RECITALS 1. ESA and City previously entered into an Agreement for professional services. 2. The parties now wish to enter into an Amendment to said Agreement under which ESA will perform additional services for Client. TERMS AND CONDITIONS Scope of Work The additional Scope of Work covered by this Amendment is shown in Attachment A, which is attached to this document and made a part of this Amendment. 2. Price Payment to ESA under this Amendment shall not exceed $ 13,070. Please see Table 1 of Attachment A for a detailed cost breakdown. Total new Contract Amount is $ 458,298. Effect of Amendment Except as amended herein, the parties' Original Agreement shall remain in full force and effect. ESA will prepare a memorandum to provide the Planning Commission with a response to the substantive environmental comments contained in the materials submitted by William Kopper. Each such comment and response will be numbered. In addition, an assessment of the materials provided by Mr. Scalmanini and their relationship to the urban decay analysis will be provided. Tasks: o ESA will respond to all comments not identified below. Specific items include: o Eestimate transportation fuel usage related to project operation (based on the VMT assumptions used for GHG analysis). o ESA will clarify "treated" domestic water supply (comment 41). An estimate of pre- and post- project landscaping water usage by applicant would be very helpful in this effort. o Preliminary calculation of additional storm drain run-off amount and required on-site retention capacity o Note that an existing photometric plan is not available for responding to comments 19 - 21. ESA will work with the applicant to identify available data. o ESA will require the following information from the applicant and staff in order to adequately respond: o Applicant (landscape architect) to respond to planter/tree suitability issue (page 2, para 1). o Applicant to provide food product and typical grocery square footage, if known o Staff to provide information on implementing policies and past Commission interpretations of general plan consistency re: policies CD-17.1, OC-28.1, EG-5.1. OC-29, OC-25.1, GP-25.2, GP- 26. o Memo will incorporate staff report information on prior conditions of approval (specifically transportation improvements including bikeways and parking lot trees). o ESA will engage its subconsultants to address the tasks below (note that if subconsultants have not exhausted their FEIR budgets, it will be redirected to this purpose, but a budget augmentation may be necessary). o RTMM to review completed document and will take the lead on the following issues: ■ CEQA Baseline and prior conditions of approval (including tree planting, transportation improvements and carpooling requirements). ■ "Requirement" to identify energy usage itself as a significant impact. ■ Pavley reduction (comment 45) (note that MCAQMD staff stated at the hearing that they were satisfied with GHG and AQ analysis). ■ Level of detail needed for mitigation measure 4.10-2 and 4 (and inappropriateness of delaying project approval until preliminary design complete). o W-Trans will take lead on addressing the following comments: ■ 5. Use of Costco counts (review of Kittleson data, if available). ■ 9. Infeasibility of MM 4.10-2 ■ 36. Planned bicycle improvements on Airport Park Blvd. ■ 46. Baseline-ESA to assist 0 0 ■ 48. Impact of queue length ■ 49. Queue length (see 48) ■ 50. Explanation of the modeling method ■ 51. follow-up to comment 50 ■ 52. Vacancies and real estate demand ■ Review of two reports submitted by Scalmanini ESA also assumes that prior to potential project approval, that an engineer's estimate will be available for Talmage/101 improvements. This will provide additional support to the FEIR's conclusions regarding traffic impact mitigation at this interchange.
