HomeMy WebLinkAboutWinzler & Kelly 2010-03-09; Amendment 2 2010-08-05CITY OF UKIAH AMENDMENT NO. 2 TO AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES DATED MARCH 9, 2010 TERMS AND CONDITIONS All terms and conditions of the Agreement for Professional Consulting Services dated March 9, 2010 and the amendment dated April 8, 2010 shall remain in force and effect except as modified by this second amendment. AUTHORIZATION Upon execution of this amendment, service provider is authorized to provide the service described under the Scope of Additional Work identified in this Amendment No. 2. SCOPE OF ADDITIONAL WORK Work authorized by this amendment shall include that work described in the June 18, 2010 letter from Winzler & Kelly. A copy of said letter is included,in this first amendment as Attachment "A". COMPENSATION Compensation for the performance of the additional work shall be made on a time and expense basis at Consultant's customary fees. The scope of work, fees and assumptions for the supplemental tasks are identified below for your consideration and approval. We have revised our proposal reducing our fee for the sewer main replacement design (Task 17) and adding a PG&E coordination task for the PG&E power pole on Hastings Avenue which must be relocated. Our work for the City on the Sanitary Sewer Management Plan (SSMP) project has enabled us to shift common tasks from the sewer analysis effort from the RBP project to the SSMP project, reducing our overall fee for this proposal. Once approved, it is our understanding that the supplemental tasks will be appended to the original contract of work with the City for this project. This fee proposal is based upon our email and telephone correspondence with you and Mr. Rick Seanor, the design forum held on April 14, 2010 and our additional investigations. Winzler & Kelly will obtain the orthorectified aerial photos for the aerial topographic surveyed areas for this project. This series of images will be incorporated into the topographic background used for design and will be included in the design drawings. We will provide the images to the City on CD upon receipt. Task 12 - Airport Rd. Preliminary Design Revisions. In this task, we will revise the preliminary design submitted to the City for Airport Road to eliminate the Class I bicycle path on the east side of Airport Road. The preliminary design will be revised to add sidewalks, curb and gutter along the west side of Airport Road. The preliminary design of Airport Road will also contain two 12-ft wide travel lanes. Assumptions: • The limits of the improvements to Airport Road extend from the Northwest Pacific Railroad tracks on the south to Commerce Drive on the north. • Preliminary design of connectivity between sidewalks on the east side of Hastings Avenue/Commerce Drive and the proposed sidewalks on the west side of Airport Road is not included in this scope item. • No bicycle lanes will be included in the design revisions. Task 13 - Airport Park Blvd. Design Revisions for Stop-Controlled Intersection In this task the roundabout design at the Airport Park Boulevard and Airport Road intersection will be removed from the project and a new stop-controlled intersection will be designed. This design will include an all-way stop-controlled intersection, and preservation and improvement of the existing driveway into the Ukiah Brewing Company parking lot. The intersection will be designed using the previously established design vehicle. Airport Park Boulevard will be designed as a full-width street with curb and gutter on both sides of the street. This revision will extend the current 4-lane plus center median roadway across the drainage channel to the new intersection. Extensions to the existing culverts will be designed including bank protection and energy dissipation. Assumptions: • New stop-controlled intersection will be contained entirely within the existing right-of-way and no additional right-of-way mapping and legal descriptions are required. The original scope of work included right-of-way mapping and legal descriptions for 2 locations. These locations are currently identified as Hastings Avenue at South State Street and Airport Park Boulevard at Talmage Road. Task 14 - Resource Agency Permit Applications Army Corps of Engineers The U.S. Army Corps of Engineers (Army Corps) will require a fill permit (Section 404 permit) because the project will have impacts below the ordinary high water mark of waters of the U.S. The project will qualify for a Nationwide Permit or Non-Reporting Nationwide Permit. Winzler & Kelly will meet with Corps representatives on site to attempt to speed up permit acquisition. We will submit the permit package on behalf of the City. WINZLER67-KELLY Mr. Alan Hasty June 18, 2010 Page 3 California Department of Fish and Game The Fish and Game Code (Section 1602) requires an entity to notify DFG of any proposed activity that may substantially modify a river, stream, or lake. Modification of the drainage channel banks and bed, including impacts to riparian vegetation