Thzs Agreement is made and entered on April Y3, 2013, In UKiah, I
California, by and between Pesranti Cons :ruction, _nc. a coipocation
("Contr.actor") ar.d _he City of Uk'_ah ("City") , a general laumunicipal
corporation.
RECITALS:

City of engineerinq, insoection, s�perintendence and other overhead �
expenses which are directly chargeable to the contcact and which
accrue du:inq �he per_od of such extens:or., except that the cost

1.2 Construction of Contract Doct�mnte. Contractor will perform
the Work ir. compliance with �he plars ar.d speciiications set forth
in the at*_acF.ed ExhibiC A. If there is any ir.consistency or conflict
between the p':ans and t`,e speci:icacions, t`�e specificat�ons will
prevail. If there is any inconsistency berween the pl�ns and the
specifications and this aqree:nent, the terms of this Agreement shall
prevail, unless expressly stated otherw;se in a par:icular
specification.
1.3 Contractor fuzniehed itema . .^_ontractnr wiil furnish all
necessary labor, :naterials, tools, equipment, and transportation

1.4 Use of Employees.

1 .5 . 2. Contractor shall comply with the Ca',ifornia
Labor Code Section 1?�5. Ir. accordar.ce wit:� said Section 1775,
Contractor shaL' forfeit as a penalty to the City, $SO.00 for each

1I70 to 1780, inc�usive. ln addition r_o said penalcy and purauanc
to Section :'775, the differer.ce between such stipulatec pzevailing
wage rates and the amouct paid co each workman foz each calendar day
or portion thereof for which each wotkman was paid less than the
stioulated prevailing wage rate shall be paid to each workman by the
Cor.tractor.
1 . 4 . 3 . Pursuant rn the provision of Section P70 of the
Labor Code o° the State of California, City has ascertained the general
prevailing rate of wages (which rate inc'_uces employer payments for
hea_thand welfare, vacation, pensionandsimilarourposes) applica�le

I of wo�kers concerned. Copies of the Genera� Prevai:ing Wage
Determi.nation are on Yile in the office of the City Engineer and are
available to the Contractor on request. The Contractor sha11 post
the wage determination at the site cf work in a promir.ent place where
the workers can easily see it.
1. 9 . 9 . Ci�y will r,ot recocr.ize any ciaim for additional
compensa�ion because che Ccntrac.o- has paid any rate in excess of
the nrevai:ing wage rate obtained from the City Eng�:neer. The
possibi;ity of wag� increases is one of the elert:ents to be considered
by �he Contractor ir. determining his or her bid and will not ir. any I
circumstances be consideied as the basis for a claim against the City. �I
1. 9 . 5. Travel and Su�sistence Payments.
Contractor shall make travel and subsistence payments to �
each worker needed tc execute the work in accordance with the
requirements in Sect:on 1773. 8 of the Labor Code (Chapter A80, Statutes
of 1968; .
1 . 4 . 6. Apprer.tices.
At_ention is directed to the provisions in Sections ;777. 5
(Chapter ':5i1, S[atctes of 1968) and 1777. 6 of the California Labor
Code concerning the employment of apprentices by the Contsactor oc i
any subcontractor under him. Contractor and any subcor.traccor under
him or :�er shall comply with the zequirements of said sections in
the employment of apprer.tices.
Informat�on relative �o apprenticeship standards, wage
schedu:es and other requirements may be obtained from the Director
of Industrial Relations, ex officio the Administrator of
Apprenticeship, San Francisro, Cal.`orr.ia, or trem the Civision of
Apprer.[iceship Standards and its branch offices.
Copies of :,abor Code SecLions 1'71 (reyuiring prevailing wages; , :775
(imposing penalties, including a S50 per day, per wor;cer forfeiture,
for fai:ure to pay prevailing wages) , 1776 (requiring contractor to
maintair, availanle for inspection certified payroll records; , 1777. 5

1.5 CSTY Inapactor. CITY may desig�ate an architect, engineer,
ot.^,er design professional or othez inspectar ("Irspector") to
suoer.vise and/or inspect Contractor's per=ormance of the Work. The

