HomeMy WebLinkAboutCounty of Mendocino 2015-11-09(.ELL � Y/L 15-1(0• J S GRANT AGREEMENT BETWEEN COUNTY OF MENDOCINO AND CITY OF UKIAH irL This Agreement is entered in Ukiah, California on November `j, 2015 ( "Effective Date "), between the County of Mendocino and the City of Ukiah ( "City "), a California general law municipal corporation. RECITALS: 1. The City and the County of Mendocino ( "County ") recognize the immediate unmet need for a homeless shelter in the Ukiah Valley this winter. 2. The City has allocated $30,000 to help pay the costs of opening and operating the winter homeless shelter, to be disbursed to the County. 3. The County has allocated $60,000 in matching funds to help pay the costs of opening and operating the winter homeless shelter, $30,000 of which has been matched by the funds allocated by the City. An additional $30,000 of matching funds from the County is available. 4. At its regular meeting of October 7, 2015, the City Council authorized the City Manager to negotiate and execute an agreement with the Mendocino County AIDS /Viral Hepatitis Network ( "MCAVHN ") for the operation of an Emergency Winter Shelter contingent upon demonstration of readiness. 5. Upon consultation with the County, at its regular meeting of November 4, 2015, the City Council revised the action taken on October 7, 2015, to give the City Manager authority to negotiate and execute an agreement with Mendocino County to receive and disburse the City's allocated $30,000 together with the County matching funds to an appropriate lead agency to develop and operate the winter shelter. 6. The City has been informed that after October 7, 2015 and prior to November 4, 2015, MCAVHN has incurred expenses to prepare the winter homeless shelter facility. 7. In order to expedite the implementation of the Emergency Winter Shelter, the County will execute a contract under the authority of the Purchasing Agent /CEO for a total of $50,000 effective November 9, 2015 to allow payment on November 12, 2015. A contract amendment will be submitted to the Board of Supervisors for approval of the maximum amount of $90,000 to include the $60,000 allocated by the County and $30,000 allocated by the City. 1 AGREEMENT: Based on the foregoing recitals and the terms and conditions as stated below, the City and County agree as follows. 1. The $30,000 contributed by the City shall be used exclusively to pay the costs of opening and operating the winter homeless shelter, including any expenses determined by the County to have been reasonably and necessarily incurred by MCAVHN between October 7, 2015 and November 4, 2015, to prepare the winter homeless shelter facility for use as the winter homeless shelter. 2. By signing this Agreement, the County acknowledges the receipt of $30,000 from the City and agrees not to expend any of these funds until it is prepared to disburse a like amount from the County. The County shall not use any portion of the combined funding to reimburse the County for any costs it incurs to administer the funding of the homeless shelter. 3.
