AN ORDI:~A:;CE OF THE CITY COUSCIL OF THE CITY OP [TKIAH REPEALIAG CHAPTER 2 OF DIVISION 9 OF THE UKIAH MUNICIPAL CODE AND ADOPTING NEW CHAPTER 2, DIVISION 9 ZONING The City Council of the City of Ukiah doffs Ordain as follows: Section 1. Existing Chapter 2, Division 9 of the Ukiah ?tunicipal Code is hereby repealed, Section 2. Chapter 2, Division 9 of the Ukiah :Municipal Code is added to read as follows: CHAPTER 2 - ZOt1ING ARTICLE 1 - PURPOSE Section 9000 - Purpose: The purpose of this chapter is to promote the growth of the City of Ukiah in an or3erly manner and to promote and protect the public health, safety, peace, comfort and general welfare. Section 4001 - Zoning in conformance with General Plan: The zoning and districting plans effectuated by this chapter are in substantial conformance with the Land Use Element of the General Plan heretofore adopted by the City of Ukiah, and consists of the establishment of various districts including all the territory within the boundaries of [he City of Ukiah, and including territory hereafter included by annexation, within which the use of land and bui~iings, the space for buildings, and the height and bulk of buildings are regul~tad. Section 900? - 3ui13ing or land use not in conformance with chapter prohibited: No building or structure shall be erected, reconstructed, or structurally altered in any manner, nor shall any building or land be used for any purpose, other than as permitted bJ and in coniorr_ance with this chapter and all other ordinances, laws, and ^aps applicable thereto. Section 9003 - Consistency with State law; The authority for the regulations contained in this Ordinance is based upon Section 7 Article XI of the California Constitution in addition to California Planning .and Zoning Law and State Law providing municipalities with police power. This Zoning Ordinance is not in conflict with State statutes. .~ ~}~~. ARTICLE 2 - DISTRICTS Section 9008 - Establishment of districts: The several districts established are as follows: Single Family Residential or R-1 District Multiple Family Residential or R-2 District General Multiple Residential or R-3 District Neighborhood Commercial or C-N District Light Commercial District or C-1 District Highway Commercial and Restricted Industrial or C-2 District Manufacturing or M District Agricultural Exclusive or A-E District Planned Development or P-D District Public Facility or P-F District Combining Agricultural or - .~ District Hillside Lot Size or - H District Section 9009 - Adoption of Zoning ?fap by Reference: The designations, locations and boundaries of the districts established are, delineated upon the maps entitled "Z~ning Map for the City of Ukiah, California" dated 1963, which map and all notations and information thereon are hereby adopted and incorporated herein by reverence as a part of this chapter. Ed. Note: Section 9006 was enacted by Ordinance No. 552, Sec. 2, adopted 1964, Subsequent amendments to the Zoning ?fap are contained in Ordinance Nos. 562, 576, 585, 599, 612, 614, 615, 618, 619, 620, 622, 624, 625, 628, 629, 630, 631, 636, 642, 643, 644, 645, 655, 656, 658, 659, 661, 665, 666, 672, 674, 677, 678, 680, 681, 683, 684, 687, 693, 694, 697, 700, 703, 705, 708, 719, 722, 725, 727, 728, 735, 739, 740, 746, 750, 758, 759, 761. The City of Ukiah is hereby divided into zones or districts as shown on the Official Zoning Map which, together with all explanatory matter thereon, is hereby adopted by reference and declared to be a part of this ordinance. The Official Zoning Map shall be identified by the signature of the 14ayor attested by the City Clerk and bearing the seal of the City under the following words, "This is to certify that this is the Official Zoning t•fap referred to in Section 9006 of Ordinance No. of the City of Ukiah"; together with the date of the adoption of this ordinance. If, in accordance with the provisions of this ordinance, changes are made in the district boundaries or other matters portrayed on the Official Zoning Map, such z ~~~ ~~. -y~~.) changes shall be entered on the Official Zoning Mao promptly after the amendment has been approved by the City Council, with an entry on the Official zoning :tap as follows: "On day of 19_, by official action of the Gity Council, the following change was made in the Official Zoning liap"; which entry shall be signed by th_ City Clerk. No changes of any nature shall be made in the Official Zoning :tap or matter shown thereon except in conformity with the procedures set forth i1 this ordinance. Any unauthorized change of whatever kind by any person or persons shall be a misdemeanor. Regardless of the existence of purported copies of the Official Zoning Map which may from tine to time be made or published, the Official Zoning Map which shall be located in the City Hall shall be the final authority as to the current zoning status of land and water areas, buildings, and other structures in the City. Section 9010 - Replacement of Official Zoning Map In the event the Official Zoning Map becomes damaged, destroyed, lost, or difficult to interpret because of the nature and number of changes and additions, the City Council may by resolution, adopt a r.ew Official Zoning :fop which shall supercede the prior Official Zoning ?fan. The new Official ' Zoning Map may correct drafting or other errors or omissions in ttie prior Official Zoning Map but no such correction shall have the effect of amending the original Official Zoning Ptap or any subsequent amendment thereof. The new Official Zoning Pfap shall be identified by the signacure of the Mayor, attested by the City Clerk and bearing the seal of the Gity under the following words: "This is to certify that this official Zoning :tap adopted by 6rdinance :fo. of the City of L'kiah as sec forth in Resolution No. of the City of L'kiah. Unless the prior Official Zoning ?fop has been lost or has been totally destroyed, the prior map or any significant part thereof remaining shall be preserved together with all available records pertaining to its adoption or amendment. Section 9011 - Rules for Interpretation of District Soundaries Where uncertainty exists as to the boundaries as shown on the Official Zoning Map, the following rules shall apply: I) Boundaries indicated as approximately following in the center lines of streets, highways, or alleys shall be construed to follow such center lines. -~~-~ 2) Boundaries indicated ~s app:oxi~atei~: C?:l~'.ai~; ?lottad 1~t lines shall be construed as following such lot lines. 3) Boundaries indicated as appro:cinately follos+iny city linits shall be construed as following such city limits. 4) Boundaries indicated as following railroad lines shall be construed to be mid-way between the main tracks. 5) Boundaries indicated as following shorelines ,hall be construed to follow such shorelines and in the event of changes in the shoreline shall be construed as moving with the actual shoreline; boundaries indicated as approximately the centerline of streams, rivers, canals, lakes, and other bodies of water shall be construed to follow such enter lines. 6) Boundaries indicated as parallel to or e:ctensions of features indicated in subsections 1 through 5 above shall be so construed. Distances not specifically indicated on the Official Zoning :fap shall be determined by the scale of the map. 7) For physical or cultural features existing on the ground or at variance with those shown on the Official Zoning :4ap or in other circumstances not covered by Subsections 1 through 6 above, the Planning Commission shall interpret the District boundaries. 8) Where district boundary lines divide a lot which was in single ownership at the time of passage of this ordinance, the Planning Commission may pe wit as a special exception, the extension of the regulations for either portion of the Lot not to exceed 50 feet beyond the district line into the remaining portion of the lot. The procedure to be followed for such an extension shall be the procedure outlined in this chapter for the granting of a variance. ARTICLE 3 - REGULATIONS LN SINGLE FAMILY RESIDENTIAL (R-1) Section 9015 - Single Family Residential or R-1 Districts: The regulations contained in [his article shall apply in all R-1 Districts and shall be subject to the provisions of article 16 of this chapter, General Provisions and Exceptions. The purpose of this section is to implement General Plan Policies for @fedium Low Density Residential Areas. Section 9016 - Uses Allowed: The following uses are allowed uses in Single Family Residential (R-1) Districts: (a) Single family dwellings, including condominiums `~ ::~ (b) accessory buildings if constructed simultaneously with or subsequent to the main building on the same lot (c) Accessory uses normally incidental to single family residences This is not to be construed as allowing any commercial use. (d) Family Care Home (Maximum Clients - b) (e) Day Care (:laximum Clients - 12) (f) Home Occupations (as defined in Section 9301) (g) Mobile Homes, pursuant to Section 9177 (h) Ownership Conversion of existing units to match existing density Section 9017 - The following uses may be permitted subject to first securing a use permit in each case. (a) Public or private schools teaching curricula as prescribed by State law. (b) Churches, public buildings. (c) Parks and playgrounds. (d) Crop and tree farming. (e) Creens, but not private clubhouses, of golf courses. (f) Grounds, but not main buildings, of country clubs. (g) Home Occupations (as defined in Section 93C1). (h) Family Care Home for more than 6 c'_ients. (i) Day Care Center for pore than 12 clients. (j) Structures with maximum height above 30 ft. Section 9018 -Building height Limits: The following shall be the maximum limits for height of buildings in Single Family Residential (R-I) Districts: (a) For dwellings, a ma:cimum height of thirty feet. (b) For accessory buildings, a maximum height of twenty feet or the maximum height of the main building, whichever is less. Section 9019 - Building site area required: In Single Family Residential (R-1) Districts the building site area required for each dwelling shall be a minimum of six thousand (6,0.00) square feet and minimum width of sixty feet on interior lots; a minimum of seven thousand (7,000) square feet and a minimum width of seventy (70) Eeet on corner lots. In no case shall there be more than one (1) single family dwelling on any one (1) building site. .