Inspector shal'� have no authority to change the Work, the comoensation
for performinq the Work or the time for completing the Worx witnout
City' s prioi written approval. City shall no�iYy the Contractor in
writing, if ir_ designates an Inspector.
1.6 Siie Conditions. Contractor acknowledges that it has
inspected the work si=e and any impzovements involv:nq the Work and
satistied i�sel� as to the conditions which can affect the Work or
its cost. Contractor has not relied on any representation by CITY
or its officers or empioyees as to the condirion of the site or the
houses or any conditior. that might affect the cost of performing this
Agreement.
1.7 Nea Pzoducta Requirod. n:l equcpment, materials orfixtures
furnished by Contractor ucder rhis Rgreement shall be new and ef the
most suitable g�ade for tne incended purpose, unless otherwise
speci:icaL y provided.
1.8 Compliane� wilh Lawa. The Contractoz shall give all notices
ar.d compty with al'_ app:icable laws, ordinances, codes, ruies and
regulations. ^:�e Cont°actor shall secure and pay for a11 permits,
fees, and �iicenses necessary `or *_he proqer exec�tion and completior.
o` the work.
1.9 Protection of Site and Improvementa. The Contractor Shall
preserve and protect the s•:te, grounds ar.d any invclved impZOVements
and shall not alter or damage any portion theteo:, except as is
absolutely necessacy in order =o perform tne Work. The �ontractor
shall repait or replace, as directed by CITY, any property that i'_
danages, ] ooses or destroys in violation of this paragraph. Contractor
shall assume full responsibility for maintainilg the safety of the
wor2sit° in cempliance witn all appl:cable State and federal workei
safecy and protection lews and snal: maintain the worksite in
compliance with all such laws.
1.10 Inspectioa of Work. The Contractor shall ens•�re that the
N'ork is available for inspection by C1'1'Y or its Inspectoz at all
reasonable tin:es and that no work is covered up or rendered incapable
of in3pection without prior notice to CSTY or its InSpector and a
reasonable opportunity for insoe�tion. ':he presence or absence of
an CITY inspector or the conduc= of an inspection by CITY or its
Inspector shall r,ot relieve the Cor.tractor frorti any c�ntract
requirement or compliance with Exhibit A.
1 .11 Title. The Cor.t;actor warrants that it conveys full ar.d
complete tit'�e, free of all liens ar,d er.cumbrances, to all materiais,
Supplies, fixtcres and equipment furnished tc CITY under tFis
Agreement and agzees to fully de°.end and indemnify CITY, its officers
and employees, and the houses and hnmebcyers included in the Work

1.12 Warrantias. Tn addit_on to any o�her Narrar.ties in this
contract, the Cor,tractor warrants �hat the 'r]ork conforms to the
contract requiremen�s and is free of any defect in eGuipmer.t, material
o= workmanshio `or a perioc of one year from tne date of final
acceptance of the ltio�h by C1TY. �f CI.Y accepts any part of the Wozk
before final acceptance of the entire Work, the warranty shall continue
fer the period of one yeaz from the date of such partial acceptance.
The Contractor shall remedy, at the Contracter's expense, any failure
to cor.form, or any defect. [Initial i: followiny senLence applies

1 .13. Extension of Time.
Should any de':ays occur which the City may �onsider unavoidable, as
hereir. definea, the Contractor sha?1 , oursuant to his or hei
application, be allowed an extension of time proportional to said
delay or delays, beyond the time here�n set forth, in which to complete
tris contract; an�l : iqu�<da�ed damages for delay sha11 not be charged
against the Cortractor by the City during an extension of time granted
because of unavoidable delay o: delays .
Any claim by Contracior for a tir.e extension based on unavoidable
delays shall be based on wr�tten notice delivered to the City witrin
15 days of tne occurrence of the ever.t qiving rise :o the claim. Failuze I
to file said written notice within t:�e time speciiied shall constitute
a waiver cf said claini. Notice of che fuil extent of the claim and
a11 suoporting data must be delivered to the City within 45 days of
the occurrence unless the City specifies in writing a longer period.
All claims for a rime extension must be approved by the City ar,d
incozporated ir.to a written change order. i
1.14. UnPavorabla Waather and Othor Conditione. �
Du_ing unfavorable weather and other conditions, the Contractor shall
pursue only such portions of. the w�rk as shall not be damaged thereby.
No portions of the work whose satisfactory quality or efficien .ry will
be affec[ed by any ur.favorable conditions shall be constructed while
these conditions remain, unless, by special medns or p:ecautions
approved by the City, the Contractoz shall be able to ove°ceme them.
The Contractor sha:1 be granted a �_me extensio� of one day for each
unfavorab�e wealhez day that prevents him oz her from placing concrete
forms oz p_acing and finishing concrete or asphalt concrete. Such
unfavorable weathe_ day is defined as a rain day where precipitation