requires notification and issuance of a Lake and Streambed Alteration Agreement (LSAA). Expansion of the existing box culverts to accommodate the widening of Airport Park Boulevard will require acquisition of a LSAA. We will meet with DFG representatives on site to attempt to speed up permit acquisition. We will submit the application package on behalf of the City, and the City would pay the necessary fees associated with the application. North Coast Regional Water Quality Control Board The North Coast Regional Water Quality Control Board (Regional Board) will require a 401 Water Quality Certification because the project will impact waters of the State. Roadway widening may result in temporary and permanent impacts to the bed, banks, and riparian vegetation near the road. Winzler & Kelly will meet with Regional Board representatives on site to attempt to speed up permit acquisition. We will submit the permit package on behalf of the City. The City will pay the permit application fees. We will attempt to combine all resource agency site meetings into a single meeting, but this is contingent on resource agency staff availability. The budget for this task includes time for meeting with resource agency staff on-site and completing the permit applications. Resource agencies may require additional information which cannot be reasonably scoped at this time. Schedule Winzler & Kelly will submit permit packages on behalf of the City within three weeks of receiving a notice to proceed. Once applications are submitted, we will contact the agencies to ensure that applications are found to be complete. We will attempt to expedite the permitting process as much as possible, and we hope to secure the permits within four months of project initiation. Task 15 - Environmental Document Update (Optional) Both DFG and the Regional Board may require an updated CEQA document that reflects the current conditions in the drainage way. If required by either agency, the City of Ukiah, as the Lead Agency, would need to adopt an Addendum to its 1992 EIR so long as fill of the drainage way would be a less than significant impact with implementation of mitigation. We expect that an Addendum is the appropriate CEQA document; however, if significant unavoidable impacts are identified for any reason, a subsequent or supplemental EIR may be required, which would require additional budget and schedule changes. Task 16 - Resource Agency Permitting & Coordination Winzler & Kelly will coordinate with the Corps, DFG and the Regional Board following submittal of the applications and attend up to four meetings with staff during the review process to ensure that subsequent information needs are met in a timely and efficient manner. Costs are limited to the time-and-materials costs presented in our budget. WINZLER&L-KELLY Mr. Alan Hasty June 18, 2010 Page 4 Acquisition of permits may require development of compensatory mitigation for permanent fill in wetlands or within waters; however this scope and budget does not cover the costs of development of a compensatory mitigation plan should one be required. Should the agencies require additional information beyond that which we can collect or develop within the hours allotted, Winzler & Kelly will submit an amendment for approval prior to proceeding with the work. Schedule Once applications are submitted, we will contact the agencies to ensure that applications are found to be complete. We will attempt to expedite the permitting process as much as possible, and we hope to secure the permits within four months of project initiation. Task 17 = Airport Park Boulevard Sewer Main Replacement In this task, Winzler & Kelly will design approximately 2,600 linear feet of new sewer main with manholes on Airport Park Boulevard, parallel to an existing 6-inch sewer main and providing either a redirection of sewer flows or a high-flow bypass for the 12-inch sewer main which flows east on Hastings Avenue and connects with the trunk sewer main in Talmage Road. The intent is to include the construction of this new sewer main with the Schedule I project and to leave the existing 6-inch sewer main in place and operational. We have divided this task into the following sub-tasks: Task 17.1: Utility Potholing Winzler & Kelly has obtained the known horizontal utility information along the proposed pipeline alignment, along with other available record drawing information that may affect the pipeline alignment or crossings. Using this information we will identify critical pipeline utility crossings that should be potholed during design to determine horizontal and vertical information, pipe size and pipe material. It is assumed in this task that potholing and traffic control will be provided by the City. We will coordinate with the City Maintenance Crew for utility potholing, understanding that they work 10-hours per day, 4-days per week, (no work on Friday). We will allow for at least a two-day notice when scheduling utility potholing with the City Maintenance Crew. We have budgeted time for coordination