HomeMy WebLinkAboutCC Reso 2013-26 - Approve Transactions to Purchase and Sell Renewable Energy Credits I � � RESOLUTION NO. 2013-26 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH AUTHORIZING CITY MANAGER/ELECTRIC UTILITY DIRECTOR TO APPROVE VARIOUS TRANSACTIONS TO ' PURCHASE AND SELL ENERGY AND TRADABLE RENEWABLE ENERGY CREDITS WHEREAS: 1. The City Council adopted Resolution No. 2005-15 which approved and authorized the City Manager to sign a Master Confirmation Agreement (Western Systems Power Pool Agreement), two modifications to the MCA which the Northern California Power Agency ("NCPA") recommended using whenever possible, because they better protect the City in i the event a seller files for bankruptcy, and a Single Member Services Agreement with i NCPA; and 2. The price for electrical energy and capacity continues to fluctuate significantly; and 3. The City Council determines that it continues to be in the best interest of the City and its residents to authorize the City Manager and the Director of the Electric Utility to approve electrical purchase and sale transactions pursuant to the agreements approved in Resolution No. 2005-15, or any revisions thereof that the City Manager/Electric Utility Director, in consultation with the City Attorney, determines are not less protective of the City's interests than the form of these agreements approved in Resolution No. 2005-15, and to take any other actions and sign other documents which shall become binding on the City, as necessary, to purchase additional electricity or sell electricity; and 4. On April 7, 2010, the City Council approved Resolution No. 2010-16, authorizing the City Manager or her designee to take various actions and execute various documents on behalf of the City to trade unbundled Tradable Renewable Energy Credits ("TRECs"), separately selling the environmental attributes of TRECs from the energy associated with the TRECs, pursuant to the California Renewable Portfolio standard ("RPS") program and decisions of the California Public Utilities Commission; and 5. It has become advantageous for the City to sell bundled, as well as, unbundled TRECs; NOW, THEREFORE, BE IT RESOLVED as follows: I 1. Until further action by the City Council, the City Manager and the Director of the Electric Utility are authorized to approve the purchase or sale of electricity by NCPA on the City's behalf using the already approved Master Confirmation Agreements and modifications with counter-parties, or to use a revised version of the Master Confirmation Agreement approved by NCPA, when, in the judgment of the City Manager and the Director of the Electric Utility, upon consultation with the City Attorney, the revised agreement is no less protective of the City's interests that the approved version. ' 2. The City Manager and the Director of the Electric Utility are authorized to take such further action and sign such additional documents as may be necessary to consummate the purchase or sale of electricity as provided herein and such actions shall be binding on the , City without further action by the City Council. 1 -- - - 3. The City Manager or her designee is authorized to sell both bundled and unbundled TRECs pursuant to Resolution No. 2010-16. 4. The City Manager and Director of the Electric Utility shall continue to make periodic reports to the City Council as required by Resolution Numbers 2005-15 and 2010-16.