1.15. Saturdny, Sunday, Holiday and Niqht Work.
No wcrk ahall be done becween th.e hours of o p.m. and 7 a.m. , nor
on Sa:urdays, Sundays or legal holidays except such wotk as is
necessary forthe propercare and protection of workalready performed,
os except in cases of absolute necessity and in any case only with
the permission of the City.
It is understood, however, that ❑ight work may be estabiished as a
reqular preceduxe by the Contractot if he oz she fiisY obtains the
written permissicn of the City and that sucn pe�mission may be revoked
at any time by the City if the Contractor fails to maintain at night
adeauazeforce and equ'pment for reasonable prosecutior, and tojus�ify
inspection of the work.
1 .16. Houza o£ Labor.
Eiqht (8� hours of laGOZ shall constitute a legal day' s work and the
�ontractor or any subccntractox shall not :eauire o: permit more than
eight hours of labor in a day from any person employed by him or her
in the performance of the work under t:nis contract, unless paying
compensation for all hours worked in excess of eiqht (&) hours per
day at not iess than 1 �Z times the basic rate of pay. The Contractoi
shall forfeit to the City, as a penalty, the sum of twenty-five do11a=s
�S25. 0�) for each workman employed in the execution of the contract
by him or her or by ar.y subcontractor, for each ca:endar day during
which such laborer, worianan, or mechanic is requ�red ot permitted
to labor mOZe than eight houis in violation of the provisior,s of Section
1810 to 1816, inclusive, ;A_ticle 3, Chapter 1, Part "7, Division 2;
of the T.annr C�de of the State of Cal-fcrnia and any acts amendatory
thereof.

4 . ZNDEt�4dIFICATION AND INSIJItANCE. II

4 .1 inde�nification. The Contractor sha11 do all of the work
and furnish all labor, macerials, tools and appliances, except as I,
otnerwise herein expressly st�pula=ed, necessary or prOpet foz �
per�orming and completir,g the work herein required in the manner and
withir. the t:me nerein specified. The mer.tior. of ar.y specific duty
o: liaoility impr,sed upon the Contractor sha L not be construed as ,
a limi�acion or restr,:ccion of any general liaoiiity or dity impesed '
upon the Contractor by rhis concrar.t, said reference to any specific ',
d�ty or liabili�y being made herein merely for t!�e p�rpose of
explanatior,.
:he right of general supervision by the City shall not n.ake the
Concractor an ager.t of rhe City and the liability of the Contracto:
for a'�1 damages to persons or to public or private property, arising
from the Contractor' s execution of the work, shall not be lessened
because of such general supervision.
(Jnti1 the completion and 'ir.ai acceptance by the City of all the work
under and implied by this contract, t}:e work shall be under the
Contractoz' s responsible ca:e ar.a charge. '1'he Contractor shall rebuild,
repair, restoLe and make good a'_� injuries, damages, re-crections ,
and r.epairs, occasioned or rendered necessary by causes of any nature
whatsoever, exceptinq only acts of God and none other, to all or any
po_tions of �he work, except as otherwise stipu'_ated. '
To the fullesl extent permitted by law, ContractoL shail indemnify ��
and hold harrnless the C�ty and it5 officers, ditectors, agents, and
employees from and aqainst all claims, damages, losses and expenses

6.2 Znsuxance. Contsactoi shall procuze and maintain ior the
duration of the contzact insurance against claims for injuries to .

cr her ag=nts, repcese�tatives, employees o� subcontractors.
4.2.1. Minimum Scope o£ Ineusance
Coverage shal ] be at least as broad as:

3. Worker' s Compensation insurance as required by the

Any deductibles or scl_`-ins��red retcntions must be decLared �
to and approved by the City. At the option of the City,
either: the insurer shall reduce or eliminate such
deductibles or self-insured reter.tions as respects the City,
its ofiicers, oificials, employees and volunteers; or the
Contractor shal'� provide a financi.al quarantee
satisfactory to the City quaranteeing payment of losses
and rela�ed investigations, claim administration and
defense exper.ses.
6.2 . 6. Other Ineurance Proviaiona
The genersl iiability and automobile liabilit policies
are te con�air„ or be endorsed to contaln, t e `ollowing
provisions:
1 . The city, its officers, officials, employees, and
volunteers are to be covered as insureds with respect to
liability arising out o� automobiles owned, '_easad, hlred
or borrowed by or on behalf of [he contractor; and witY.
respect to liabiiity arising out of work or operations
per°.ormed by or on behalf of the Contractor including

