RIGHT TO APPEAL DECISION Persons who are dissatisfied with a decision of the City Council may have the right to a review of that decision by a court. The City has adopted Section 1094.6 of the California Code of Civil Procedure which generally limits to ninety (90) days the time within which the decision of the City Boards and Agencies may be judicially challenged. 5. CONSENT CALENDAR ~ The following items listed are considered routine and will be enacted by a single motion and roll call vote by the City Council. Items may be removed from the Consent Calendar upon request by a Councilmember or a citizen in which event the item will be considered at the completion of all other items on the agenda. The motion by the City Council on the Consent Calendar will approve and make findings in accordance with Administrative Staff and/or Planning Commission recommendations. a. Award of Bid for 55 feet Treated Cedar Wood Poles to McFarland Cascade in the Amount of $13,920 b. Adoption of Resolution Waiving 60 Day Noticing Requirement for Leasing Building Within City Limits by County of Mendocino 776 S. State Street Suites 102 and 102A (Public Health and Social Services Departments) c. Ratification of $5,000 Refundable Contribution to Pumpkin Festival d. Authorize City Manager to Send Letter of Support for Community Development Commission's Application for Housing Assistance 6. AUDIENCE COMMENTS ON NON-AGENDA ITEMS The City Council welcomes input from the audience. In order for everyone to be heard, please limit your comments to three (3) minutes per person and not more than ten (10) minutes per subject. The Brown Act regulations do not allow action to be taken on audience comments. 7. PUBLIC HEARING - 7:00 p.m. a. Consideration of Request to Vacate Stephenson Street Between Oak and State Streets, as filed by the Ukiah Redevelopment Agency for the Downtown Plaza/Park Project i. Approval of Negative Declaration of Environmental Impact ii. Adoption of Resolution Vacating the Stephenson Street Right-of-Way Between State and Oak Streets iii. Approval of the Plaza/Park Site design 8. UNFINISHED BUSINESS a. Approval of Resolution City Manager to Execute Submittal of Loan Application for Advanced Wastewater Treatment Project to State Water Resources Control Board b. Authorize Staff to Advertise for Bids for Construction of Advanced Wastewater Treatment Project at the Ukiah Wastewater Treatment Facility 9. NEW BUSINESS a. Consideration of Installation of Girls Softball Field Improvements at Giorno Field b. Consideration of California Parks Bond Act Recommendations c.
