AUTHORIZATION Upon execution of this amendment, service provider is authorized to provide the service described under the Scope of Additional Work identified in this Amendment No. 1. SCOPE OF ADDITIONAL WORK Work authorized by this amendment shall include that work described in the October 3, 2013 letter proposal from GHD, Inc., with the requested amount for compensation as modified herein. A copy of said letter is included in this amendment. COMPENSATION Compensation for the performance of the additional work shall be made on a time and expense basis at Consultant's customary fees. The professional consulting services will be provided under the City of Ukiah's agreement dated October 16,2012 and all provisions of this agreement shall apply. The original scope of services for this project was based on the 30% design produced for the MCOG Mendocino County Rail with Trail Feasibility Study. The concept presented in those plans did not include a pedestrian refuge and re-alignment of the roadway at the Perkins Street crossing and nor the trail alignment change requested by the NWP Co. between Perkins Street and Clara Avenue that was identified in their most recent comments on the revised 30%concept drawings. Additional tasks are proposed for work that has been identified as necessary to address necessary changes that have been identified during the initial design effort, and/or review comments provided by NCRA and their consulting engineers. It is believed that addition of the pedestrian refuge and roadway shift at Perkins Street will provide improved safety at the planned crossing and that the new proposed trail alignment will consolidate the trail corridor and improve the potential for developable parcel(s) of land between the new trail alignment, and the existing development west of the railroad right-of-way. Scope: 1. Additional Topographic Survey Additional survey will be needed to allow for design of the roadway shift to accommodate the pedestrian refuge at Perkins Street and for the design of the improvements between Perkins Street and Clara Avenue including the following areas: • Along the alignment proposed by NWP Co between Perkins Street and Clara Avenue. The area generally area bound by the main line track and the original proposed alignment and includes the main line track prism. • Portions of Perkins Street roadway and shoulder both east and west of the proposed trail crossing and including portions of the private property on the south side of Perkins Street. This task will be added to Phase 03—Survey.The estimated fee for this task is an increase of $8,000. Additional Design Services Per the City of Ukiah's desire for a pedestrian refuge at Perkins Street, GHD will re-align and widen Perkins Street to accommodate this improvement. This will require: . Widening at Perkins Street will include design of the following: new 8'wide pedestrian refuge between the eastbound and west bound travel lanes, obstruction and lane guidance striping, new signage, new curb, gutter, and sidewalk on the south side of the intersection, a realignment of the east bound travel lanes, drainage improvements, and identification of required utility relocations. • Coordination with NCRA for relocating or removing railroad appurtenances. • Coordination with City of Ukiah for affected City owned utilities. • 1-2 Additional geotechnical borings and calculation of R Value to determine the pavement section. • Additional modifications to the intersection geometry to accommodate tapers, sidewalks, curbs and new roadway realignment and widening. • Design of an ADA compliant path of travel and associated sidewalk crossings and ramps. This task will be added to Phase 11 —90%PS&E.The estimated fee for this task is an increase of$18,000. 3. Legal Description and Exhibits for Right of Way Acquisition It is anticipated that a portion of the privately owned parcel on the south west side of the Perkins Street intersection (Quan Property-APN 002-231-29)will need to be acquired to accommodate the roadway widening for the pedestrian refuge. A licensed surveyor will prepare a legal description and exhibit for use by the City to acquire a portion of the privately owned parcel. Deliverables will include a plat map and closure calculations and a legal description of the proposed easement area identified in consultation with the City. The survey or will also use temporary markers to identify the area of the easement to assist the City with discussion with the private property owner. This work does not include any permanent monuments or completing a record of survey. This task will be added to Phase 03—Survey. The estimated fee for this task is an increase of $2,500. 4. Additional Coordination and Meetings with NCRA Two meetings with NCRA were anticipated during the initial scope. It is anticipated that the City will request that GHD provide updates to the NCRA Board at two additional meetings, one in May and One in June, at which GHD will provide an update on the status of the project to the NCRA and provide a presentation to the board on the project deliverables. This task includes preparation and attendance for two additional meetings This task will be added to Phase 07 —Project Management.The estimated fee for this task is an increase of$1,600. 5. CPUC Diagnostic Review and General Order 886 Application The NCRA has requested that a diagnostic meeting with the CPUC be held with CPUC staff to review the project for consideration of the configuration and safety related issues of the at-grade crossings. This task includes organizing and participating in a diagnostic review meeting with the NCRA and CPUC Staff. 2 �� � Additionally, the reconfiguration of the at-grade crossing at Perkins Street to incorporate a pedestrian refuge triggers a formal review and approval by the Public Utilities Commission of the State of California under General Order 88-B as the proposed change will include roadway realignment that is functionality related to the existing crossing. GHD will prepare a letter requesting the CPUC Review and Authorization for construction of the Cit�s trail project and include a vicinity map, plan sheets of the proposed crossing, description of the proposed alterations, benefits achieved, and description of warning devices,temporary traffic controls and a copy of the CEQA Notice of Exemption as prepared by the City for the subject project. This task will be added to Phase 01 — Project Management. The estimated fee for this task is an increase of$1,600. Schedule: GHD will complete the above tasks per The attached schedule. Cancellation of Task 6 and Budaet Decrease: Per direction from the City, GHD will no longer be completing Task 6(Public Workshop).Therefore,the original contract amount of$154,316 will be decreased by$4,632 to account for the removai of Task 6 (Public Workshop),for a revised fee of$149,684. Budqet Increase per Phase Associated with the Additional Tasks: The estimated fee for GHD to complete the above scope within the above schedule is$31,700. . Total budget increase$31,700 Conclusion: The revised fee of$149,684 (which accounts for the removal of Task 6) will be increased by$31,700 to accommodate for the addition of tasks outlined above, for a revised contract amount of$181,384.