4.2.7. Subcontractore
�ontractor sha17 inc.lude all subcontractors as insureds
under its policies or shall furnish sepasate certificates
and endorsements for each subcontzactor. All coverages for
subcontractors shall be subject to all of the requiiements
s*a�ed herein.
5. TEAMINATION.
This Agreement may only be terminated by City: 1) for breach
oi the agreement; 2) because .`unds are no longer available to pay
Contractor for services provided under this Agreement; or 3) City
has abandoned and does not wish to complete the pro;ect for which
Conr.ractor was retained. City shall notify Contractoz of any alleged
breach of the agreement and of the action required to cure the breach.
1Y (;o�tractor fails to cure the breach within the lir.�e specified in
*_he notice, the contract shall be terminated as of that time. If
terminated for lar.k of funds or abandonment of the project, the
contcact shall terminate on the date notice of cermination is given
to Contractor. City shall pay the Contractor only for services
performed and expenses incurred as of the effective termination date,
unless terminated bccause the Cor.tractor has failed to satisfactnrily
cure a breach after notice in which event City shall:
a. retain any amounts earned unde: the Cor,tract but not yet
paid by City;
b. take possession of all material and Tixtures on the job

right :.o, ar.d shall not con�_rol lhe man:�er or prescribe the metnod
of accomplishing those services contracted to and performed by ,
Contractor under this Agreement, and the general public ar.d all
goverrunental agencies regulating such activity shall be so informed.
Those provisior,s o_' this Agzeement that reserve ultimate
au�nority in City have been inserted solely to achieve compliance
wi[h federal and state laws, rules, reyulations, and interpretations
thereof'. No such provisions and no other provisions of �hi� Ayreement
shall be interpreted or construed as creating cr establishing the
relationship of employer and employee between Contiactor and City.
Contracto° shall pay all estimated and actual federal and s�ate
income anc se:f-employment taxes that are due the state and federal I
governmer,t and shall furr.isn ar,d pay worker ' s compensation insurance, I
unemploymenc insurance and any other benefits required by law for
himself and his emQloyees, if any. Contractor acrees to indemnify
and hold City and its ofYicers, agents and employees harmless from
and against any claims or demands by federal, state cr local government
agencies for any such taxes or benefits due but not paid by Cor.tractoz, I
including r.he legal costs associated with defendinq against any audit, I
claim, demand or law suit.

(a)
(1) The contractor and any subcontractor under the contractor shall, as a penalty to the state or
political subdivision on whose behalf die contract is made or awarded. forfeit not more than fifty
dollars ($50) for cach calendar day, or portion thereof, for each worker paid less than the prev�iling
wane rates as determined by the director for the work or craft in which the worker is employed for
any public Nork dune under[he contract by the contrac[or or, except as provided in subdivision (b),
by any subcon[rac[or under the contractor.

(A) '1'he amount of the penalty shal I be determined by [he Labor Commissioner based on
consideration of both of the following:
(i) Whethcr the failure of the contractor or subcontractor to pay the correct rlte of per dicm
wages was a aood faith mistake and, if so, the error was promptiv and volimtarily corrected when
brought to the attention of the contractor or subcontractor.
(ii) W hether the contractor or subcontractor has a prior record of failing to meet its pre-
vailing wagc obligations.
(B)
(i) 'I�hc pcnalty may not be less than ten dollars ($I 0) for each calendar day, or poition
thcreof, for cach worker paid less than the prevailing wage rate, unless the failure of the contractor
or subcontr�ctor to pay the correc[ rate of per diem wages was a good faith mis[ake and, if so, thc
error was promptly and voluntarily corrected when brought to the attention of the contractor or
subcontractor. �
(ii) The penalty may not he less than twenty dollars ($20) for each calendar day, or portion
thereof. ibr each worker paid less than the prevailin� wage rate. if the contractor or subcontr�ctor
has been assessed penalties within [he previous three years for failino to mee[ its prevailina wage

