1. ROLL CALL
Ukiah City Council met at a Regular Meeting on October 2, 2013, having been legally noticed on
September 27, 2013. Mayor Crane called the meeting to order at 6:02 p.m. Roll was taken with the
following Councilmembers Present: Mary Anne Landis, Benj Thomas, Vice Mayor Phil Baldwin,
and Mayor pouglas F. Crane. Staff Present: Jane Chambers, City Manager; David Rapport, City
Attorney; and Kristine Lawler, City Clerk.

a. MCOG Presentation of Preferred Scenario for the Vision Mendocino 2030 Project. I
Presenters: Nephele Barret and Bruce Brubaker of Mendocino Council of Governments (MCOG).
Consensus of the Council directs MCOG representatives to consider incorporating easy access
connections from the City of Ukiah to Mendocino College as a priority in their Blueprint Plan.

Measure S. Data is to be in a graph form that provides scaled visual representation with all
reasonable detail of all the components of cost, including those funds which come back for the use
of the general government services.

List, and approves the disbandment of the following Ad Hoc Committees: Water Reclamation,

Motion/Second: Landis/Baldwin to approve the formation and appointments of the following two Ad
Hoc Committees: Mayor Crane and Councilmember Landis for the Study of Feasible Alternatives for
Street Infrastructure Maintenance and Improvement, and Mayor Crane and Councilmember
Thomas for the Rate Studies for Water and Wastewater Utilities. Motion carried by the following
roll call votes: AYES: Landis, Thomas, Baldwin, and Crane. NOES: None. ABSENT: None.

b. Adopt Resolution Renewing the Delegation of the City Manager and/or the Electric
Utility Director to Approve Power Purchases for the City Pursuant to the Ukiah-
NCPA's Market Purchase Program (MPP) Agreement and Authorize the City Manager
and Electric Utility Director to Manage the Energy Attributes for Carbon and
Renewable Energy Credits to Meet State Compliance Obligations and Maximize the
Value to the City's Rate Payers — Electric Utility Department

Manager and Electric Utility Director the authority to approve power purchases pursuant to the I

approve and negotiate purchases and sales of bundled energy attributes for carbon and renewable
energy credits (RECs) not to exceed 100% of Ukiah's needs, requiring approval of City Manager
and the Electric Utility Director for carbon and bundled REC sales transactions. Motion carried by

Indexing as a tool to help maintain a level playing field for City/County sales tax sharing.
Since the founding of our national currency federal monetary policy has yielded a seemingly never
ending dedine in the value of the dollar, commonly called inflation,more accurately it is devaluation ;�
another form of taxation. To cope with the devaluation of the dollar many contracts include periodic
adjustments based upon on some index or combination of indexes that track the prices or costs of
various "baskets" of goods and/or services in various markets over time.
In the case of the city and county sharing sales tax above a base amount generated by increased tax
revenue from existing and/or new businesses it seems prudentto annually adjust the base amount with
Ithe intent of canceling the skewing that would result without indexing.
Hypothetically,say the base year establishes the threshold amount for sales tax sharing as$1,000,000 so I
the amount of Sharable Sales Tax(SST) is the amount in excess of the base$1,000,000. Projecting a 2% �
compound annual increase in sales tax revenue: ,
The 1"year of revenue increase the subjec[tax is$1,020,000, so $20,000 of SST.
In year 2 of revenue increase the tax is$1,040,400 so SST of$40,400.
In year 3 51,061,208 so SST of$61,208.
In year 4$1,082,240 so SST is$82,240.
In year 5 51,104,080 so SST of$104,080.
If[here were no change in the value of the dollar in the life of the agreement all of the increase in the
, revenue would be SST to be distributed according to the sharing ratio. But if the dollar devaluation were
2qo compounded for those 5 years there would be nothing to share since no actual increase in value had
occurred. I
' It is extremely unlikely the value of or rate of decay of the dollar will be constant so indexing the base, I
year over year to deal with that reality is crucial to any tax sharing agreement.
