The City Council has considered the factual information provided in Exhibit A and at the hearing conducted on August 5, 2009, in making the findings as set forth below; NOW, THEREFORE, BE IT RESOLVED as follows: 1. The City hereby consents to the Agency funding the Project; and 2. The total taxes to be disbursed by the Agency for the Project is $163,084; and 3. Based on the facts as set forth in the attached Exhibit A, the City Council hereby finds: a. The rehabilitation of the building is of benefit to the project area; b. The rehabilitation of the building will contribute to the elimination of blight. c. There are no other reasonable means of financing the rehabilitation of the building available to the community. d. The Project is consistent with the Agency's Five Year Implementation Plan, adopted on August 15, 2007. Baldwin, Mayor ATTEST: s a JoAnne Currie, City Clerk EXHIBIT A TO RESOLUTION M OF THE UKIAH REDEVELOPMENT AGENCY FOR THE REHABILITATION OF THE UKIAH RAILROAD DEPOT BUILDING The City of Ukiah created a redevelopment agency ("Agency"), adopted a redevelopment plan, and established a redevelopment project area in 1989. The Agency uses a portion of property tax revenues to undertake projects and finance improvements to reduce or eliminate blighted conditions in the redevelopment project area. The City and Agency must comply with Health and Safety Code Sections 33679, 33445, and other provisions of Community Redevelopment Law (CRL) before permitting the use of redevelopment funds for the purpose of paying all or part of the value of the land for, and the cost of installation and construction of, any public owned buildings, facilities, or improvements. . The Ukiah Redevelopment Agency has proposed the use of redevelopment funds to pay for the cost of completing the rehabilitation of the Ukiah-Railroad Depot Building located at 309 East Perkins Street. The facility is owned by the North Coast Railroad Authority ( CRA), a governmental agency. Accordingly, the City Council as the legislative body of the Agency must conduct a public hearing in compliance with Health and Safety Code Section 33679 before it can approve the disbursement of redevelopment funds for the improvement and construction of buildings to be owned by a public agency. Two weeks prior to conducting the hearing, the City is required to make a summary available for public review. The summary must state the total amount of taxes proposed to be used for the construction of the building and other improvements, and it must include the facts supporting the findings which are required by Health & Safety Code §33445. Those findings are as follows: (1) That the buildings, facilities, structures, or other improvements are of benefit to the project area or the immediate neighborhood in which the project is located. (2) That no other reasonable means of financing the buildings, facilities, structures, or other improvements, are available to the community. (3) That the payment of funds for the acquisition of land or the cost of buildings, facilities, structures, or other improvements will assist in the elimination of one or more blighting conditions inside the project. The Ukiah Railroad Depot Building Rehabilitation Project is benefit to the project area and contributes to the elimination blight. i. The Ukiah Railroad Depot Building was constructed and used as a train depot, commencing on or about 1928. However, Ukiah was last served by passenger rail service on or about 1971. Since that time, the train depot has been vacant and has deteriorated through non-use and neglect. Rehabilitation of the building will eliminate the blighting conditions caused by the non-use and neglect. ii. The vacant building has been plagued by trespassing, vandalism, littering, overnight camping, and other illegal activities which adversely impact business activities and property values. Reuse of the building will discourage illegal activities and secure the building from unauthorized entry. iii. The Depot Building has been identified by the City as a historical structure with a historic connection to surface transportation. Rehabilitation of the structure will help preserve the historical and unique character of the Downtown which has been identified as an important factor for continued economic development. iv. The Ukiah Railroad Depot Building is located directly off Perkins Street which is a major entry point into Downtown Ukiah and a significant commercial/retail corridor. Perkins Street has been specifically identified in the Ukiah Redevelopment Plan as a major thoroughfare in need of 2.