obligations on a separate contract. unless those pcnalties were subsequently withdrawn or over- �
turned.
(iii) 'I�he penalty may not be less than thirty dollars ($30) for each calendar day, or poRion
thereof, for each ti�orker paid Icss than the prevailina wage rate, ifthe Labor Commissioner deter-
mines that the violation was ti�illful, as detined in subdivision (c) of Sec[ion 1777.1. '
(C) When the amount due under this section is collected from the contractor or subcontrac-
tor, any outstanding wage claim under Chapter I (commencing with Section 1720) of Part 7 of D i-
vision 2 against that contractor or subcontractor shall be satistied before applying that amount to the
penalty imposed on that contractor or subcontractor pursuanl to this section.
(D) The detennination of the Labor Commissioncr as to the amoun[of the penalty shall be �I
revicwable only �or abuse of discrction. �
(E) The dif(erence between the prevailing wage rates and the amount paid to each worker ti�r
each calendar day or portion thereoffor which each worker was paid Iess than the prevailing wage
ratc shall be paid to each worker by the contractor or subconR�actor. and the body awarding the con-
tract shall cause to be inseited in the contract a stipulation that this section will be complied with.
(b) If a worker employed by a subcontractor on a public works project is not paid the general I
prevailing rate of per diem �vages by the subcontractor. die prime contractor of the project is not
liable lor any penalties under subdivision (a) unless the prime contrac[or had knowledge of[hat
failw�e uf the subcon[ractor to pay the specified prevailing rate of wages to those workers or unless
the prime contracta� fails to comply with all of the following requirements:
(1) The conL'act execu[ed bet��een the contractor and the subcontractor for the performance of
work on the public works pr�jcct shall include a copy of the provisions of Sec[ions 1 771. 1775, i
1776. 1777.5, 1813, and 1815.
(2) The contractor shall monitor the paymcnt of the specified general prevailin� ratc of per d i-
em wages by the subcontractor to the employees, by periodic review of the ceitified payroll records �
of the subcontractor. �
(3) Upon bccoming aware of the failure of the subcontractor to pay his or her workers the �
specitied prevailing rate of wages, the contractor shall diligently take corrective action to halt or I
rectify the failure, including, but no[ limited to, retainin� sufficient funds due the subcontractor for
work performed on the public works project. ,
(4) Prior to making final payment to the subcontractor for N�ork performed on the public works �
pr�jec[, [he contractor shall obtain an affidavit si��ned under penalty of perjury from Ihe subcon-
tractor that the subcon[ractor has paid the speci�ied general prevailing rate of per diem wages to his �
or her employees on the puhlic works project and any amounts due pursuant to Section 1813.
(c) �I�he Division of Labor Standards Enforcement shall notify the contractor on a public works �
project within I S days of the receipt by thc Division of Labor Standards Enforcement of a conr
plaint of the failw�e of a subcontractor on that public works project to pay workers the general prc-
vailing rate of per diem wages.

§ 1776. Puyroll record of wages paid; Inspection; Forms; Effect of noncompliance; Penaltics
(a) Each contractor and subcontracCOr shall keep accurate payroll records, showina the name,
address, social security number, work classification. straigh[ time and overtime hours worked cach
day and ��-cck, and the ac[ual per diem wages paid lo each journeyman, apprentice, workcr. or other
employee cmployed by him on c�r in connection with the public work. Each payroll record shall
contain or be verified by a written declaration that it is made under penalt�� of perjury. stating both
of die followin=:
(1) Thc infonnation contained in the payroll record is true and correct.
(2) "Che employer has complied with the requirements of Sections U71. I 81 I. and 181� for any
work perti�rmed by his or her employees on [he public works project.
(b) "I�he payroll records enumerated under subdivision (a) shall be certified and shall be availa-
ble Cor inspection at all reasonable hours at the principal office of the contractor on the followine
basis:
(1) A ccrtitied copy of an employee's payroll record shall be mlde available for inspection or
furnished to the employee or his or her authorized representative on request.
(2) A certified copy of all p�yroll records enumerated in subdivision (a) shall be madc available
for inspection or furnished upon request to a representative of the body awarding the contract, the
Division of Labor Standards Gnforcement, and the Division of Apprenticeship Standards uf the De-
partment of Industrial Relations.
(3) A certitied copy of all payroll records enumerated in subdivision (a) shall be made available
upon request by the public for inspection or for copies thereof. However, a request by [he public

