RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH WAIVING
THE 60-DAY NOTIFICATION REQUIREMENT FOR ESTABLISHING A
COUNTY FACILITY WITHIN THE CITY LIMITS, AS REQUIRED BY
IGOVERNMENT CODE §25351
WHEREAS,
1. Government Code §25351 requires that a County notify a City in
advance of its intent to locate a County facility in the incorporated area; and
2. Government Code §25351 further requires that said advance
notification occur at least 60 days prior to use and occupancy of the County
facility, unless the City Council waives the notification requirement by Resolution;
and
3. The General Services Department of Mendocino County has
requested a waiver of the 60-day notification requirement to lease property at
175 S. School Street, Ukiah for the purpose of use by American Red Cross of
Sonoma, Mendocino, and Lake Counties for the use of office space for first aid
and disaster volunteer training.
4. The granting of the waiver will enable American Red Cross of
Sonoma, Mendocino, and Lake Counties to lease the property starting on August
15, 2013, thereby avoiding loss of the property to another prospective tenant.
NOW, THEREFORE, BE IT RESOLVED that the City of Ukiah grants the County
of Mendocino a waiver of the 60-day notification requirement so as to lease the
property at 175 S. School Street, Ukiah, in a timely manner.