and two days of field observation and data collection during the potholing. Task 17.2: Field Survey In this task our survey subconsultant Rau and Associates will acquire additional aerial topographic survey for the proposed pipeline alignment. Additional field topographic utility information, including storm drain inlet grates and inverts, storm drain junction box and manhole rims and inverts, sanitary sewer manhole rims and inverts, water distribution system valve covers and top of operating nut, utility pothole locations and existing sewer lateral locations will be acquired. Pipe sizes and flow directions will also be identified. Task 17.3: Hydraulic Analysis, Sizing and Basis of Design We will analyze the hydraulics of the existing and proposed new pipelines and assess the need to either redirect all flows in the 12-inch Hastings Avenue sewer main to the new Airport Park Boulevard trunk main, or design the connection to operate as a high-flow bypass. The analysis WINZLER&7-KELLY Mr. Alan Hasty June 18, 2010 Page 5 will include a review of recent sanitary sewer flow monitoring data collected as part of the SSMP project. We will perform hydraulic calculations using the sanitary sewer model developed as part of the SSMP project to estimate the minimum size and slope the new sewer main to provide adequate flow capacity for existing flows in the Hastings Avenue sewer main and existing and estimated future build-out sewer flows in the Redwood Business Park. We will assume an allowance for an additional 30 percent increase in sewer flows from future sewer flows in the basin. The design criteria, including peak and average flows, velocities, minimum slopes and minimum pipe size will be summarized in a brief technical memorandum. Task 17.4 Construction Documents (50%, 95% and Final PS&E) Winzler & Kelly will prepare plans and profiles for the new sewer main. Plans will be prepared at a scale of 1"=20' and profiles will be prepared at a vertical scale of 1" = 4'. The design will be incorporated into the utility drawings for the Schedule I project, and will use City of Ukiah standard details where appropriate. The cost estimate for the Schedule I project will be revised to include the new sewer main, connections and appurtenances. We will submit five (5) sets of the 50% sanitary sewer utility plans for City review and approval. Comments will be addressed and incorporated into the 95% sanitary sewer utility plans and submitted to the City for review and approval. Comments provided by the City on the 95% submittal will be addressed in the Final (bid) submittal and incorporated into the Schedule I PS&E set, including the special provisions and the engineer's opinion of probable construction cost. Task 18 - PG&E Coordination On June 15, 2010 we were informed by the City that following a field investigation by the City Electric Department it was determined that the power pole which must be relocated as part of the Hastings Avenue widening at South State Street is not a City utility pole, but belongs to PG&E. PG&E typically needs at least three months to coordinate this type of relocation design, which will likely require the Hastings Avenue widening element to be moved to the Schedule 2 project to avoid delaying the Schedule 1 project. There are several possible options for how the power pole relocation can occur, which includes various combinations of Winzler & Kelly or PG&E performing the design, and PG&E, PG&E's contractor or the City's contractor performing the relocation work. The most cost effective approach will depends on many factors which cannot be determined at this time and must be coordinated with PG&E. In this task we will engage PG&E in the relocation design effort, including attending one meeting to coordinate our efforts on the project and identify the most cost effective and time efficient strategy to performing the design and relocating the power pole. We will summarize our efforts in a tech memo to the City outlining the various options for design and construction that will satisfy PG&E's requirements while minimizing design and construction cost and delays in the project schedule, including our recommended approach. Schedule Update A revised schedule reflecting the additional effort associated with the sewer design is attached to this letter for your review. The schedule assumes approval of the amendment during the July 7, 2010 City Council meeting. We estimate the design of the sewer main as proposed in Task 17 will require between W INZLER&T-KELLY Mr. Alan Hasty June 18, 2010 Page 6 two and two and a half months to complete. Budget Summary The following table summarizes the net budget change between Amendment No. 1 and Amendment No. 2. The value of the net difference (savings to the City) is a result of the City's selection of the "non- widening" alternative for the Talmage Road element of the Project. With selection of the "non-widening" alternative the additional structural engineering and geotechnical evaluation services described in Task 8 of Amendment No. 1 are not required.
