judicial action, and failure to accomplish thistask shall constitutegrounds for recusai.

6. COMMENTS FROM AUDIENCE ON NON-AGENDA ITEMS
The Planning Commission welcomes inputfrom the audience. In orderfor everyone to be heard ,
piease limit your comments #o three (3) minutes per person and not more than ten ( 10) minutes
persubject. The Brown Act regulations do not ailow action to be taken on audience comments.
7. APPEAL PROGESS
All determinations of the Planning Commission regarding majordiscretionary planning permits,
shafl be final unless a written appeal, stating thexeasons for fhe appeal, is #iled with the City Clerk
within ten (10) days of the date the decision was made. An interested party may appeal only if he
or she appeared and stated his or her position duringthe hearing on the decision from which the
appeai is taken. Because of the Christmas holiday, the last date to appeal a decision made at
this meeting is Tuesday, December27, 2005.

9. PUBLIC HEARINGS
A. Zoning Ordinance Amendment 05-59 - Marijuana Cultivation. Theproposed amended
ordinance deletes the six piants per parcel limit and the permitting provisionsin the current
ordinance. The revised ordinance also prohibits outdoor growing . Indoor cuitivation is
proposed to be Jimited to qualified patients and primary caregive�s in residential zoning
districts and #he neighborhood Commerciai zoning dist�ict. The total number of plants is
proposed to be limited to no more than tweive mature or 24 immature marijuana plants
within a fully enclosed and secure structure. The revised Ordinance also prohibits any
public nuisance resulting from the cultivation of marijuana:

B. Major Use Permit No. 05-55 , as submitted by Jason Waoldridge for Craig and Jane
Rohrbough, to allow the conversion of an existing detached garage that is located 1 '-2"
from the south property line and zero feet from the east property line into a 297 square foot
second dwelling unit. The subject property is located at 707 West Standley Street and is
curtently developed with a primary residential dwelling (APN 001 -225-07) ; zoned R-1
(Single-Family Residential).