~ ti t> In existing density cases, there is no minimum site area. Development may occur on existing nonconfor;ning R-1 lots; a Site Development Permit is required for existing lots 4500 square feet and greater and a use permit is required on existing lots of less than 4500 square feet. :tinimum width in either case is 40 feet. Section 9020 - Front setback lines; building within prohibited; exceptions: In Single Family Residential (R-1) Districts no building construction shall be permitted or allowed at any distance closer to the street right of way line along any adjacent street than the following: (a) On interior lots the front setback liae shall Se a ainiaua of ten (10) feet veasured from the street right of way line fronting such lot, except in cases where 50% of one side of tie block is already built out the average setback shall apply. Section 9021 - Yards required: In Single Family Residential (P.-1) Districts, ::ards shall Se required in the following miniaum widths: (a) Front yards - the miniaum depth required shall be the area included within the front setback areas as defined by Section 9020 hereof. (b) Side yards - the width required shall be a miniaum of five feet. (c) Rear yards - the minimum depth shall. be fifteen feet. Section 9022 - Parking required: The minimum parking area required in Single Family Residential (R-1) Districts shall be that determined by Section 9198. Section 9023 - ,additional Requirements (a) There shall be provided on site a miniaum covered storage area of forty (40) square feet for each dwelling unit. (b) Curb, gutter, sidewalks, paving and street trees shall be installed as a condition of obtaining building permits for new residential structures on a parcel where these street improvements do not exist. 9uild- ing permits are required where [he permit value is equal to or greater than 1/3 of the value of the existing structure. 4, ~ . ~1sTRlcTs Section 9030 - >!u1[iple Family Residential ~~r 3-_' Oistr~_.t;: The regulations contained in this article shall ~epiv in all :!ultiple Family Residential (R-?) districts and shall be subject to the provisions of Article I6 of this chapter. The purpose of this section is to implement General Plan Policies for ifediun High Density Residential areas. Section 9031 - uses allowed: The following, uses are allowed uses in '!ultiplo Family .',esidential (R-2) Districts: (a) Single family dwellings, duplexes, and all .ether uses allowed or pemitted in R-1 Districts, except as noted in the fol'owing section. (b) ttultiple dwellings, apartment houses. (c) Rooming or boarding houses. (d) Home occupations, as defined in Section 9301. (e) Accessory uses and buildings normally incidental to any of the "' above. This shall not be construed as permitting any business use or occupation other than those specifically listed herein. Section 9032 - Uses per-fitted subject to first securing a use permit: The following uses may be permitted in :fultiple Family Residential (R-2) Districts subject to first securing a use oernit, as provided in this chapter, in each case: (a) Dwelling groups. (b) Social 'Halls, lodges, and public buildings. (c) Rest homes, Family Care Homes and Dav Care Centers for more than 6 clients, Nursery Schools. (d) Home occupations, as defined in Section 9301. (e) Single Family Dwelliag on a 3000 sa. ?[. lot lone side zero lot line and one side 5 ft. setback provided that "0" '.ot Lines are contiguous). Section 9033 - Building height 1ir..its: The following shall be the maximum !faits for icight of buildings in :fultiple Family Residential (R-2) Districts: (a) For main buildings a maximum height of thirty: feet. (b) For accessory buildings a maximum height of twencv fact, or the maximum height of the main building, whichever is less. Section 9034 - Building site area required: In aultiple Family Residential (3-2) 0lstricts t!ic aui'_din^ •=itc irca required shall be as follows: (a) For each building or group of buildings a minimum of si:: thousand (6,000) square feet in area and a minimum width of si:a ? feet on interior lots; a minimum of seven thousand (7,000) square feet in area and a minimum width of seventy feet on corner lots. (b) For each family unit intended to occupy any building or group of buildings on such building site area, a minimum of three thousand (3000) square feet of area. (c) A two parcel land division is allowed for a duplex structure pursuant to section 9032(e). (d) In existing density