HomeMy WebLinkAboutRau & Associates, Inc. 2010-08-16; Amendment 1 2010-09-30CITY OF UKIAH AMENDMENT NO. 1 TO AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES DATED AUGUST 16, 2010 TERMS AND CONDITIONS All terms and conditions of the Agreement for Professional Consulting Services dated August 16, 2010 shall remain in force and effect except as modified by this first amendment. AUTHORIZATION Upon execution of this amendment, service provider is authorized to provide the service described under the Scope of Additional Work identified in this Amendment No. 1. SCOPE OF ADDITIONAL WORK Work authorized by this amendment shall include that work described in the September 30, 2010 letter proposal from Rau and Associates, Inc. A copy of said letter is included in this first amendment. COMPENSATION Compensation for the performance of the additional work shall be made on a time and expense basis at Consultant's customary fees. CIVIL ENGINEERS* LAND SURVEYORS September 30, 2010 Mr. Tim Eriksen, City Engineer City of Ukiah, Department of Public Works 300 Seminary Avenue Ukiah, CA 95482 Job Number R09072.2 RE: PLAN OF ACTION FOR SCOUR AT ORRS CREEK BRIDGE ON OAK STREET Dear Mr. Eriksen: Rau and Associates, Inc., also referred to herein as "RAU", will provide the following services for City of Ukiah herein also referred to as "City". Work will include: RAU will perform a Bridge Scour Evaluation Plan of Action for the Oak Street Bridge over Orr's Creek in the City of Ukiah. The evaluation will conform to the requirements of Caltrans. Examples of other evaluations and an explanation of what is required was provided by the City in preparation for performing this work. RAU will incorporate the FEMA mapping information regarding flood water surface levels, subsurface borings upstream at the Brush Street Bridge over Orrs Creek, and the geologic mapping done for the City of Ukiah by the USGS. RAU also has reviewed the bridge plans supplied by the City and has made a site visit to view physical conditions. It is assumed that the concrete apron and cut-off walls at the inlet and outlet of the structure, shown on the plans, were constructed and remain intact. Part of the work to complete the Plan of Action is to do hand excavations to confirm the concrete substructures exists. If they do not exist or there has been damage to them, there will be additional work which is beyond the scope of services described herein. DELIVERABLES: Rau will deliver a completed Bridge Scour Evaluation Plan of Action to the City by October 18, 2010. SCHEDULE OF WORK: RAU realizes that the timely performance of the services provided is an important element of this Agreement. RAU will endeavor to complete the work with due and reasonable diligence consistent with sound professional practice and within the time frame noted below. RAU and the Client agree to cooperate with each other in every way on the project and to solicit the cooperation of other parties who may influence the schedule of the work. The time of completion noted below is an estimate only and RAU is not responsible for circumstances beyond its control. It is also possible that as the project proceeds, sound professional practice may necessitate additional work being done and hence additional time may be needed for completion. RAU will begin the work within 3 days of receipt of this signed Agreement. RAU anticipates that work will be completed within 15 days after commencing work. If additional work is requested or required, which is not covered in the Scope of Work, the Client agrees to meet with representatives of RAU to discuss changes in the scope, schedule, cost or other Terms of Agreement. If modifications to the Agreement are required, RAU will prepare an amendment to the Agreement for Professional Consulting Services for execution by the Client and RAU. NOTE. Hourly rates on the Schedule of Fees are valid for one year from the date of this Agreement.
