 25, 1994 RIGHT TO APPEAL DECISION Persons who are dissatisfied with a decision of the City Council may have the right to a review of that decision by a court.- The City has adopted Section 1094.6 of the California Code of Civil Procedure which g~ner~lly limits to ninety (90) days the time within which the i~lecision of the City Boards and Agencies may be judicially challenged. . . 0 CONSENT CALENDAR The following items listed are considered routine and will be enacted by a single motion and roll call vote by the City Council. Items may be removed from the Consent Calendar upon request by a Councilmember or a citizen, in which' event the item will be considered at the completion of all other items on the agenda. The motion by the City Council on the Consent Calendar will approve and make findings in accordance with Administrative Staff and/or Planning Commission recommendations: 1 a, Authorize City Clerk to Advertise Parks and Recreation Commission Vacancy Due to Resignation of Commissioner William Clarke Consideration of Amendments to Ukiah Solid Waste Disposal Site Stipulated Agreement~ 94-01 with Local Enforcement Agency, Mendocino County Environmental Health Department Award of Bid for One-Ton Truck with Service Body and Crane for Water Department AUDIENCE COMMENTS ON NON-AGENDA ITEMS The City Council welcomes input from the audience. PUBLIC HEARING *This is a Quasi-Judicial Hearing Which Requires Councilmembers to View the Site Prior to Hearing Appeal of Planning Commission Determination 'of Inadequacy of Mitigated Negative Declaration and Denial of Use Permit No. 93-32, KMart, to Allow Retail Sales and Construction of a 117,000 Square Foot Building and a 4,800 Square Foot Development Pad on North Orchard Avenue, Assessor Parcel Nos. 002-370-01,02, 03, 04, 05, 06, 07, and 08, 002-370-12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 23, and 24, in the C-2, Highway Commercial and Restricted Industrial Zoning District, and Assessor Parcel Nos. 002-137,18, 19, 23, and 24 in the R-2, Multiple Family Zoning District. b, Consideration of and Authorization to Execute Agreements Regarding Street and Bridge Improvements: (ii) (iv) Agreement Between City of Ukiah and KMart Corporation for KMart to Pay City $200,000 Towards Construction of Orchard Avenue Bridge at Orrs Creek Agreement Between City of Ukiah and Pear Orchard Associates for Pear Orchard Associates'to Pay City $75,000 Towards Construction of Orchard Avenue Bridge at Orrs Creek Agreement Between City of Ukiah and KMart Corporation for KMart to Loan to the City of Ukiah Funds to Construct Improvements on Brush Street from Orchard Avenue Extension Westerly to City Umits Agreement Between City of Ukiah and County of Mendocino for City to Construct Improvements on County Right-Of-Way and Accept Maintenance of the Improvements Consideration of Resolution Amending Fees for Final 48-Hour Notices and Disconnect Charges for City Utility Service 10.