shall be made through either the hody awarding the contract, the Division of Apprenticeship Stand-
ards, or the Division of Labor Standards Enforcemcnt. If the requested payroll reca�ds have not
been provided pursuant to paragraph (2), the requcsting paiTy shall, prior to being provided the rec-
ords, reimburse the costs of preparation by the conu'actor, subcontractors and the cntit�� through
which the request was made. Thc public may not be given access to the records at the principal of-
fice of the contractor. ��
(c) l�he certified payroll records shall be on forms provided by the Division of�Labor Standards
F.nforcement a�shall contain the same inti�rmation as the forms provided b} the division. The pay-
roll records may consist of printouts of payroll data that are maintained as computer records, if the
printouts contain the same information as the lorms provided by the division and the F�rin[outs nrc
veritied in the mant�er specified in subdivision (a).
(d) A contractor or subcontractor shall t71e a certified copy of the records enumeratcd in subd i-
vision (a) with the entity that rcquested thc records within 10 days after receipt of a written request.
(e) Any copy of records made available for insprction as copies and furnished upon request to
the public or any public agency by the a��arding bod}'. the Division of Apprenticeship Standards, or
the Division of Labor S[andards Enforcement shall be marked or obliteratcd to prevent disclosure of
an individuaPs name. address. and social security number. The name and address of the contractor
awarded the contract or the subcontracror performing the contract shall not be marked or obliterat-
ed. Any copy of records madc available for inspection by. or fin•nished to, a joint labor-manabement
committee established pursuant to [he federal Labor Management Cooperation Act ol 1978 (29
U.S.C. Sec. l7Ja) shall be marked or obliterated only to prevent disclosure of an individual's name
and social securiry number. A.joint labor mananement committee may main[ain an action in a court
of competent jurisdiction against an employer who fails [o comply with Section 1774. The court
may award restitution to an employee for unpaid wases and may award [hejoin[ labor management
committee reasonable attornev's fees and costs incurred in maintainins the action. An action under
this subdivision may not be based on the employer's misclassification of the craft of a worker on its
cer[ified payroll records. Nothing in this subdivision limits any other available remedies for a viola-
tion ofthis chapter.
(� 'I�he contractor shall ii�form the body awarding the conU�act of the location of thc records
enumerated under subdivision (a), including the street address, city, and county. and shall, within
five working days. provide a notice of a change of location and address.
(g) Thc contractor or subcontractor has 10 days in which to comply subsequent to receipt oF a
written notice requesting the records enumerated in subdivision (a). In the event that the conh�actor
or subcontractor fails to comply within thc 10-day period, he or she shalL ns a penalty to the state ur
political subdivision on whose behalf the contract is made or awarded, forfeit tti�enty-five dollars
($25) Cor c�ch calendar day, or portion thereof, for cach worker, imtil strict compliance is effectu-
ated. Upon the request of the Division of Apprenticeship Standards or thc Division of Labor Stand-
ards Lnforcement. these penalties shall be withhcld from progress payments then due. A contractor
is not subject to a penalty assessment pursuant to this section due to the failure of a subcontracror to
cumply with this section.
(h) The body ati�ardina the contract shall cause to be inserted in the contract stipulations to ef- �
fectuate this section.

§ 1777.5. Employment of apprentices on public works
(a) Nothing in this chapter shall prevent [he employment of properly registered apprentices upon
puhlic works.
(b) Ever� apprentice employed upon public works shall be paid the prevailing rate of per diem
wages for apprentices in the trade to which he or she is reeis[ered and shall be employed onl� at the
work of the craft or trade to which he or she is registered.
(c) Only apprentices, as defined in Section 3077, who are in training under apprenticeship
standards that havc been approved by the Chief of thc Division of Apprenticeship Standards and
who are parties to written apprentice agreements under Chapter 4 (commencing with Section 3070)
of Division 3 are clieible to be employed at die apprentice wage rate on public works. The em-
ployment and traininv of each apprentice shall be in accordance with either of the followin�:
(1) Tl�e apprenticeship standards and apprentice agreements under wl�ich he or she is training.
(2) The rulcs and regulations ofthe California Apprenticeship Council.

