HomeMy WebLinkAbout2010-15 county facility within city limitsRESOLUTION NO. 2010-15 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF KIAH WAIVING THE 60-DAY NOTIFICATION REQUIREMENT FOR ESTABLISHING A COUNTY FACILITY WITHIN THE CITY LIMITS, AS REQUIRED Y GOVERNMENT CODE §25351 WHEREAS, Government Code §25351 requires that a County notify a City in advance of its intent to locate a County facility in the incorporated area; and 2. Government Code §25351 further requires that said advance notification occur at least 60 days prior to use and occupancy of the County facility, unless the City Council waives the notification requirement by Resolution; and 3. The Mendocino County Health and Human Services Agency has requested a waiver of the 60-day notification requirement to lease and use the building located at 123A and 123B Leslie Street for residential independent living space for use by the Human Services Agency to relocate clients capable of independent living from costly out-of-County settings to local residential settings; and 4. The granting of the waiver will enable the Health and Human Services Agency to immediately lease and occupy the building rather than waiting 60-days; and 5. The use of the building by the Social Services Special Investigations Unit would not be inconsistent with any City code, or the goals and policies of the Ukiah General Plan. NOW, THEREFORE, BE IT RESOLVED that the City of Ukiah grants the County of Mendocino Department of General Social Services a waiver of the 60-day notification requirement to lease and use the building located at 123A and 123B Leslie Street for residential space for use by the Human Services Agency to relocate clients capable of independent living from costly out-of-County settings to local residential settings. Currie, City Clerk RESOLUTION O. 2010- 14 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDS WHEREAS, the Finance, Community Services, City Manager, and Human Resources Departments have reviewed and approved the list of records provided by the City Clerk's Department that are ready for destruction; and WHEREAS, the attached list of City records represents records which are no longer necessary and may at this time be destroyed. NOW, THEREFORE, BE IT RESOLVED, that the Ukiah City Council hereby approves the destruction of certain records, contained in Exhibit A of this Resolution, and authorizes the City Clerk to destroy the records. Currie, City Clerk RESOLUTION NO. 2010-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH FORMALLY OPPOSING PROPOSITION 16, "THE NEW TWO-THIRDS VOTE REQUIREMENT FOR LOCAL PUBLIC ELECTRICITY PROVIDERS - INITIATIVE CONSTITUTIONAL AMENDMENT" WHEREAS, California State Ballot Petition 09-0015, Proposition 16, "The New Two-Thirds Vote Requirement for Local Public Electricity Providers," was filed with the California State Attorney General for the June 2010 statewide ballot; and WHEREAS, prior to expanding electricity service into a newly annexed portion of the City or to any portion of the City where the City's utility is not the sole provider of electricity, the proposed ballot initiative would require that a public power provider obtain two-thirds voter approval of both the voters in the existing territory and the voters in its proposed expanded territory; and WHEREAS, the proposed ballot initiative, if passed, could affect the ability of the City of Ukiah to expand and offer Ukiah Electric Utility services. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby oppose Proposition 16, "The New Two-thirds Vote Requirement for Local Public Electricity Providers" Initiative; and BE IT FURTHER RESOLVED that the City Council directs the Electric Utility Department to appropriately and proactively inform the citizens of Ukiah, California, regarding the ballot petition in accordance with California Fair Political Practices Commission regulations.
