HomeMy WebLinkAboutUkiah Unified School District (UUSD) 2013-11-07 �D1,�- !�0 • 13(K - ��r MEMORANDUM OF UNDERSTANDING BETWEEN CITY OF UKIAH POLICE DEPARTMENT AND UKIAH UNIfIED SCHOOL DISTRICT This is a memorandum of Understanding between the City of Ukiah Police Department and the Ukiah Unified S�hool District. It is expressly understood and agreed by both the City of Ukiah Police Department and the Ukiah Unified School District as follows: I. PURPOSE: The purpose of this Memorandum of Understanding is to establish and maintain an effective working relationship between the parties. The purpose is also to provide the means by which the City of Ukiah Police Depzrtmert and;he Ukiah Unified School District will coordinate School Resource Officer servites to students,faculty,and residents on the campus of and in the immediate vicinity of Ukiah High School and Pomolita Middle School through collaborative proactive activities. II. TERM: The term of the Memorandum of Understanding shall commence July 1, 2014, and shall be extend on an annual school year basis, until either party provides written notification cancelling the terms ofthis agreement. (See TERMINATION below) III. ASSIGIVMENT: The School Resource Officer shall work days and hours mutually agreed upon by City of Ukiah Police Department and Ukiah Unified School District. The School Resource Officer shall work four(4) days per week at the Ukiah High School; provide services to Pomolita Middle School and Ukiah Elementary Schools during the s[hool year to atcomplish the listed objective; provide training to school staff in law enforcement issues; and work cooperatively with school staff in resolving school related crime problems and investigations. Should the School Resource Officer be required to leave the school to perform his duties,he shall notify school administration of his departure and his return. IV. HIRING/EVALUATION OF PERSONNEL: School Resource Officer hiring and evaluations shall be a cooperative process involving the Chlef of Police,or designee, and the Ukiah Unified School District, Assistant Superintendent of Human Resources, or designee. Both parties must approve of the employee's performance level for rating of satisfactory or above. V. EQUIPMENT: The City of Ukiah Police Department shall provide the School Resource Officer with equipment for performance ofjob requirements,including use of a marked police unit, drug detection dog,and safety related equipment required for the assignment. Memorandum of Understanding—Page 2 City of Ukiah Police Department/Ukiah Unified School District Ukiah Unified School District shall provide on-site office space and equipment, including telephone and computer access,to allow the School Resource Officer to function efficiently in an offi�e setting. VI. FUNCTIONAL SUPERVISION: The School Resource Officer will work cooperatively with school personnel,who shall use their besi efforts to cooperate with the School Resource Officer in the performance of his law enforcement duties under this Agreement, but the School Resource Officer will perform his duties under this Agreement under the supervision and direction of his supervisor at the Ukiah Pollce Department. VII. PERSONNEL SERVICES: The School Resource Officer is an officer assigned specifically to the program. When that offi[er is absent from work,the City of Ukiah Police Department may provide a replacement officer if another office is available to fill all or a portion of the affected work day(s�. Ukiah Unified School District shall reimburse the City of Ukiah a minimum of$90,000 per school year for the services provided by the School Resource Officer under this Agreement. This reimbursement will be adjusted annuallyto cover the benefited cost of an A2 Step (Entry Level) Officer and additional MOU increases that may be received by the Police Officer Association in the future. VIII. ABSENCE FROM WORK: Absence of the Schoal Resource Officer from work due to illness, family death,family sickness, approved treining or time off approved by the Chief of Police, or his designee, shall not reduce the amount of the reimbursement to the City under Section VII of this Agreement. IX. METHOD OF PAYMENT: Duringthe school year,Ukiah Police Department will provide two invoices for% of total payment per request. Invoices will be submitted on December 1 of each year, and June 1 of each year. X. PROGRAM TERMINATION:This Memorandum of Understanding may be terminated at any time, by either party, by giving a written notice thirty(30)days prior to the termination date. In the event of termination, Ukiah Unified School District shall pay the pro-rated portion of the reimbursement required by Section Vll based on the number of unreimbursed months of service on the termination date. XI. HOLD HARMLESS: The City of Ukiah Police Department shall indemnify, hold harmless, and defend Ukiah Unified School District from and against all claims,damages, losses and expenses, including reasonable costs and attorney's fee, arising out of or resulting from the City of Ukiah Police DepartmenYs performance under the contract, excepting only such injury or harm as may be caused solely and exclusively by the Ukiah Unified School DistricYs fault or negligence. Such indemnification shall extend to all claims, demands,or liabilities occurring after completion of the contract as well as during the progress of the contract. , . . INSURANCE: Each entity shall obtain insurance or pooled risk coverage that is acceptable to thc cthcr enti;y. A. Public Liability Insurence: Personal injury and replacement value property damage insurance coverage for all activities of the parties arising out of or in connection with this contract, written on a comprehensive general liability form including contrac[or's protected coverage, blanket contractural,completed operations,vehicle coverage and employers non-ownership liability coverage, in an annual policy limits of no less than $1,000,000.00 combined singie limit personal injury and property damage for each ocarrence. B. Workers' Compensation: The City of Ukiah shall provide Workers' Compensation coverage for their employee. Nothing in this agreement shall be construed as providing that the employee of one entity in an employee of the other entity. Certificate by the Joint Powers Authority shall suffice for evidence of insurance. XIII.
