ROLL CALL Ukiah City Council met at a Special Joint Meeting of the Ukiah City Council and the Ukiah Valley Sanitation District on September 29, 2010, the notice for which having been legally noticed on September 24, 2010. Mayor Thomas called the meeting to order at 6:00 pm. Roll was taken with the following Councilmembers present: Landis, Crane, Baldwin (arriving at 6:08 pm), and Mayor Thomas. Councilmembers absent: Rodin. City Staff present: City Manager Chambers, Director of Finance Elton, Director of Public Works/City Engineer Eriksen, City Attorney Rapport, and City Clerk Currie. Sanitation District Board present: Directors Ronco, Porter, McNerlin, and Vice-Chair Pallesen. Sanitation District Board absent: Chair Paulin. UVSD Staff present: UVSD District Manager/Clerk Kennedy, County Council Walker, and Board Secretary Clark. 2. DISCUSSION CONCERNING THE NOTICING OF DELINQUENT SEWER SERVICE CHARGES AND THE DISTRICT'S OPTION TO USE THE TAX ROLL FOR THE COLLECTION OF SEWER SERVICE CHARGES AND POSSIBLE DIRECTION TO STAFF District Manager Kennedy presented the item. UVSD Recommended Action(s): Discuss the issue and provide direction to staff. Public Comment Opened 6:34 pm. Public Speaking in support of earlier notification of account delinquency. Will Barker, Ukiah area resident and Don Finch, rental property owner. Public Comment Closed 6:37 pm City Council by consensus directed staff to work with UVSD staff on a short and long term resolution of the process of UVSD notification of delinquent sewer accounts in the district. 3. DISCUSSION CONCERNING THE USE OF A THREE MONTH AVERAGE OF WINTER WATER USE IN LIEU OF THE JANUARY WATER USE FOR CALCULATING THE CONSUMPTION COMPONENT OF THE SEWER BILL AND POSSIBLE DIRECTION TO STAFF District Manager Kennedy presented the item. UVSD Recommend Action(s): Direct the District Manager to submit for introduction a proposed ordinance modifying Section 8.12.D(2) of District Ordinances 12 and 25. It is recommended that the City Council provide a similar direction to City Staff. CC Page 2 of 2 Public Comment Opened 6:47 pm. Public Speaking to the item: Jenny Barker and JR Rose. Public Comment Closed 6:52 City Council by consensus directed staff to work with UVSD staff to explore changing from the current one month to a three month winter water usage consumption to calculate sewer rates and bring back to City Council. 4. DISCUSSION AND POSSIBLE ACTION TO ENGAGE DAVID W. SMITH SERVICES TO ASSIST DISTRICT BOARD AND CITY COUNCIL, AS WELL AS DISTRICT STAFF AND CITY STAFF, IN IMPROVED GOVERNANCE FUNCTIONS FOR WASTEWATER UTILITY. City Manager Chambers presented the item. Recommended Action(s): Direct the City Manager to work with the Ad/Hoc committees of the UVSD and City of Ukiah to finalize the scope of services and 2) The City Council authorize the City Manager to sign a contract engaging the services of David W. Smith for an amount not to exceed the FY 2010/2011 appropriation of $50,000. Public Comment: None. UVSD M/S Porter/Ronco to engage the services of the facilitator on a month to month basis that either body can cancel. Motion carried by the following roll call vote: AYES: Directors Ronco, McNerlin, Porter, and Vice Chair Pallesen. NOES: None. ABSENT: Chair Paulin. ABSTAIN: None. M/S Baldwin/Crane to Approve authorization the City Manager to sign a contract engaging the services of David W. Smith for an amount not to exceed the FY 2010/2011 appropriation of $50,000. Amended with the acknowledgement of the motion and discussion of the UVSD Board regarding the at-will aspect of the contract. Motion carried by the following roll call vote: AYES Councilmembers Landis, Crane, Baldwin, and Mayor Thomas. NOES: None. ABSENT: Councilmember Rodin. ABSTAIN: None. 5. DISCUSSION OF NEEDED AMENDMENTS TO THE PARTICIPATION AGREEMENT AND POSSIBLE FORMATION OF AND DIRECTION TO AD HOC COMMITTEES AND STAFF Due to the outcome of item 4, this item was not heard. PUBLIC COMMENT JR Rose, senior advocate, spoke to sewer rate concerns for the single occupant residence. 7. ADJOURNMENT There being no further business, the meeting adjourned at 8:02 pm. a ne M.
