HomeMy WebLinkAbout723 Zoning Administrator~~;(- ORDINANCE N0. 723 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF UKIAH AMENDING DIVISION 9, CHAPTER 2 OF THE CITY OF UKIAH ZONING ORDINANCE BY ADDING ARTICLE 13a - ZONING ADMINISTRATOR The City Council of the City of Ukiah does hereby Ordain as follows: Section 1. The following sections Nos. 9170, 9171, 8172, 9173, 9174 and 9175 are added to read as follows: Section 9170 Office: There is hereby created in the Department of Community Develop- ment the office of Zoning Administrator. Section 9171 Designation: The Zoning Administrator shall be the Director of Community Development and his/her designated representative. Section 9172 Function: The function of the Zoning Administrator is to achieve im- proved coordination in the administration of the Zoning Ordinance; to increase the efficiency of the zoning enforce- ment proceedings; to reduce the time required in processing applications for the various permits and to relieve the Planning Commission of certain routine functions in order that it may give its attention to its primary responsibility of comprehensive planning. Section 9173 Authority: The Zoning Administrator shall have the authority and it shall be a duty of this office to conduct public hearings in the manner described by Section 9242 of the Zoning Ordinance and to make determinations regarding certain use permits, variances, modifications of conditions of approval, and architectural alterations as described herein. a) The Zoning Administrator may approve, approve with condi- tions or deny Use Permits as specified in the Zoning Ordinance as permitted uses, where no new construction or exterior alteration is contemplated and where the pro- posed use is similar to and compatible to the adjacent uses. b) The Zoning Administrator may approve, conditionally approve or deny certain variances to the regulations prescribed by the Zoning Ordinance in accord with the procedures pre- scribed for a variance with respect to fences, walls, hedges, screening, and landscaping; building site area, width, frontage and depth; front, rear and side yards; height of accessory structures; distances between struc- tures; signs; off-street parking and off-street loading facilities. c) The Zoning Adminis-rator may approve modification of con- ditions of approval of a Use Permit or Site Development Permit. d) The Zoning Administrator may approve minor Site Development Permits, where no new structure is proposed but review of modifications is necessary. ., ,~ 1 e) The Zoning Administrator may accomplish all administrative actions required by the Ordinance, including public hear- ing and meeting notification, preparation of reports, con- sidering approval, conditional approval or denial of appli- cations, receiving and processing appeals, receiving and accounting for fees and other actions as required to pro- cess applications. f) The Zoning Administrator supervises staff members assigned to the Zoning Administrators office. g) The Zoning Administrator shall report regularly to the Planning Commission on the activities of this office in- cluding number and types of cases considered and their disposal and recommendations for change and improvements in ordinance regulations and procedures. Section 9174 Referal to the Planning Commission: The Zoning Administrator may refer any application for a variance or permit to the Planning Commission for public hearing. Section 9175 Appeals: Any person who is dissatisfied with a ruling or interpretation of the Zoning Administrator may appeal the matter to the Planning Commission. Such appeal shall be made in writing to the Zoning Administrator who will cause the matter to be scheduled for a public hearing by the Planning Commission in the manner specified in Section 9242 of the Ordinance. Section 2. This ordinance shall be published as required by law in a newspaper of general circulation published in the City of Ukiah. Section 3. This ordinance shall become effective 30 days after its adoptions.
