HomeMy WebLinkAboutWinzler & Kelly 2010-03-09; Amendment 4 2011-11-08CITY OF UKIAH AMENDMENT NO. 4 TO AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES DATED MARCH 9, 2010 TERMS AND CONDITIONS All terms and conditions of the Agreement for Professional Consulting Services dated March 9, 2010, the first amendment dated April 8, 2010, the second amendment dated August 5, 2010, and the third amendment dated March 23, 2011 shall remain in force and effect except as modified by this fourth amendment. AUTHORIZATION Upon execution of this amendment, service provider is authorized to provide the service described under the Scope of Additional Work identified in this Amendment No. 4. SCOPE OF ADDITIONAL WORK Work authorized by this amendment shall include that work described in the November 8, 2011 letter from Winzler & Kelly. A copy of said letter is included in this fourth amendment as Attachment "A". COMPENSATION Compensation for the performance of the additional work shall be made on a time and expense basis at Consultant's customary fees, not to exceed $47,478. This fourth amendment will not result in an increase in the total compensation per the original contract and prior approved amendments. Funds for this fourth amendment are hereby reallocated from previously approved project tasks budgets. i WINZLER KELLY CITY OF UKIAH BY: BY- J9ne( Chambers gitiManager f~ ~r ly DAT DATE Amendment No. 4 to Agreement for Professional Consulting Services Winzler & Kelly ATTACHMENT "A" WINZLER4&,KELLY November 8, 2011 Mr. Alan Hasty City of Ukiah Department of Public Works 300 Seminary Ave. Ukiah, CA 95482 Ref: Project No. 02502-10001 Re: Fee Proposal for Requested Supplemental Services, Redwood Business Park Transportation Improvements Project, City of Ukiah Dear Mr. Hasty: Enclosed please find our proposal to develop a preliminary design and preliminary opinion of probable construction cost for the roundabout option at the Talmage Interchange, prepare a technical memorandum comparing the signal and roundabout options, and continue coordinating with resource agencies on permits associated with the Airport Park Boulevard culvert extensions and road widening. This scope of work, fees and assumptions for the supplemental tasks is described below for your consideration and approval. Once approved, it is our understanding that the supplemental tasks will be appended as a "no- cost" amendment to the original contract of work with the City for this project. The summary of the proposed Supplemental Services (project scoping) and fee follow. Scone of Work Task 1 Process and Obtain Orthorectified Aerial Survey $12,602 Task 2 Develop Preliminary Roundabout Design $11,264 Task 3 Roundabout Preliminary Opinion of Probable Cost $6,188 Task 4 Prepare Technical Memorandum $9,040 Task 5 Resource Agency Permitting & Coordination $8,384 Total $47,478 Task 1- Obtain Orthorectified Aerial Mapping. The orthorectified aerial photos for the aerial topographic surveyed areas for the interchange project were flown earlier this year. This series of images and associated topographic data will be incorporated into the topographic mapping used for preliminary and final design. The extent of the aerial is from the start of the southbound off ramp (north end) to the end of the southbound on ramp (south end), and from the edge of the existing aerial (west end, near the Talmage Road southbound on ramp) to the center median of US 101 (east end). In this task our surveying subconsultant (Rau & Associates) will process previously flown aerial photos and develop the photogrammetry, topographic mapping, and aerial photos for use in developing the preliminary design. Similar to the preliminary design developed for the signalized intersection alternative, Winzler & Kelly will develop a preliminary design for the roundabout alternative (Option A - Roundabout) identified in the Wal-Mart Draft EIR. The purpose of this preliminary design is to develop a preliminary opinion of probable construction cost that can be used as a tool to evaluate the alternative's feasibility as a project. The design will be developed in sufficient detail to estimate construction quantities as well as anticipated additional costs associated with hazardous materials abatement, land acquisition, right-of-way and easements. Task 3 - Roundabout Preliminary Opinion of Probable Cost. Winzler & Kelly will develop a preliminary opinion of probable construction cost for the roundabout alternative (Option A - Roundabout) identified in the Wal-Mart Draft EIR. The format and content of the opinion of probable construction cost will be the same as that developed and submitted to the City with the Caltrans Encroachment Permit application for the signal alternative (Option A - Signal). The estimate will identify costs associated with demolition, earthwork, pavement, drainage, traffic, structures, right-of- way and property acquisition, studies, and associated project costs. Task 4 - Prepare Technical Memorandum. Winzler & Kelly will prepare a technical memorandum that summarizes each of the Talmage Interchange intersection alternatives (Option A - Signal and Option A - Roundabout), opinions of probable construction cost, and pros/cons. The purpose of the tech memo is to present and discuss the two alternatives in sufficient detail and to provide qualitative and quantitative information that will assist the City Council in a decision regarding which of the interchange alternatives to pursue as a capital improvement project. The tech memo will be provided to the City as a draft for review. We will meet with the City in Ukiah to discuss comments on and the results summarized in the tech memo. Following the meeting we will finalize the tech memo for presentation to the City Council. Task 5 - Resource Agency Permitting & Coordination. Winzler & Kelly will continue to coordinate the permit application review process with the Corps, CDFG, and the Regional Board. To date, questions and requests for information have been received from the Corps and Regional Board. The June 18, 2010 amendment acknowledged that responding to agencies' questions and requests for information during the review process could exceed the effort estimated in that amendment. That situation has occurred. Given the nature of this project and the quality of the resource in question, 26 hours were allotted for this task in our June, 2010, amendment. The permit applications were not submitted until September/October, 2011, over which time expectations to propose and enforce more stringent - but existing - mitigation techniques have increased within each agency than was the case in 2010 (e.g., posting signage, application of development restrictions, etc.). This has proven to be the case since the time the project site visits were conducted in October, 2010, and March, 2011. The actual level of effort has, therefore, increased over that originally estimated. Much of this has occurred outside the City's and W&K's control. This amended scope assumes that W&K will respond only to those questions and requests for information WINZLER67-KELLY Mr. Alan Hasty November 8, 2011 Page 3 pertaining specifically to the project design, project construction, mitigation implementation, and our original work products. This amended scope does not include response to questions and requests for information of administrative nature (e.g., providing CEQA documentation, asserting development restrictions, payment of additional requested fees, etc.). No further agency meetings are included in this amendment. It is anticipated the response to these additional questions and requests for information will be facilitated via e-mail and telephone communications to provide a timely and efficient response. Based on the review experience to date, and understanding that the successful completion of this task relies on a number of outside factors, we have estimated an additional 40 hours of Senior Planner effort and 20 hours of Project Engineer effort. Deliverables: Draft and Final Technical Memorandum with figures and attachments: 0 5 hard copies and 1 electronic PDF copy on CD We propose to complete the above scope of work for the time-and-materials fee not to exceed $47,478 without prior written authorization from the City.
