RESOLUTION OF THE CITY COUNCIL OF THE CiTY OF UKIAH APPROVING A
MITIGATED NEGATIVE DECLARATION FOR THE RECYCLED WATER MASTER PLAN
PROJECT AND PREFERRED ALTERNATIVE
1. WHEREAS, The City of Ukiah as Lead Agency, has prepared an Initial Environmental
Study and a Mitigated Negative Declaration, dated March, 2013 for the City of Ukiah
Recycled Water Master Plan Project and the Preferred Alternative contained in Chapter
7 therein (attached as Exhibit A); and
2. WHEREAS, The Initial Environmental Study and Mitigated Negative Declaration found
that the proposed Recycled Water Master Plan project and Preferred Alternative would
not have significant adverse impacts on the environment that could not be eliminated or
reduced to levels of insignificance with the adoption of mitigate measures; and
3. WHEREAS, The Initial Environmental Study and Mitigated Negative Declaration were
submitted to the California State Clearinghouse for distribution to State agencies for
review and comment, and made available to the general public and local agencies for
review and comment; and
4. WHEREAS, The City Council conducted a public hearing on May 15, 2013 to provide an
opportunity for the public and all interested persons to verbally comment on the
adequacy of the recommended Initial Environmental Study and Mitigated Negative
Declaration; and
5. WHEREAS, Written responses to all comments were prepared and distributed to all
those who commented on the recommended Initial Environmental Study and Mitigated
Negative Declaration document on May 23, 2013; and
6. WHEREAS, CEQA Guidelines Section 15074 provides that the City shall not approve or
carry out a project for which a Mitigated Negative Declaration has been prepared which
identifies one or more significant environmental impacts, unless it makes specified
findings.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Ukiah hereby
resolve, determine, find, and order as follows:
1. Bases on the whole of the record, including the Initial Environmental Study, Mitigated
Negative Declaration, and all comments received, there is no substantial evidence that
the project will have a significant adverse effect on the environment and that the
Mitigated Negative Declaration reflects the City of Ukiah's independent judgment and
analysis; and
2. Based upon the analysis, findings and conclusions contained in the Initial
Environmental Study, the project, as mitigated, does not have the potential to degrade
the quality of the local or regional environment; and
3. Based upon the analysis, findings and conclusions contained in the Initial
Environmental Study, the project, as mitigated, will not result in short-term impacts that
will create a disadvantage to long-term environmental goals; and
4. Based upon the analysis, findings and conclusions contained in the Initial
Environmental Study, the project, as mitigated, will not result in impacts that are
individually Iimited, but cumulatively considerable; and
5. Based upon the analysis, findings and conclusions contained in the Initial
Environmental Study, the project, as mitigated, will not result in environmental impacts
that will cause substantial adverse effects on human beings, either directly or
indirectly; and
6. Based on the conclusions reached in the Initial Environmental Study, it has been
determined that the proposed Recycled Water Master Plan and Preferred
Alternative would not have significant adverse impacts on the environment because
feasible and reasonable mitigation measures have been adopted and/or
incorporated into the project; and
7. Mitigation measures have been prepared and are hereby required for the following
potential impacts: Air Quality, Biological Resources, Cultural Resources, Geology
and Soils, Hazards and Hazardous Materials, Hydrology and Water Quality, Noise,
and Traffic and Circulation; and
8. A Mitigation Monitoring and Reporting Program has been prepared, dated May,
2013, and is contained in the Final Initial Environmental Study and Mitigated
Negative Declaration (attached as Exhibit A).