cases, there is no minimum site area. Section 9035 - Front setback lines; reduction in partially developed areas: Except as otherwise provided in this chapter, in :tul[iple Family Residential (R-2) Districts no building construction shall be pernitted or allowed at any distance closer to the street right of way line along any adjacent street than the following: (a) On interior lots the front setback line shall be a niniaum of ten (10) measured from the street right of way line fronting such lot, except in cases where 507. of one side of the blocl: is already built out the average setback shall apply. Garages and carports perpendicular to the street shall be setback twenty feet. Two story structures shall be a minimum of fifteen feet measured from the street right of way line fronting such lot. The front setback lines shall be a minimum of ten feet measured from the street right of way lines fronting such lot. Section 9036 - Yards required: In :•lultiple Family Residential (R-2) Districts, yards shall be required in the following minimum widths: (a) Front yards - the minimum depth required shall Se the area included within the front setback areas as defined b7 Section 9035 hereof. (b) Side yards - the width required shall be a minimum requirement of five feet, except as provided for in Section 9032 (e). (c) Rear yards - the minimum depth shall be ten feet. (d) Special yards and distances between buildings - minimum widths shall be as follows: _~(~~~ 1. The distance between any buildings in any dwelling group shall be a minimum of Cen feet. 2. Side yard providing access to single row dwelling group shall have a minimum width of twenty tcet. 3. Section 9037 - Parking required: The minimum parking area required in ?fultiple Family Residential (R-2) Districts shall be that determined by Section 9198. Section 9038 - Additional Requirements (a) Site Development ?emit is required for develo?.r.ent of r..ore than a single duplex. (b) There shall be provided on site a minimum covered storage area of forty (40) square feet for each dwelling unit. (c) See Section 9208 for Site Developr..ent Requirements ARTICLE 5 - REGULATIO`S IY CESE(Z4L ?IULTIPLE RESIDEVTI.IL (R-3) DISTRICTS Section 9045 - General Multiple Residential or R-3 Districts: -- Tfie regulations contained in this article shall apply in all General Multiple Residential (R-3) Districts and shall be subiect to the provisions of Article 16 of this chapter. The purpose of this section is to implement the General Plan Policies for High Density Residential areas as a transition zone between residential and commercial with the enrohasis upon residential uses. Section 9046 - Uses allowed: The following uses are allowed in General Multiple Residential (R-3) Districts: (a) All uses allowed or permitted in any R-1 or R-2 District except dwelling groups and rest homes. Section 9047 - Uses peroitted subject to first securing a use permit: The following uses may be permitted in General fultirole Residential (R-3) Districts subject co first securing a use pernit, as provided in [his chapter, in eacfi case: (a) Dwelling groups. Section 9049 - Building site area required: In General 'lultiple Residential (R-3) Districts the building site area required shall be as follows: (a) For each building or group of buildings a ninir..un building site area of six thousand (6,000) squaw feet ~+ith a mini-un width of sixty feet on interior Lots; a minimum of seven thousand (7,000) square feet with a minimum width of seventy feet on corner lots. (b) For each family unit intended to occupy any building or group of buildings on such building site area there shall be at least one thousand five hundred (1,500) square feet of site area. (c) For each mobile home park a mininum of two acres. Section 9050 - Front setback lines; reduction in partially developed areas. (d) Special yards and distances between buildings - minimum widths shall be as follows: 1. The distance between any buildings in any dwelling group shall be a minimum of ten (10} feet. 2. Side yard providing access to single row dwelling group shall have a minimum width of twenty (20) feet. 3. Inner court providing access to double row dwelling group shall have a minimum width of twenty (20) feet. Section 9052 - Parking required: The ninimum parking area required in General )'.ultiple Residential (:.-3) Districts shall be that detert:ined by Section 9198. Section 9053 - Additional requirements: (a) All new construction, exterior modifications to e::isting buildings or on-site work shall require a Site Development Pernit pursuant to Section 9208. (b) There shall be provided on site a minimum covered storage area of forty (40) square feet for each dwelling unit. ARTICLE 6 - REGULATIOtiS 1N :;EIGHBOPd100D C0:•L`tERCIAL (C-lv) DISTRICTS. Section 9060 - ~;eighborhood Commercial or C-~ Districts: The regulations contained in [his article shall apply in all Neighborhood Commercial (C-id) Districts, and shall Se subject to the provisions of ,'+rticle 16 of tfiis chapter. The purpose of this article is to implement the General Plan Policies for Commercial areas. Section 9061 - Uses allowed: ~~) ~ The following uses are allowed in 'neighborhood Cor.