(d) When the contractor to N�hom [he contract is awarded by the state or an}� political subdivi- ��I
sion, in perf�rming any of the work under the contract, employs workers in any apprenticeable craft
or trade, the contractor sl�all employ apprcntices in at Icast d�e ratio set forth in this section and may
apply to any apprenticeship program in the craft or trade that can provide apprentices to the site oi�
the public work for a ce�rtificate approvin� the contractor under the apprenticeship standards for thc
employment and training of apprentices in thc area or industry affected. However, the decision of
i the apprenticeship program to approve or dem� 1 ceititicate shall be subject to rcview by Uie Ad-
ministrator of Apprenticeship. The apprenticeship program or proerams, upon approving [he con-
tractor, shall arrange for the dispatch of appmntices to the contractor. A contractor covered by an
apprenticeship program's standards shall not be requircd [o submit any additional applica[ion in or- I
der to include additional public �aorks contracts under that program. "Apprenticeable craft or trade."
as used in this section, means a craft or trade determined as an apprenticeable occupation in ac-
cordance with rules and regulations prescribed by the California Apprenticeship Council. As used in
� this sec[ion, "contractor" includes any subcontr�ctor under a contraclor who performs any public
works not excluded by subdivision (o). �
(e) Prior to commencing work on a contract for public works, every conn�actor shall submit con-
tract award information to an applicable apprenticeship program that can supply appren[ices [o die
site of the public work. The infonnation submitted shall include an estimate of journeyman huurs to
be perfonned under the contract. the number of apprentic�s proposed to be employed. and the ap-
proximate dates the apprentices would be employed. A copy ot this information shall also be sub-
mitted to the awarding body ifrequested by die awarding body. Widiin 60 days after concluding
work on the contract. cadi contractor and subcontractor shall submit to the awardin� body, if re-
quested. and to the apprenticeship program a verified statement of the journeyman and apprentice
hours performed on the cuntract. "I�he information undcr this subdivision shall be public. The ap-
prenticeship programs shall retain this information for 12 months.
(� The apprenticeship pro�ram that can supply apprentices to the area of the site of thc public
work shall ensure equal employment and affirmative action in apprenticeship for women and m i-
norities.
(g) The ratio of work performed by apprentices to journcyme�� employed in a particular craft or
trade on die public work may be no higher than the ratio stipulated in the apprenticeship standards
under ti�hich the apprenticeship program operates where the contractor agrees to be bound by those
standards, but, except as otherH�ise provided in this section. in no case shall the ratio be less than
one how�of apprentice work for every five hours ofjourneyman work.
(h) This rltio of apprenlice work to journeyman work shall apply durina any day or portion of a
day when any journeyman is employed at the jobsite and shall be computed on the basis of the
hours workcd during the day byjourneymen so employed. Any work pe�fiormcd by ajourneyman in
excess of eight hours per day or 40 hours per week shall not be used to calculate die ratio. The con-
tractor shall employ apprentices lor the number of hours computed as above bc�i�re the end of the
con[rac[ or, in the case of a subcontractor. before the end of the subcon[rac[. I Io��z�er, thc contrac-
tor shall endeavor, to the greates[ ertent possible, to employ apprentices durin�, [he same [ime peri-
od that [he journeymen in the same craft or trade are employed at the jobsite. Where an hourh� ap-
prenticeship ra[io is not feasiblc for a particular cratt or trade, the Chicf of the Division of Appren-
i ticeship Standards, upon application of an apprentieeship program, may order a minimum ratio of
not less than one apprentice for each tive.journeymen in a craft or trade classif ication.

(i) A contractor covered by this section that has agreed to be covered by an apprenticeship pro- �
gram's standards upon the issuance of the approval certificate, or that has been previously approved
tbr an apprenticeship program in the cratt or trade, shall employ the number of apprentices or the
ratio of apprcntices to journeymen stipula[ed in the applicable apprenticeship standards, but in no
event Icss than the I-to-5 ratio required by subdivision (a).
(j) Upon proper showing by a contractor Ihat he or she employs apprentices in a par[icular craft
or trade in the statc on all of his or her contracts on an annual a�eraee of not less than one hour of
apprentice work for every five hours of labor performed byjourneymen, the Chiefofthe Division
of Apprenticeship Standards may �rant a certiflcate exempting the contractor from the I -to-> hourly
ratio, as sct forth in this section for that craft or trade.
(k) nn apprenticeship program has thc discretion to grant to a participating contractor or con-
tractor association a certit7cate, �hich shall be subject to the approval of[he Administrator of Ap-
prenticeship, exempting the contractor from the I-to-� ratio set foRh in this section when it finds
that any one of the following conditions is met:
(1) Unemployment for the previous three-month period in [he area eaceeds an average of I�
percent.
(2) The number of apprentices in training in the area exceeds a ratio of I to 5.
(3) l�here is a showing that the apprcnticeable cra�t or trade is replacing at least onc-thir[ieth of
its journeymen annually through apprcnticeship tcaining, cither on a statew�ide basis or on a local
basis.
(4) Aysignmcnt of an apprenlice to any N�ork perfonned under a public works contr�ct w�ould
crcate a condition [hat would jeopardize his or her life or the life, safety, or property of tellow em-
ployces or the public at large, or [hc speci(ic task to tihich the apprentice is to be assigned is of a
nature that trainin�, cannot be provided by a journeyman.
(1) When an exemption is granted pursuant to subdivision (k) to an organization that represents
conu•actors in a speci(ic trade from thc I-ro-5 ratio on a local or statcwide basis. [he membcr con-
tr�ctors shall not be required to submit individual applications for approval to local joint appren-
ticcship committces, ifthey are alre�dy covered by the local apprenticeship standards.
(m)
(1) A contractor to whom a contract is awarded, who, in performing any of the work under the
contr�ct, employs journeymen or apprentices in an} apprenticeable craft or trade shall contribute to
the California Apprenticeship Council the same amoimt that the director determines is the prevail-
ing amount of apprenticeship training contributions in the area of the public works site. A contractor
may take as a crcdit for payments to the council any amounts paid by the contractor to an approved
apprenticcship program that can supply apprentices to the site of thc public works projecL The con-
tractor may add the amount of the contributions in computin� his or her bid for the contract.
� (2) At the conclusion of the 2002-03 tiscal year and each fiscal year thereafter, the California
Apprenticeship Council shall distribute training contribu[ions received by Ihe council undcr this
subdivision, less the expenses of the Di��ision of Apprenticeship Standards for administering this
subdivision, by making grants to approved apprenticeship programs for[he purpose of trainin, ap-
prentices. The funds sl�all be distributed as follows:

(A) If there is an approved multiemployer apprcnticeship program seivin� the same craft or ��
trade and �eographic area for which the training contributions werc made to the coimcil, a grant to
that program shal I be made.
(B) If there are [wo or more approved multiemployer apprenticeship prograins serving the
same crafl or trade and neographic arca for which the training contributions were made to the coun-
cil, thc orant shall be divided amona those programs based on the numhcr of apprentices registered '
in each program.
(C) All training contributions not distributed undcr subparagraphs (A) and (B) shall be used �
to defray the future expenses of the Division of Apprenticeship S[andards.
(3) All training contributions received pursuant to this subdivision shall be deposited in the
Apprenticeship"I'raining Contribution Pund, which is hercby created in the Sta[e 7�reasury. Not-
withstanding Section 133-/0 oJ'the Gorernment Cocle. all money in the Apprenticeship �1'raining �
Conh�ibution Fund is hereby continuously appropriated for the purpose of carrying out this subdi��i-
sion and [o pay the expenses of the Division of Apprenticeship Standards.
(n) "I�he body awarding the contract shall cause to bc inserted in the contract stipulations to e�= ��
fectuate this section. Thc stipulations shall �ix the responsibility of compliance w'ith this section for �i
all apprenticeable occupations with thc prime contractor. �
(o) "fhis section does not apply to eontracts of general contractors or to contracts of specialty
contractors not bidding for work through a general or prime contractor when the contracts of gen- I
eral conu�actors or those specialty contractors involve less than thirty thousand dollars ($30,000). ��
(p) All dccisions of�n apprenticeship program undcr this section ace suhject to Section 3081. I

§ 1815. Work performed in excess of specified hour limitations; Compensation
Notwithstanding the provisions of Sections 1810 to 1814, inclusive, of[his code, and notwith-
standing any stipulation inserted in any contract pursuant to the requirements of said sections, work
perfonned by cmployees of contractors in excess of 8 hours per day, and 40 hours during any one
week. shall he permitted upon public work upon compensation for all hours worked in excess of 8
hours per day at no[ less than I 1/2 times the basic ratc of pay.