~ercial (C-'I) Districts: (a) Retail stores, personal service establishments and offices, all carried on within a building, including: bakery (where at least one half the floor space is used for retail purposes), bank, bar, barbez shop, beauty shop, book store, candy store, cleaning (no on site processing), drug store, florist, food store, launderette, liquor store, newsstand, photographer, ___. restaurant, shoe repair shop, tailor shoo, variety store, and all other uses which in the opinion of the Planning Commission are similar. (b) Accessory uses to any of the uses allowed in a C-N District. Section 9062 - Uses permitted subject to first securing a use permit: The following uses nay be permitted in ::ei;hborhood Co:-m~ercial (C-S) Districts subject to first securing a use permit, as orovided in this chapter, in each case: (a) Pet shops (b) Service stations, drive-in restaurants, and plant nurseries. Section 9063 - Building height limits: The following shall be the maximum limits for height of buildings in Neighborhood Commercial (C-N) Districts: , (a) For main buildings a maximum of forty (40) feet unless abutting an R-1 or R-2 lot, in which case, a maximum of 30 ft. (b) For accessory buildings a maximum of twenty (20) feet. Section 9064 - Building site area required: In Neighborhood Commercial (C-~) Districts the building site area required shall be as follows: (a) For each main building a minimum of seven thousand (7,000) square feet of area. Existing lots as of the date of this Ordinance under 7,000 square feet are considered legal building sites. Section 9065 - Front setback lines: The provisions for front setback lines in Neighborhood Commercial (C-N) Districts shall be as follows: (a) On interior lots, the front setback line shall be a minimum of 5 feet measured from the street right of way Line fronting such lot. (b) On corner lots, there shall be a front setbac'~ line on each street side of a corner lot. The Eront set-back line shall he a minimum of ten (10) feet measured from the street right of way line adjacent to such lot. Section 9067 - Parking required: The minimum parking area required in Neighborhood Commercial (C-~) Districts shall be that determined by Section 9198. Section 9068 - Additional requirements: (a) A11 new construction, exterior modifications co existing buildings or on site work shall require a Site Development Permit. ARTICLE 7 - REGULATIO;IS IN LIGriT CO`L`SERCIAL (C-1} DISTRICTS Section 9080 - Light Commercial or C-1 Districts: The regulations contained in this article shall apply to all Light Commercial (C-1) Districts and shall be subject to the provisions of Article 16 of this chapter. The purpose of this article is to implement the General Plan Policies for Commercial areas. Section 9081 - Uses allocaed: The following uses are allowed uses in Light Commercial (C-1) Districts: (a) Any use allowed or pernicted in any ^-1, 3-2, er 3-3 District, exceot for single family dwellings, duplexes or mobile ho^e parks. (b) Retail stores and personal service estahlishments carried on within a building, including: aoparel, apoliance stores, bakeries, banks, bat, barber shops, beauty parlor, book store, bowling, candy store, caterer, cleaning (agency only), clinic department store, dress shop, drug store, florist, food shop, furniture stor_, hardware score, jeweler, launderette, liquor store, millinery, new car sales, newsstand, offices, photographer, plant nurseries, print shop, radio and television repair ;hop, radio store, recreation uses, restaurant, shoe shoo, sign shoo, studio, tailor shop, upholsterer, variety store, yardage store, and all other uses which in the opinion of the Planning Commission are of a similar nature. ~~ ~--4 (c) Accessory uses [o any of the uses allowed in n ~:-1 district. Section 9082 - Uses permitted subject to first sacurin, a use permit: (a) Animal hospitals, auto repair shoos, car :ash, c:eaning and dyeing establishments, creameries, drive-in establishments, iaunderies, outdoor markets, outdoor sales establishments, pet shops, public garages, theaters, used car sales lots, mini storage, service stations, par'.cing lots, and all other uses which in the ooinion of the Planning Ccr•~tission are of a similar nature. (b) Any residential use. (c) Social halls, lodges. Section 9083 - Building height limits: The maximum height of any building in a Licht Commercial (C-1) District shall be fifty (50) feet. Section 9084 - Building site area required: No minimum building site area except for residential development e+hich shall be that of the R-3 zone. Section 9085 - 'lards required: In Light Commercial (C-1) Districts yards shall be required in the following minimum widths: (a) Front yards - none reeuired on interior parcel.
